November 6, 1986
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building, November
6, 1986.
Present: Chairman Pete Anderson, Commission members Dee Stalder,
Bob Allen, Myrna Cain, Becky Hopkins, Council representative,
City Attorney Lynn Winmill, Public Works Director Steve Smart.
Excused Sue Parrish, Evan Byington, Ted Corrington and Bob
Anderson, Boyd Fullmer.
Meeting called to order at 7:45 by Chairman Anderson.
Chairman Anderson asked for anyadditions or corrections to the
minutes of September 4, 1986, there being none, Dee Stalder
made motion to accept mintes as mailed. Myrna Cain seconded
the motion, with all commission members voting in favor.
PUBLIC HEARING ITEM:
A PROPOSAL BY GATE CITY CHRISTIAN CHURCH FOR A CONDITIONAL
use permit for construction of a church building on the west
half of Block 18, Paradise Acres Subdivision, 202 Syphon
Road. Property is presently zoned General Residential (R-2).
Chairman Anderson opened public hearing and asked for comment
from Steve Smart. He said a church is conditionaly allowed
in all zones except Industrial; this piece of property is
zoned General Residential (R-2). He said the city was interested
in seeing this property developed.
Tom Myers, Architect for project, 444 So 7th, Pocatello, Idaho,
said property ~ at Yellowstone and Syphon Road, it is
approximately half of Lot 18, Paradise Acres Subdivision.
He said the entrance to the church will be off from Syphon
Road, with residential ~ two sides.
Mr. Myers said church would be built in two phases, with the
second, and larger building, being built when funds are
available. He said there would be a two way entrance, with
parking around and behind the building. Mr. Myers said
there would be a 20' planting strip around the outside, the
two sides adjacent against residential property.
Chairman Anderson opened public hearing for public comment,
there being none, he closed the public hearing and asked for
comment from the commission members.
Becky Hopkins asked about having only one exit and entrance. Mr.
McMurdie, 1499 Sierra, Pocatello, said they had a membership
of about 110 people, and there would not be that many cars
involved.

Bob Allen asked about the lighting of the church yard.
Myers said lighting would be directed inward.
Mr.
Commission members discussed if fire truck would be able to
turn around in church yard. It was determined that they
would be able to do so.
Becky Hopkins made motion that the conditional use pemit be
granted to the Gate City Christian Church to permit
construction of a church on the west half of Block 18,
Paradise Acres Subdivision, 202 Syphon Road, with the
following conditions:
a) Lighting to be directed inward, away from
residential area.
b) Second phase, landscaping to be continued on
the west and north side, to be planted with trees.
Myrna Cain seconded the motion. Roll call vote: Allen, yes;
Stalder, yes; Hopkins, yes, Cain, yes; Anderson, abstained.

AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ENACTING A NEW
Chapter 18.14 of the Chubbuck Municipal Code to provide for
landscaping requirements for all set-back and yard areas
and off-street vehicular parking and open-lot sales and
service areas; repealing prior conflicting ordinances; and
providing when this ordinance shall become effective.
Chairman Anderson opened public hearing, there being no comment
public hearing closed.
After discussion commission members asked to have the addition
made on Page 3, C. Plant Material .... , Paragraph 2. A list
of accepted tree species, shrub and ground cover .......
Dee Stalder made motion to recommen the Landscape Ordinance
enacting a new Chapter 18.14 of the Chubbuck Municipal
Code, with the addition above included, to the City
Council for their approval.
Myrna Cain seconded the motion. Roll call vote, Allen, yes;
Stalder, yes; Hopkins, yes; Cain, yes; Anderson, yes.
Motion to adjourn made by Dee Stalder at 8:25 p.m., with all
voting in favor.
