May 5, 1988
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building May 5, 1988.
Present: Chairman Pete Anderson, Commission Members Larry Call,
Robert Allen, Jerry Tydeman, Myrna Cain, Richard Pearson,
Attorney Tom Holmes; Public Works Director Steve Smart, and
Secretary Myrna Crapo.
Meeting called to order at 7:30 pm by Chairman Anderson.
Chairman Anderson asked for any additions or corrections to the
April 7, 1988 minutes. There being none Myrna Cain moved
to approve the minutes as mailed. Larry Call seconded the
motion, with all commission members voting in favor.
PUBLIC HEARING:
1.)
A PROPOSAL BY DANIEL L. GRIFFITH, 212 Joel, Chubbuck, Idaho
for a variance to build a garage to within 5' of the property
line. Property is presently zoned Limited Residential (R-2).
Chairman Anderson asked for comments from the city.
Smart read the requirements for a variance.

Mr. Daniel Griffith, 212 Joel explained that he wanted to
expand his garage so he could get his truck out of the weather.
He told the commission that there was another home in his
neighborhood that had build a garage, since he moved in, close
to the property line as he wanted to do.
The neighbors house was 7' from the property line. The commission
questioned Mr. Griffith on the easement at the back of his
home.
Chairman Anderson opened the meeting to public comments. Gary
Wilkins, 222 Joel told the commission he had no problems with
putting the garage next to his place.
The public hearing was closed and the meeting was opened to commission
for discussion.
The commission then discussed: 1. Can the dimensions of the garage be changed.
2. Other similiar garages in the area
3. Fire problems
4. Setting a precedence
Mr. Griffith told the commission that it would be a drive through
garage with a single door in the back.
Myrna Cain made a motion to grant the variance for Daniel L. Griffith
to add the addition onto the garage.
Jerry Tydeman seconded the motion with the stipulation that the
door in the back is installed.
Myrna Cain accepted that addition to her motion.

A roll call vote: Myrna Cain, yes; Richard Pearson,
Pete Anderson, yes; Jerry Tydeman, yes; Larry Call, yes;
Robert Allen, yes.
GENERAL BUSINESS:
1. REVIEW OF A CONDITIONAL USE PERMIT FOR PINE RIDGE BMX TO operate
a bicycle motorcross tract at the Pine Ridge Mall.
Steve Weighall, 4967 Elizabeth, represented the BMX Pine Ridge.
He explained that last year that were a couple of minor injuries
with broken ankles. The racers must have their parents consent
and be a member of the association. The association carries
insurance on the mall with the City of Chubbuck listed on
the certificate. The racers also have a seperate medical
insurance on themselves.
The conditions set down by the commission last year were met.
This year they need to haul in more dirt to cover some rocks
and the signs that were up last year need to be replaced as
they have been taken.
When the insurance certificate arrives a copy will be forwarded
to the city.
Chairman Anderson suggested that the yearly review be dropped
and that a reveiw be held only if the location is moved.
Richard Pearson made a motion to grant the conditional use
permit for the Pine Ridge BMX to operate a bicycle motorcross
at the Pine Ridge Mall and that the annual review be changed
to the point that we need a review if the track site is moved
and that the same conditions apply as in the past. Larry Call
sesconded with all members voting in favor.
2).
REVIEW OF A CONDITIONAL USE PERMIT FOR DELORES J. BARRUS to
operate a day care center at 4562 Burley Drive.
The city had not received any complaints on the day care center.
The commission questions Mrs. Barrus on:
1. Feelings of neighbors - the one neighbor who opposed
it moved away
2. Children access to the street. - there is a fenced
back yard.
3. Amount of parking available - for nine cars
4. Meeting all the requirements of the City - They had
been passed on by Cary Campbell, city inspector.
5. Number of people at one time - usually 5 from data
center
6. Number of years she has had children- 2½ years
7. The length of tsime since the original application
8. Doing away with yearly review.
Robert Allen moved that we continue the conditional use
permit for Mrs. Barrus along with all the conditions being
met; and that we do away with the yearly review. Myrna Cain
seconded with all commission members voting in favor.

4). DISCUSSION OF LIVESTOCK and it's allowed use within the city.
LeRoy Quick from the council was the only member present and
so they lacked a quorum.
The livestock ordinance was presented to the commission and
councilman Quick. A short discussion was had on livestock.
A map of areas in the city with over ~ acres of ground was
presented.
The commission will review the ordinance and meet with the
council at the commissions meeting in June.
4). REVIEW OF THE FINDING OF FACTS AND CONCLUSIONS OF LAW ON RICHARD
& CATHERINE CONN.
Chairman read the finding of facts to the commission.
Jerry Tydeman made a motion that the finding of facts and
conclusions of law be approved. Richard Pearson seconded
with all commission members voting in favor.
Jerry Tydeman moved to adjourn at 9:00 pm with Larry Call seconding.
