HomeMy WebLinkAbout003 07 96 CITY OF CHUBBUCK LAND USE AND DEVELOPMENT MEETING March 7, 1996 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building March 7, 1996. Present: Chairman Kent Kearns; Commission members: Mary Harker, Dusty Whited, Gayle Anderson, Pete Anderson, Myrna Cain; Attorney Tom Holmes; City Staff Larry Kohntopp, Gerd Dixon Steven Smart; Secretary Teresa Strieber. The meeting was called to order by Chairman Kent Kearns at 8:05 p.m. Chairman Keams asked for approval of the February 1, 1996 minutes. Myma Cain moved to approve the minutes with Dusty Whited seconding. All voted in favor. PUBLIC HEARING: 1. An application by Arave Construction Company, Inc. 1395 N. W. Main, Blackfoot, Idaho for review of a preliminary plat for Diamond Court Subdivision. A Subdivision located between 5160 and 5328 Yellowstone. Tom Arave, 1395 N.W. Main, Blackfoot, Idaho discussed a preliminary plat for a subdivision located between 5160 and 5328 Yellowstone. The Commission reviewed copies of the preliminary plat for Diamond Court Subdivision. Tom Arave pointed out some corrections on the plat regarding some lot lines and that Block 1 and Block two are the lots proposed to put four-plexes on. Pete Anderson questioned the radius turn on Yellowstone Avenue and it was decided to review this for the final plat. There was discussion about a ditch that aligns with the property line and that Mr. Arave plans to backfill this ditch. Chairman Kearns opened the public testimony in opposition to the application. Seeing none, it was opened up to public testimony in support of this application; Seeing none, the public testimony portion was closed and brought back to the Commission. Pete Anderson made a motion to approve the application by Arave Construction Company for preliminary plat. Dusty Whited seconded. Gayle Anderson, yes; Dusty Whited, yes; Mary Harker, yes; Myrna Cain, yes; Kent Kearns, yes; Pete Anderson, yes. 2. An application by Arave Construction Company, 1395 N. W. Main, Blackfoot, Idaho for a change in land use district to Dense Residential (R-4) for property located between 5160 and 5328 Yellowstone. Property is presently zoned Industrial (I). Land Use and Development Commission Page -2- March 7, 1996 It became apparent at the meeting that the public notice and the application for land use district change did not include a request for general commercial zoning adjacent to Yellowstone. Further, the public notice did not disclose the request for annexation into the City as stated on the application. City Attorney Tom Holmes advised the Commission that this was a defect in the public hearing notice that could be rectified only by renoticing and rehearing at a later date. It was determined that Lot 14, which is owned by the City of Chubbuck is presently within the City boundary and zoned General Commercial (C-2). Pete Anderson moved that the Commission deny any zone changes at this time, because the City did not include the request for annexation. Pete also moved that any additional costs for re-advertizing be borne by the City of Chubbuck Dusty Whited seconded. Scalf, 5047 Elizabeth, Chubbuck, Idaho, for a review of a preliminary plat for Vista Park 1 st Addition. A Subdivision located immediately North of Vista Park and Rebecca Drive. Harold Scalf, 5047 Elizabeth, Chubbuck Idaho discussed an application for preliminary plat on Vista Park 1 st Addition for review. Gerd Dixon discussed a deviation from the master plan that was submitted by Mr. Scalf regarding Tree Valley Road that residents would like to see Tree Valley Road Continued. There was discussion of a park that would be put on the north of lots 4 and 5 and about the development of Garden Drive. The master plan showed that there would be a connection between Tree Valley Road and Garden drive, which would be an alternate access into this Subdivision. Chairman Kearns opened the meeting to any public testimony in opposition. Mike Bunce, 5110 Tree Valley Road, Chubbuck, Idaho read his opposition regarding not having Tree Valley Road appearing to not be continued to his property. Mrs. Claude Ferguson discussed her concerns of an easement and a right-of-way on her property that one of Mr. ScalPs lot overlaps. Chairman Kearns asked for any other public testimony in opposition, seeing none, it was opened to public testimony in support of the preliminary plat. Tim Shurtliffof ShurtliffEngineering took the podium and stated he would try to answer any questions asked by the opposition. Mr. Shurtliffdid address most questions that were asked. Land Use and Development Commission Page -3- March 7, 1996 Brett Carlsen, 4941 Hawthorne Road, Chubbuck, Idaho. His father owns the land which extends over to Buffalo Road. He discussed his concerns of possible development in the future that may require them to improve and extend a roadway, otherwise he has no problem with Mr. Scalfs development. Chairman Keams asked for any other public testimony in support, seeing none it was brought back to the Commission for discussion and a motion. Pete Anderson moved to deny the preliminary plat for Vista Park 1 st Addition. Gayle Anderson seconded. Gayle Anderson, yes; Dusty Whited, yes; Mary Harker, yes; Myrna Cain, yes; Kent Kearns, yes; Pete Anderson, yes. 4. An application by Harold L. Scalf, 5047 Elizabeth, Chubbuck, Idaho for a change of land use district to Single Family Residential (R-l) for property located immediately north of Vista Park. Property is presently zoned Agricultural (A). Pete Anderson moved that we recommend to the City Council the zoning change for Vista Park 1st Addition to R-1. Mary Harker seconded. Gayle Anderson, yes; Dusty Whited, yes; Mary Harker, yes; Myrna Cain, yes; Kent Kearns, yes; Pete Anderson, yes. Chairman Kearns called for a 10 minute break at 9:50 p.m. 5. An application by Scott Beech, 5142 Whitaker Road, Chubbuck, Idaho and Mack Losser, 839 Park, Pocatello, Idaho, for review of a preliminary plat for Beech Subdivision. A subdivision located north of Vista Park 1 st Addition. Scott Beech came to the podium to discuss the future development of Lot 1 of Tract 1. Mr. Beech stated he plans to build a house on Lot 2 of Tract 1. Chairman Kearns opened the meeting to any public testimony in opposition, seeing none it was opened to public testimony in support of the preliminary plat. Mike Bunce, 5110 Tree Valley Road, Chubbuck, Idaho gave his support of Scott Beech and Beech Subdivision. Rebecca Rowe, 1058 Lexington, Chubbuck, Idaho who is planning on purchasing Tract 2 and build a house. She gave her support of Scott Beech and Beech Subdivision. Chairman Kearns asked for any other public testimony in support, seeing none it was Land Use and Development Commission Page -4- March 7, 1996 brought back to the Commission for discussion and a motion. Dusty Whited moved that we approved the plat with exceptions of Tract 1 being one lot with a 25 foot right-of-way being granted on the fi-ontage of Lot 1 and 2, along with the eleven page agreement not requiting improvements of the street, sewer, water and pavement. Dusty Whited mentioned that he would like to see the Commission have work study sessions when there is an application for preliminary plat. This would give them more time to review all the paperwork. Mary Harker suggested other items of General Business be tabled until the next Land Use and Development Commission meeting, due to the length of this meeting tonight.
