Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building May
4, 1989.
Present: Chairwoman Sue Parrish, Commission Members: Myrna
Cain, Jerry Tydeman, Bob Anderson, Pete Anderson, Kent
Kearns, Richard Pearson; Council Representative Dwaine
Kinghorn, Public Works Director Steve Smart, Project
Engineer Gerd Dixon, Attorney Tom Holmes, Secretary
Myrna Crapo.
Meeting called to order by chairman Sue Parrish at 7:30
pm.
Chairwoman Sue Parrish asked for approval of the Minutes
of the April 6th Meeting. Kent Kearns moved to approve
the minutes as written. Dwain Kinghorn seconded the
motion. All commission members voted in favor.
GENERAL BUSINESS:
1. RALPH J. HENDERSON, 1325 Paramount, request for a waiver
of platting requirement on property in the 5100 block
on Whitaker Road. Property is presently zoned R-2,
Limited Residential.
Steve Smart explained the reason why Mr. Henderson
was asking for a wavier of platting. He drew a map
on the board showing the location of the property and
the platting of the other property in the area.
The commission then discussed:
1. The future plans for that area
2. Access into the property being critical
3. The extension of Hiway Avenue
4. Consistency in what the commission does
5. Sewer and water services availability in the area
Pete Anderson made a motion that we recommend to the
city council to deny the request for the wavier of
platting based on the fact that we feel that the city
needs to have control over how that property is going
to be subdivided and know how its going to be subdivided.
The other reason is that we do not know the size of
the lot at this time whether he's buying a lot the
same size as Vern Briscoe or not. On those two reasons
I would move that we recommend to the city council
that they deny the wavier of platting.
Richard Pearson seconded the motion.

2. REVIEW OF PROPOSED CHANGES IN THE LAND USE ORDINANCE
TO PROVIDE FOR SCREENING of commercial products stored
outdoors; to provide for screening of outdoor storage
in industrial areas and to provide for a phase in period
when these amendments shall govern the existing situation.

FOR SCREENING (cont.)
Attorney Tom Holmes advised the commission that they
need to discuss and make recommendations to him from
this proposed ordinance. One problem area in the ordinance
might be "View something from residential requiring
a screening".
The commission then discussed the proposed ordinance
1. Areas in the city with problems
2. Reason for changing the present ordinance.
3. Using screening in a design review on an individual
basis
4. Expense in screening
5. Defining the display area
Pete Anderson moved that we review this ordinance
individually and think about the comments that were
said here tonight and be prepared to come with some
ideas that Tom can incorporate into a draft at our
next Land Use Commission meeting.
Kent Kearns seconded the motion with all commission
members voting in favor.
3. REVIEW OF TRANSFERABILITY OF CONDITIONAL USE PERMITS
The commission discussed the information that Attorney
Tom Holmes had prepared for them.
1. The conditional use for class II Production dwellings
2. Changing the ordinance and taking out the requirement
that it only stays with the applicant because it is
burdensom to keep track of
Attorney Tom Holmes told the commission he would present
a proposed ordinance at the next meeting.
Jerry Tydeman moved to adjourn at 9:10 pm.

FINDINGS OF FACT, CONCLUSIONS OF LAW AND RECOMMENDATION
RE: WAIVER OF PLATTING
This matter having come before the Council as required by
law, on May 4, 1989, upon the application of Ralph J. Henderson
(hereinafter referred to as "applicant") for a waiver of platting
for a proposed postal facility on the real property located in
the 5100 block of Whitaker Road and the Commission having heard
testimony from interested parties and being fully advised in the
matter, now makes the following:
FINDINGS OF FACT
1. Applicant has applied for a waiver of platting as
particularly described above.
2. All legal requirements have been met.
3. The property is designated as R-2 (Limited Residential)
in the duly adopted Comprehensive Plan of the City of Chubbuck.
4. Relevant criteria and standards for consideration of
this application are set forth in Chapter 17.12, Chubbuck Code.
5. The facts relevant to an evaluation of the relevant
criteria and standards are as follows:
A. Several pieces have been developed from a larger tract;
B. Applicant desires to build a home adjoining Whitaker
Road;
C. Noy lot size has been supplied by Applicant.
BASED UPON THE FOREGOING FINDINGS OF FACT, the Commission
hereby enters the following:
CONCLUSIONS OF LAW
1. The proposed waiver should not be granted because the
City needs to control how the larger piece will be subdivided and
needs to know how it will be subdivided.

DECISION
1. The Commission recommends the Waiver of Platting
requested by applicant not be granted.
