HomeMy WebLinkAbout009 04 97LAND USE AND DEVELOPMENT COMMISSION September 4, 1997 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building August 23, 1997. Present: Chairman Kent Kearns, Commission Members: Myrna Cain, Ray Rosen, Dusty Whited, Mary Harker, Gayle Anderson; City Staff: Larry Kohntopp and Steve Smart; Secretary Teresa Strieber. Chairman Kearns called the meeting to order at 8:04 p.m. Myrna Cain moved to accept the minutes of August 23, 1997 as mailed, with Dusty Whited seconding. All voted in favor. GENERAL BUSINESS: 1. Steve Camolattaro, 435 E. Chubbuck Road, Chubbuck, Idaho for a Conditional Use Permit for a home occupation permit. Chairman Kent Kearns stated that he was not at the August 23, 1997 meeting. The Land Use and Development Commission directed Mr. Camolattaro to gravel his driveway and make an effort to control the dust. Mr. Camolattaro stated that he put gravel in the driveway and that the grass has come back on the opposite side. The Commission Discussed: Chairman Kent Keams stated that he drove by Mr. Camolattaro's property tonight and made a note to talk about the dust abatement. Chairman Kent Kearns asked Mr. Camolattaro about the fence he was directed to erect. Mr. Camolattaro stated that he was not able to finish the fence this year because of financial reasons. Because of this he is not sure when he will be able to finish it. Chairman Kent Kearns told Mr. Camolattaro that he felt he has not complied. Mary Harker stated that she was concerned about the ditch in front of the property because it is overcome with weeds and she is concerned about children around the ditch. Mary asked Mr. Camolattaro to cut the weeds down. Mr. Camolattaro stated he has cut the weeds down. Chairman Kearns mentioned the accumulation of items in the southwest corner of his property. These items are a crane, trailer, vehicle parts, horse chariot, etc. These items are beyond the definition of allowing a home occupation and the view of these items are commercial use of that property. Chairman Kent Kearns suggested he get a re-zoning for commercial property and if he had talked with his neighbor Mr. Robinson about a re-zoning Mary Harker suggested for him to sell some of the items on the property that he is not using. Land Use and Development Commission Minutes Page -2- Ray Rosen states that he has seen a lot of cleanup on the property in comparison to what it was and asked for more time for Mr. Camolattaro to cleanup and finish the fence. Ray Rosen also stated that he felt the Commission did not detail other items which are being addressed for Mr. Camolattaro to do and complete. Pete Anderson states that basically what the Commission is doing, is revisiting the original application of conditional use. To put additional conditions on that use, Pete stated that he felt the Commission was being a little unfair of the applicant. They are not conditions that were not put on the applicant. The intent is that the property needs to be re-zoned along with Mr. Robinson's property. A compromise should be made at this point. The City of Chubbuck should re-zone Mr. Robinson ' s and Mr. Camolattaro's property along with the other property on the other side of the road. The other property consisting of the mini storage, which is industrial, etc. Dusty Whited stated that when the Chubbuck road widening starts and is completed, there will be no use for that property as residential. Pete Anderson agreed that this area will not be a desirable residential use. The Comprehensive Plan states that this property will become commercial property due to the widening of Chubbuck Road. Tom Holmes stated that if Mr. Camolattaro is experiencing a potential hardship, in past the city has set another deadline. We should possibly look at June 1, 1998. Mary Harker motioned that the Commission create another date to review provisions for the permit for the property at 435 Chubbuck Road for Mr. and Mrs. Camolattaro. Mary asked Mr. Camolattaro to make an effort to complete the fence by June 1, 1998 and if he is not using the ditch from the corner of their home to fill the ditch. Mary corrects "ditch" to "trench". Dusty Whited seconded. Roll Call Vote: Mary Harker, yes; Kent Kearns, yes; Pete Anderson, yes; Dusty Whited, yes; Ray Rosen, yes; Myrna Cain, yes. 2. Kathleen Lacey, Bannock Planning Organization. Kathleen Lacey states Bannock Planning Organization has just begun a new long range transportation plan. The project is to be accomplished within the next six years. They are gearing up from public involvement and comment. There will be six meetings in the City of Chubbuck and five meetings in the City of Pocatello, which will be held in our schools. The focus will to look at the metropolitan area. There will be a follow up with analysis of those meetings. After input from three supporting committees they will start with the plan. They will also consider recommendations from focus groups. Kathleen Lacey ask for support from the Land Use and Development Commission in this project. Mary Harker motions for the Commission to support this project. Pete Anderson seconded. Mary Harker suggested contacting Channel 11, Access Channel to arrange for media coverage. Chairman Kent Kearns ask the members of the Commission to check their calendars to make sure all meetings will be attended for rest of year.
