February 6, 1986
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building, February
6, 1986.
Present: Chairman Pete Anderson, Commission Members: Mayor
John O. Cotant, Jr., Sue Parrish, Myrna Cain, Robert Allen,
Evan Byington and Bob Anderson, Attorney B. Lynn Winmill,
Public Works Director Steven Smart and Dorothy Ward, Secretary.
Dee Stalder and Ted Corrington were excused. Mr. Byington,
Mr. Anderson and Mr. Corrington are new members of the
Commission.
Meeting called to order at 7:30 p.m. by Chairman Anderson.
Chairman anderson asked for any additions or corrections to the
minutes of December 5, 1985. Chairman Anderson asked the minutes
be corrected on page two, under review of General Controls, to
read meeting would be held on January 9, 1986
Myrna Cain made motion to accept minutes as corrected, Robert Allen
seconded the motion, with all commission members voting in favor.
OTHER BUSINESS:
1. Chairman Anderson said a certified letter had been sent to
Peggy Stebbins, concerning her conditional use permit. The letter
had not been delivered until January 13, 1986, and Mrs. Stebbins
had not called the city office, and was not at this meeting. Item
tabled until later in the meeting.
2. CHANGING OF THE COMPREHENSIVE PLAN OF THE CITY OF CHUBBUCK.
Chairman Anderson reviewed with the new members the process that
had taken place. Commission has drafted a multiple housing
ordinance, in doing this have created two new zones, an R-3
and and R-4 zone, and made recommendations to the City Council.
The City Council has asked the commission to define where these
zones should be. It was the opinion of the commission that
at this time the zones would not be created as such; but would
be created as developers asked for them. Therefore it is
necessary to make a change in the comprehensive plan to allow
it. Attorney Winmill has prepared an amendment which he feels
will handle this intent; a public hearing needs to be held on
the amendment.
The commission discussed the amendment as prepared by Attorney
Winmill.
Mayor Cotant made motion to instruct Attorney Winmill to add
R-2 zone following, for commercial and industrial, in the
amendment, third line from the bottom, and to hold a public
hearing on the Amendment to the Comprensive Plan on March
6, 1986.

Sue Parrish seconded the motion, with all commission members
voting in favor.
3. MULTIPLE HOUSING ORDINANCE - GENERAL CONTROLS.
The commission studied the general controls as listed in the
Multiple Housing Ordinances and made new recommendations.
Sue Parrish made motion to hold a public hearing on the Multiple
Housing Ordinance including the General Controls, on March
6, 1986. Myrna Cain seconded the motion, with all commission
members voting in favor.
4. LANDSCAPING ORDINANCE: It was decided the commission
would table this item for further study.
Myrna Cain made motion to table the Landscaping Ordinance until
March 6, 1986, to give commission members time to do further
study of material handed out. Bob Anderson seconded the
motion with all commission members voting in favor.
Chairman AnderSon adjourned meeting at 9:30 p.m.
