Minutes of the regular meeting of the Land Use and Development
Commission held in the city municipal building August 5, 1993.
Present: Kent Kearns, Chairman; Commission Members: Myrna Cain,
Pete Anderson, T. Kent Hill, LeRoy Quick, Gayle Anderson and
Secretary, Myrna Crapo.
Chairman Kent Kearns called the meeting to order at 8:00 p.m.
Chairman Kearns asked for approval of the July 1, 1993 minutes.
Myrna Cain moved to accept the minutes of July 1, 1993 with
Gayle Anderson seconding. All voted in favor.
PUBLIC HEARING:
Chairman Kearns asked if any of the commission members had a
conflict of interest. There was none.
A PROPOSAL BY THE CITY OF CHUBBUCK TO PROVIDE ERRONEOUS
APPROVAL OF A PLAT OR ISSUANCE OF A BUILDING OCCUPANCY PERMIT
DOES NOT WAIVE COMPLIANCE WITH THE LAND USE AND DEVELOPMENT
PORTIONS OF THE CHUBBUCK MUNICIPAL CODE.
Chairman Kearns explained the content of this ordinance.
Since there was not a representative from the city staff, he
then opened it up to public testimony. There was none and so
the public hearing was closed and opened to the commission for
discussion.
Pete Anderson moved that we recommend to the city council to
adopt the ordinance, T. Kent Hill seconded. Roll call vote:
Myrna Cain, yes; Pete Anderson, yes; T. Kent Hill, yes; Kent
Kearns, yes; LeRoy Quick, yes; Gayle Anderson, yes.
GENERAL BUSINESS:
APPROVAL OF FINDINGS OF FACT, CONCLUSIONS OF LAW AND DECISIONS
FOR FRANK AND CAROL HALL. Myrna Cain moved to approve the
Findings of Fact for Carol and Frank Hall, Pete Anderson,
seconded the motion. Roll Call vote: Myrna Cain, yes; Pete
Anderson, yes; T. Kent Hill, yes; Kent Kearns, yes; Leroy
Quick, yes; Gayle Anderson, yes.
Update on Comprehensive Plan· Pete Anderson informed the
commission the results of the July 22nd meeting. They had
gone over the mission statement. The subcommittee felt that
the items to include in the mission statement needs to be
discussed by the Land Use and City Council.

Chairman Kearns explained his participation in the Bannock
Land Use Meeting.
The commission then discussed land laying in the impact area
north of the city and how Bannock County had it zoned.
