Present: Chairwoman Sue Parrish, commission Members: Pete Anderson, Kent Kearns, Bob Anderson, Richard Pearson, City Council representative Steve England, Attorney Kelly Kumm, Public Works Director Steve Smart, Project Engineer Gerd Dixon, Secretary Myrna Crapo. Meeting called to order by chairwomen Sue Parrish at 7:35 pm. Chairwoman Sue Parrish asked for approval of the minutes of July 6th meeting. Kent Kearns moved that the minutes of July 6 be approved as written and mailed. Pete Anderson seconded the motion. All commission members voted in favor. PUBLIC HEARING NOTICE: A PROPOSAL BY GARY RATLIFF, 4970 APACHE FOR A CONDITIONAL USE PERMIT TO BUILD A MINI STORAGE at 201W. Linden. Property is presently zoned R-2, Limited Residential. A PROPOSAL BY GARY RATLIFF, 4970 APACHE, POCATELLO, IDAHO FOR A CHANGE OF LAND USE DISTRICT from Limited Residential (R-2) to General Commercial (C-2) at 201W. Linden. Chairwoman Sue Parrish opened the public hearing. John Aller, 222 1/2 West Linden, spoke against the proposed zoning. Chairwoman Sue Parrish acknowledge the receipt of a letter fron Cantu's, Martinez's, Aller's, Lewis's, James's, Christensen's, Hays's. Mr. Aller discussed the items in the letter. 1. There are private residents within 150 feet of the property. The storage sheds will not be an asset to the neighborhood. 2. The property doesn't adjoin any other commercial property 3. It will lower property value and limit the ability to sell other propert5 4. Paving in the street is only 18' wide. It won't accomodate the extra traffic flow. 5. The property is lower than the street. It will create an unsafe situati( for emerging traffic. 6. There is no turn around provided at the end of the street. 7. It will cut down on the irrigation water flow by further piping. 8. If approved it needs to be fenced or screened. Mike James, 208 W. Linden stated that he doesn't want to see the change and the increase in traffic. PLANNING AND ZONING COMMISSION PAGE 2 GUST 3, 1989 Inda Mae Aller, 222 W. Linden wants the area to stay the way it is. Harry Lewis, 221W. Linden whose property borders on the west doesn't want to be in a commercial zone. Yera James, 208 W. Linden felt that there would be faster, intentive driving with the storage sheds. She liked the peace and quite. Margaret Christensen, 251W. Linden lives at the end of the road and there is not a turn around area. Gary Ratliff, 4970 Apache offered the following comments to the commission. The comprehensive plan showed the area as commercial. He will be renting too individuals and small businesses, etc. The maximum number of people at his Burley Drive site is two to three a day. This is not a heavy traffic business. There will be a turn around on his property. There will be no noise at the storage sheds because people won't be able to work on their equipment. Mr. Ratliff plans to only pipe the irrigation water as far as he has to. The storage facility is a nice looking facility. There would be no outside storage allowed. The buildings will be built over a period of time. He will maintain the area until all sheds are built. Slag would be used for the driveways and they would rely on natural drainage. The area sheds would be lighted. Councilman Steve England asked the residents if there was anything Mr. Ratliff could do that would make this acceptable to them. Mr. James said if it was paved, fenced, screened and he moved the access down away from across his driveway, plant trees and clean it up then he would be for it. The commission discussed: 1. The screening of the property 2. The need to take the zoning proposal before the conditional use request. Chairwoman Parrish closed the public hearing. The city was asked for their comments. Public Works Director Steve Smart informed the commission that the ditch is in the levy. The landscaping ordinance is applicable and buffering would be required. Pete Anderson asked the commission if this is the type of business that we want located in our down town area? Pete Anderson moved that we recommend to the city council that this property be zoned C2 as outlined in the comprehensive plan. PLANNING & ZONING MEETING PAGE 3 3, 1989 The motion died for lack of a second. After further discussion. Pete Anderson then moved to recommend to the city council that we rezone this piece of property to C-2 in agreement with the comprehensive plan. Steve England seconded the motion. Roll Call vote: Bob Anderson, yes; Steve England, yes; Pete Anderson, yes; Sue Parrish, no; Kent Kearns, yes; Richard Pearson, no. Kent Kearns moved that we table Mr. Ratliff's application for a conditional use permit until he returns with more information about the development of the property as pertains to the city ordinances and discussion of the requirements. Richard Pearson seconded. Roll call vote: Bob Anderson, yes; Steve England, yes; Pete Anderson, no; Sue Parrish, yes; Kent Kearns, yes~ Richard Pearson, yes. Motion carried. A PROPOSAL BY THE CITY OF CHUBBUCK TO AMEND THE CHUBBUCK LAND USE ordinance to provide that conditional use permit is issued to the application. The Public hearing was opened. was closed. There being no comments the public hearing Pete Anderson moved to recommend to the city council the passing of the assignability of the conditional use to the applicant along with the changes of wor'~ng from Upon the City Council to by the Land Use Development Commission upon the. Kent Kearns seconded the motion. All voted in favor. 4. A PROPOSAL BY THE CITY OF CHUBBUCK TO AMEND THE CHUBBUCK LAND USE ORDINANCE to provide for screening of commercial products stored outdoors; to provide for screening of outdoor storage in Industrial areas, to provide for the partial screening of the storage areas where products are being offered for sale to the public. The public hearing was opened to the public. Chairwoman Sue Parrish asked for any public comments, there being none the hearing was closed. The commission then discussed the ordinance and felt the following changes needed to be made. J. 1. Need to read "No such storage area shall be located in any front yard setback area unless allowed by conditional use permit.,, NO such storage area shall be located in any residentially zoned area unless allowed by conditional use permit. 2. Need to read The area must be screened on all sides except adjoining a residential area except for the side bordering a public street Because of the major changes on this ordinance a new ordinance needs to be written and a new hearing held. Pete Anderson though the commission should go on record that we need a fire station that looks like a fire station and something the city can be proud of and not a metal storage building.
