Minute of the regular meeting of the Land Use and Development
Commission held in the city municipal building August 1, 1991.
Present: Chairman Kent Kearns, Commission Members- Myrna Cain,
Betty Poole, Luther Perkins, Gayle Anderson, Attorney Tom
Holmes, Public Works Director, Steve Smart and secretary
Myrna Crapo. '
Chairman Kent Kearns called the meeting to order at 8'00 p.m.
PUBLIC HEARING.
Chairman Kearns asked if any Land Use Member had a conflict
of interest with any proposals before them tonight There was
none. ·
A PROPOSAL BY THE CITY OF CHUBBUCK TO AMEND THE CHUBBUCK LAND
USE ORDINANCE SECTION 18.12,040(F) TO CLARIFY THE LINE OF
SIGHT RESTRICTIONS along a street right-of-way and to increase
the distance that needs to be clear of obstructions from ten
to fifteen feet.
Chairman Kearns opened the public hearing, there being no
testimony the public hearing was closed.
Steve Smart explained that the reason for this ordinance was
to clarify the existing ordinance. This ordinance reflected
the current practices of the building department.
The commission then discusses:
Changing to 10 feet instead of 15, as 15 feet would take a lot
of a persons property.
Defining a site triangle in place of the proposed ordinance
The city needs to discuss with Cary and Rex the 10 feet
instead of 15 to see if it would be acceptable.
The city needs to work on a description of a site triangle.
Safety being the main reason for consideration of this
ordinance.
Inviting Cary or Rex to attend the September meeting to answer
any questions.
Luther Perkins proposed that we table this ordinance until the
next meeting. Myrna Cain seconded it. All commission members
voted in favor.

GENERAL BUSZNESS-
Chairman Kent Kearns asked for approval of the July 11 1991
minutes. '
Myrna Cain moved to approve the minutes of the last meeting,
with Gayle Anderson seconding. All commission members voted
in favor.
Chairman Kearns brought to the attention of the commission
that larry Babb has not removed his 40' pole as he was
required by the commission. The date it was to be removed was
August 1.
Chairman Kearns talked to the commission about having training
time before our meetings.
Luther Perkins ~oved to adjourn at 8'40 pm with Myrna Cain
seconding.
