Minute of the regular meeting of the Land Use and Development
Commission held in the city municipal building October 3,
1991.
Present: Chairman Kent Kearns, Commission Members: Betty Poole,
Gayle Andersen, Richard Pearson, Pete Anderson, Attorney Tom
Holmes, Public works Director, Steve Smart, and secretary Myrna
C rapo .
Chairman Fent Kearns called the meeting to order at 8:25 p.m.
Chairman Kearns asked for approval of the September 5 meeting. Pete
Anderson moved to accept the minutes as mailed. Richard
Pearson seconded with all commission members •voting in favor.
Chairman Kearns asked for approval of the findings of fact. Pete
Anderson moved to approve the findings of facts and
conclusions of law for Wallace Smith Jr. and Leman Whited.
Richard Pearson seconded the motion. Roll Call vote: Pete
Anderson, yes; Betty Poole, abstain; Richard Pearson, yes;
Kent Kearns, yes; Gayle Andersen, yes.
GENERAL BUSINESS:
1. A discussion on a proposed ordinance to clarify the vision
triangle restrictions on a driveway by a street right-of-way.
The commission discussed this ordinance and reviewed a drawing
on the board. Steve Smart informed the commission that this
ordinance would be used when issuing new permits for new
fences, and that the city will: not be going around to issue
citations to everyone. Tf a neighbor complains then it will
be enforced.
The commission decided to present this ordinance for public
hearing at the November 7th meeting.
2. A discussion on a proposed ordinance adding definition of
screening fence and solid fence and clarifying screening
fences required around vehicle storage sites.
Steve Smart presented a picture of an auto wrecking yard on
S. Sth that showed a solid fence and demonstrated what a board
single layer slats in a chain link fence would do.

The Commission discussed:
1. Differences between screening and solid fence
2. Defining solid and screening fences.
3. Screening fences being solid fences
4. Other ordinances that need to be cleaned up which mention
screening or solid fences.
5. Having the attorney work on the ordinances that need to be
cleaned up.
The commission decided to have the attorney rewrite this
ordinance and present it for discussion at the next meeting.
3. A discussion on a proposed ordinance providing for new
commercial uses of property to comply with existing ordinances
regarding curb, gutter, sidewalk, streets and landscaping.
The commission reviewed the proposed ordinance and discussed:
1. Time limits being set for compliance
2. City starting now to work towards what we want the city to
become in the future
3. Curb and gutter in residential
Richard Pearson moved to adjourn at 9:10 pm with Betty Poole
seconding.
