Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building September
7, 1989
Present: Chairwoman Sue Parrish, Commission Members: Myrna
Cain, Richard Pearson, Pete Anderson, Kent Kearns; Project
Engineer Gerd Dixon, Engineer Steve Smart, Attorney Tom
Holmes, City Council Representataive LeRoy Quick, Secretary
Myrna Crapo
Meeting called to order by chairwoman Sue Parrish at 7:30 pm.
Chairwoman Sue Parrish asked for approval of the minutes of
August 3, 1989 meeting. Pete Anderson moved that the
minutes of the August 3 meeting be approved as mailed.
Kent Kearns seconded the motion. All commission members
voted in favor.
GENERAL BUSINESS:
1. A PROPOSAL BY GARY RATLIFF, 4970 APACHE FOR A CONDITIONAL
USE PERMIT to build a mini storage at 201 W. Linden.
Mr. Ratliff had requested a postponement until the next
meeting as he was not ready at this time.
2. REVIEW PROPOSED ORDINANCE TO AMEND THE CHUBBUCK LAND USE
ORDINANCE TO PROVIDE FOR SCREENING OF COMMERCIAL PRODUCTS
STORED OUTDOORS.
The Commission discussed each section of the proposed
ordinance. Item 5. D was in conflict with Item 3. The
commission then discussed that conflict.
Richard Pearson moved that we add "Not withstanding the
provision of Paragraph #3"to number 5. Pete Anderson
seconded the motion. All commission members voted in
favor.
Pete Anderson moved that we advertise this for public
hearing for the next meeting. Richard Pearson seconded
the motion. All voted in favor.
3. A REQUEST FOR A WAIVER OF PLATTING REQUIREMENTS FROM GEORGE
AND KENT SHIOZAWA, 4828 Yellowstone for property on the
West side of Whitaker Road (outside of the city limits.)
Chairwoman Sue Parrish invited comments and discussion
from those present.
Kent Shiozawa explained to the commission the reason for
the request. They were requesting to hook-up to the city
sewer and water. Two of the lots would be sold and he
would build on the 3rd lot.

The commission then discussed the following:
1.Cost of city services outside the city versus increased
taxes.
2. Require annexation into the city
3. Putting in sidewalks at a later date
4. Being consistent in invoking subdivision rules and
land improvement ordinance
Pete Anderson moved that we recommend to the City Council
the granting of the waiver of platting on the property
of George and Kent Shiozawa with the stipulation that
they be annexed into the city and as a condition of the
granting of the wavier of platting that when sidewalk
is developed along Whitaker Road that the sidewalk would
be developed along these three lots. Kent Kearns seconded
the motion.
Roll call vote: Myrna Cain, yes; Richard Pearson, yes;
Pete Anderson, yes; Sue Parrish, yes; LeRoy Quick, yes;
Kent Kearns, yes.
OTHER BUSINESS:
1. Pete Anderson asked that the city list mini-storage sites
on their schedule.
The commission members felt that the following schedule
should apply:

Pete Anderson moved that we have the city attorney draw
up the ordinance for adding mini storage to Land Use General
Controls along with a definition of what is classified
as mini storage.
Myrna Cain seconded the motion. Roll call vote: Myrna
Cain, yes; Richard Pearson, yes; Pete Anderson, yes; Sue
Parrish, yes; LeRoy Quick, yes; Kent Kearns, yes.
2. The Commission recommended Ray England or Gail Anderson
to replace Robert Allen who had resigned from the commission.
3. Kent Kearns asked if the city could provide orientation
for new members of the Planning and Zoning Commission.
Pete Anderson moved to adjorn at 8:30 pm with Kent Kearns seconding.

LAND USE AND DEVELOPMENT COMMISSION
FINDINGS OF FACT, CONCLUSIONS OF LAW AND RECOMMENDATION
RE: WAIVER OF PLATTING
This matter having come before the Land Use and Development
Commission as required by law, on September 7, 1989, upon the
application of Kent Shiozawa (hereinafter referred to as
"applicant") for a waiver of platting for the real property
located just North of Dan Kunz's property on Whittaker Road (See
attached) and the Commission having heard testimony from
interested parties and being fully advised in the matter, now
makes the following:
FINDINGS OF FACT
1. Applicant has applied for a waiver of platting as
particularly described above.
2. All legal requirements have been met.
3. The property is located outside the city limits but
within the City of Chubbuck's area of impact.
4. Relevant criteria and standards for consideration of
this application are set forth in Chapter 17.12, Chubbuck Code.
5. The facts relevant to an evaluation of the relevant
criteria and standards are as follows:
A. Services are accessible to the property and the
property is served by Whittaker Road, curb, gutter and sidewalk
are not necessary at this time due to the area's development.
B. The proposed development neither creates a street nor
constitutes a subdivision
BASED UPON THE FOREGOING FINDINGS OF FACT, the Commission
hereby enters the following:
CONCLUSIONS OF LAW
1. The proposed waiver would not have a significant impact
upon the City's Comprehensive Plan.
2. The waiver of platting, if granted, should be maintained
subject to the conditions set forth below.

DECISION
1. The Land Use and Development Commission, pursuant to the
foregoing, finds that the requested waiver of platting of the
applicant should be granted and the Commission makes such
recommendation to the Chubbuck City Council.
2. The Commission recommends the following conditions, if
any, be imposed upon the granting of said waiver of platting and
applicant, by taking advantage of said waiver of platting permit
would agree to the imposition of the same:
A. The property be annexed in to the City.
B. The applicant agrees to install sidewalks along
Whittaker Road when sidewalk is developed.
