July 7, 1988
Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building July 7, 1988.
Present: Chairman Pete Anderson, Commission Members Myrna Cain,
Bob Anderson, Richard Pearson, City Council member David Landon,
Attorney Tom Holmes, Public Works Director Steve Smart, and
Secretary Myrna Crapo.
Chairman Anderson asked for any additions or corrections to the
May 5, 1988 minutes. There being none Myrna Cain moved to
approve the minutes as mailed. David Landon seconded the
motion, with all commission members voting in favor.
PUBLIC HEARING:
1)
A PROPOSAL BY DONALD B. MITCHELL, 261Briscoe for a variance
to put a permanent foundation and remodel a Class III Mobile
Home at 261Briscoe. Property is presently zoned R-2, Limited
Residential.
Steve Smart represented the city informed the commission:
1. That the proposed lot width was less than the 60' minimum
lot width
2. It doesn't meet the ordinance standards
Attorney Holmes stated that the application didn't meet the
definition of a variance set forth in the Chubbuck Code.
Chairman Anderson asked for any comments from the Mitchells.
Mrs. Mitchell reviewed their feelings.
Chairman Anderson opened the public hearing and then closed
it. No one was present for the hearing.
The Commission then discussed:
1. the existing trailers in the area
2. Letter from the Fire Chief
3. The requirements thet must be met
4. Bring the trailer up to a Class II Production standards
5. Lot size being approximately 49'
David Landon moved that the city grant the application with
a 49' lot under the stipulation that the applicant meet these
five requirements mentioned in Mr. Carmpbell's letter or they
bring in another trailer that does meet these requirements
if they feel like that its too costly to do that.
Steve Smart addressed the concern that we had advertized to
put it on a foundation and we were not calling it a conditonal
use permit as long as they meet the requirements and split
the lot up.
Attorney Holmes advised the commission that to allow a Class
II you need a conditional use permit and we had not gone through
the hoops for that permit, they were there on a variance.

The commission then discussed:
1. Remodeling from a class III to an upgraded Class II
2. Denying it and comming back for a conditional use permit
3. Being advised incorrectly on the original application
4. Flag lot
5. County tax notice
6. Changing the zoning in the land use ordinance
7. A new hearing at city expense because of erroneous information
being given the Mitchell's.

Attorney Holmes told the commission they needed a variance
and a conditional use permit.
David Landon withdrew his motion
Richard Pearson moved that we deny the variance to put in
a permanent foundation and remodel a Class III Mobile Home
at 261 Briscoe.
Roll call vote: Myrna Cain, yes; David Landon, yes; Bob Anderson,
yes; Pete Anderson, abstain; Richard Pearson, yes.
Richard Pearson moved that the city be directed to readvertize
at the city expense a public hearing for a conditional use
permit to allow a Class II Mobile Home and for a variance
for a 49' lot and for an extension for the existing Mitchell
variance for three months. Myrna Cain seconded the motion.
Roll Call vote: Myrna Cain, yes; David Landon,yes; Bob Anderson,
yes; Pete Anderson, abstain; Richard Pearson, yes.
A PROPOSAL BY THE CITY OF CHUBBUCK TO AMEND THE CHUBBUCK LAND
USE CONTROLS TO PERMIT LIVESTOCK in some residential areas
and to allow livestock in commercial and industrial areas
by conditional use permits.
Chairman Anderson opened the public hearing.

David Landon made a motion to recommend to the city council
that the livestock ordinance be approved. Richard Pearson
seconded.

GENERAL BUSINESS:
1. Chairman Anderson asked that a new chairman be considered
as he has been chairman for some time; at the next meeting they
will consider a replacement
2. Steve Smart informed the commission that the Idaho Planning
Association is having an annual conference this fall and had invited
the planning commission to attend any and all sessions. Some of
the meeting would be geared to the needs of commission members.
They are scheduled for October 5th and 6th. The city would pay
their registration fees.
3. Engineer Smart also informed the commission that Daniel
Griffith when he had applied for a variance on a garage setback
had misinformed the commission by telling them that there was another
garage in that area built the same way under our present ordinance.
Steve had found the building permit showing it being built prior
to our current ordinance.
Pete Anderson moved to adjourn
