Minutes of a special meeting of the Land Use and Development
Commission held in the city municipal building, July 17,
1986.
Present: Chairman Pete Anderson, Commission members Dee
Stalder, Bob Allen, Sue Parrish, Ted Corrington, Myrna
Cain, Council Representative Becky Hopkins, Attorney
Lynn Winmill, Public Works Director Steven Smart and
Dorothy Ward, Secretary. Evan Byington was excused.
Meeting called to order at 7:30 p.m. by Chariman Anderson.
PUBLIC HEARING ITEM:
1. A PROPOSAL BY THE CITY OF CHUBBUCK, 5160 YELLOWSTONE
AVENUE, CHUBBUCK, IDAHO, FOR A CONDITIONAL USE PERMIT TO
ALLOW the City to operate a swimming pool with related
concessions on a tract of land, SW1/4 SE1/4 SE1/4 Section
3.T.6S., R. 34E. Bannock County, on the north side of East
Chubbuck Road. Property is presently zoned Industrial (I).
Chairman Anderson turned gavel over to Bob Allen, to act as
Chairman, due to conflict of interest.
Chairman Allen read from the Land Use Ordinance, the criteria
standards for a conditional use permit.
Steve Smart, reported for city, that the city has option on
the piece of land, 5 acres, east of the railroad tracks on
the north side of Chubbuck Road, for a swimming pool. The
property is zoned Industrial (I), swimming pool is not
listed under General Controls, therefor the need for a
conditional use permit.
Jerry Myers, Myers, Anderson and Myers, said the Architects
had worked closely with the swimming pool committee and
the city council on the swimming pool. He said several
sites had been considered and they considered this site
the most reasonable, taking into consideration the area,
access to it and cost made it the best site for the dollar.
Mr. Myers said the site layout met all Chubbuck Land Use
zoning ordinances. The buffer zones had been layed out,
with measures for safety at the railroad tracks for those
using the facility.
Mr. Myers said no traffic study had been made on the traffic
on East Chubbuck Road. He said that a bike path was planned
from Yellowstone Avenue to the site.
Chairman Allen opend the public hearing for comment from the
audiance.
Dee Greene, 410 E Chubbuck Road, adjacent property owner, said
he strongly objected to the site. He expressed concern about
the invasion of his privacy, lights, noise, litter, the
increased traffic and concern due to the number of trains
that travel in the area each day with children involved
crossing the tracks.
Mr.-Greene said the devaluation of his property was questionable.
He was concerned that there were no sidewalks or bike paths
on East Chubbuck Raod.
Franklin Briscoe, 5058 Whitaker Road, expressed concern about
the traffic and the trains.
Rodney Parrish, 689 E. Chubbuck Road, said there would be
expensive costs involved in widening East Chubbuck Road,
and putting in curb, gutter and sidewalk.
William Nice, 418 E. Chubbuck Road, expressed the same
concerns as Mr. Green, and stated there was irrigation
water in area of the site that would have to taken into
consideration. Mr. Myers said he was not aware of the
irrigation water.
Florence Copeland, 319 E. Chubbuck Road, said she was concerned
about the traffic, noise, lights and the irrigation water.
Mr. Myers said the lighting would be minimal as the pool would
be operated in th day light hours. He said the parking lot
could be made secured, so there would be no one using it
after the pool closure.
Commission members discussed with those present the items
they were concerned about.
Chairman Allen closed the public hearing.
Commission members discussed the following items:
a) Securing the parking lot
b) Protecting irrigation water
b) Bike paths
c) Buffering noise
d) Low diffusion lights
e) Cross walks
Becky Hopkins made motion to grant the City of Chubbuck, 5160
Yellowstone, Chubbuck, Idaho, a conditional use permit to
allow the City to operate a swimming pool with related
concessions on a tract of land. SW1/4 SE1/4 SE1/4 Section 3.t.
6S., R.34E. Bannock County, on the north side of East
Chubbuck Road, at 320 East Chubbuck Road with the following
conditions:
1) Close parking lot 30 minutes after closing of pool.
2) Protect irragation water.
3) Construct bike path , Yellowstone to Hiline Road.
4) Solid wood or masonry fence on the east boundry,
beyond facility on northern boundry, chain link
with slats.
5) Cross walks to be provided.
6) Low diffusion lighting to be used, lighting not to be
disruptive to neighbors.
* Correction to minutes 7) Turn bay to be added
Myrna Cain seconded the motion.
Roll call vote: Cain,yes; Hopkins, yes; Corrington, yes;
Parrish, yes; Stalder, no; Allen, yes.
Chairman Anderson at this time took over as chairman.
Chairman Anderson asked commission members to study the
of Landscape Ordinance that had been passed out.

Chairman Anderson asked for nominations for a new chairman.
Bob Allen nominated Chairman Anderson, seconded by Sue
Parrish. Dee Stalder nominated Bob Allen as chairman.
After vote taken, Chairman Anderson will continue as
Chairman for the coming year.
Dee Stalder made motion to adjourn at 9:15 p.m., seconded
by Bob Allen. Motion carried.
