August 7, 1986
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building, August 7,
1986.
Present: Chairman Pete Anderson, Bob Anderson, Sue Parrish,
Evan Byington, Council Representative Boyd Fullmer,
Building Official Cary Campbell, Secretary Dorothy Ward.
Bob Allen, Myrna Cain and Dee Stalder were excused.
Meeting called to order at 7:40 p.m. by Chairman Anderson.
Chairman Anderson asked for any additions or corrections to the
minutes of June 5, 1986. There being none, Evan Byington
made motion minutes be approved as written. Bob Anderson
seconded the motion, with all commission members voting in
favor.
Chairman Anderson asked for any additions or corrections to the
minutes of July 17, 1986. Sue Parrish asked for minutes to
be corrected to the motion to add - 7) Turn bay to be
installed. Evan Byington seconded the motion, with all
commission members voting in favor.
PUBLIC HEARING ITEM:
1. PROPOSAL BY CHRIS AND DEBBIE CAHOON FOR A CONDITIONAL
use permit to place a double mobile home on a piece of property
located at 4503 Burley Drive, Chubbuck, Idaho. Property is
presently zoned General Commercial (C-2).
Chairman Anderson asked for comment from Cary Campbell. Cary
said there was not enough information on application; there
would be no problem if land had been divided since the
subdivision ordinance had taken affect, then a question if
the third mobile home, on same piece of property, would
constitute a mobile home court. If this is the case then
they would have to satisfy ordinance for a mobile home park.
Edith Cahoon, 4503 Burley Drive, mother of Chris Cahoon, said
she owned the ground. She said she lived in one of the
mobile homes and her 86 year old parents lived in the other,
that it was there on a conditional use permit. She said
there was about 31/2 acres and she could no longer take
care of it, and would like to have her son live there and
be able to take over the care of the yard.
Chairman Anderson opened public hearing for comment. There being
none, public hearing closed.
Commission members discussed:
1. Three units on one piece of property.
2. Ordinance covering a mobile home park.
3. If it would constitute a subdivision.
CHRIS AND DEBBIE CAHOON CONDITIONAL USE PERMIT.
Sue Parrish made motion to grant conditional use permit to
Chris and Debbie Cahoon for a double wide mobile home to
be placed at 4503 Burley Drive, Chubbuck, Idaho with the
following conditions:
a) When or if parents of Mrs. Cahoon no longer living
in mobile home, this home to be removed.
b) Mobile home to be placed on permit foundation and
meet all city codes.
c) If Chris Cahoon move from mobile home new residents
would have to apply for a conditional use permit.
Evan Byington seconded the motion.
Chairman Anderson asked if there was any other comment. Boyd
Fullmer said relative to structure of property with three
mobile homes the Building Official or City Attorney should
appe~ decision to City Council, with all commission members
in agreement, to determine if subdivision ordinance or
mobile home park is being by passed.
Roll call vote: Fullmer, yes; Byington, yes; Parrish, yes;
Anderson, yes; Chairman Anderson, yes.
2. PROPOSAL BY CARL C. PACKER FOR A CONDTIONAL USE PERMIT
to place a double wide mobile home on a piece of property located
at 130 Ward Drive, Chubbuck, Idaho. Property is presently zoned
General Commercial (C-2).
Mr. or Mrs. Packer were not present.
Chairman Anderson asked for comment from the city. Cary Campbell
said a mobile home could be placed in a commercial area.
Cary Campbell said the comprehensive plan shows Valenty Road being
extended to th north, if this would happen, the mobile home
would be in the way, he said it could be moved to the east if
granted.
Chairman Anderson opended public hearing for comment. Jerry
Tydeman,5008 Yellowstone, said he had no objection to the
mobile home as long as the Packers would be aware they were
in a commercial zone and there would be trucks in and out 24
hours a day with reefers running day and night.
Bob Anderson, president of East Chubbuck Building Complex, said he
had no problem with the mobile home but it would be in a
commercial area, with considerable noise.
Public hearing closed.
Boyd Fullmer made motion to table item at this time, Carl Packer
was not present and a quoram not present to vote on issue,
as Bob Anderson had a conflict of interest.
Sue Parrish seconded the motion. Roll call vote: Fullmer, yes
Byington, yes; Parrish, yes; Anderson, yes; Bob Anderson
abstained.
3. REVIEW OF PRELIMINARY PLAT OF THE K SUBDIVISION TO BE
developed by Kent S. Kunz, a subdivision located SE1/4 SE1/4
Section 3T.6S. R.34E. B.M., from 4801 to 4839 Whitaker Road,
Chubbuck, Idaho.
Tim Shurtliff, 4943 Redfish, representing Kent Kunz said project
at the corner of Chubbuck and Whitaker Road. Existing
home and home on end lot of subdivision create two additional
building lots. He said they were asking for waiver of
improvements until such time rest of road improved; also
asking no additional right-of-way for Chubbuck Road be
required. They feel two additional houses will not create
significant traffic on Whitaker Road or a traffic change on
East Chubbuck Road.
Letter on file in city offices from Mr. and Mrs. Kunz.
Property has been divided once; but not an illegal subdivision,
to divide further requires a plat.
Public hearing opened for comment. Terry Briscoe, 4849 Whitaker
Road, said people in area seemed to like the rural feeling
of area.
Dan Kunz, 5157 Whitaker Road, said he had lived in area many years
and Whitaker Road has become an attractive area. He said homes
would be better than a barnyard with animals.
Public hearing closed.
Commission members dicussed:
1. Chubbuck Road right-of-way.
2. Waiving curb, gutter and sidewalk.
3. City has required curb and gutter on Chubbuck Road.
4. Have required other property owners to develop
according to ordinance and not fair to let others
develop without curb, gutter and sidewalk.
5. Extra frontage for widening Chubbuck Road.
6. Subdivision Ordinance.
Chairman Anderson asked Boyd Fullmer if he would inform the
City Council three very demanding public hearing items
have had legal questions and the attorny was not at meeting.
A preliminary plat, discussion of streets, where city
engineer not present. Would like council to instruct
these people when such items appear on agenda they be present
at meeting. Commission was not aware of correspondence
between Mr. Winmill and Mr. Robinson.
Commission members agreed with Chairman Anderson's remarks and
Mr. Fullmer asked the minutes so reflect their concern.
The Commission Members decided to meet Tuesday, August 12, 1986,
and have City Engineer and City Attorney present to make
recommendations to the city council, on the preliminary
plat of K Subdivision.
Evan Byington made motion to table public hearing on K Subdivision
until Tuesday, August 12, 1986, at 6:30 p.m. Sue Parrish
seconded the motion. Roll call vote: Fullmer, yes;
Byington, yes; Parrish, yes, Anderson, yes; Anderson, yes.
OTHER BUSINESS:
1. REVIEW OF RANDY KRESS CONDITIONAL USE PERMIT TO ALLOW
placement of mobile home for an office at 4674 Yellowstone Avenue.
Commission members discussed with Mr. Kress the requirement he
have curb, gutter and sidewalk installed on East Linden
in 18 months. Mr. Kress said they had met with Mayor
and Council over having an Insurance office in mobile
home and had agreed to have a permanent building, with
curb, gutter and sidewalk in three years.
Bob Anderson made motion to extend conditional use permit for
16 months, at that time to come in for a review. Boyd
Fullmer seconded the motion, with all commission members
voting in favor.
Meeting adjourned at 10.-00 p.m.
