HomeMy WebLinkAbout001 09 97 CITY OF CHUBBUCK LAND USE AND DEVELOPMENT COMMISSION JANUARY 9, 1997 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building January 9, 1997. Present: Acting Chairman Mary Harker, Commission Members: Wally Wright, Myrna Cain, Dusty Whited; Council Representative Steve England; Attorney Tom Holmes; City Staff Steve Smart, and Larry Kohntopp; secretary Myrna Crapo. The meeting was called to order by Acting Chairman Mary Harker at 8:00 PM. Chairman Mary Harker asked for approval of the minutes of the December 5, 1996 meeting. Myrna Cain moved to approve the minutes, Dusty Whited seconded. All voted in favor. PUBLIC HEARING: 1. A proposal by the City of Chubbuck amending section 18.08 and 18.20 eliminating a conditional use as a request for a Planned Unit Development, and reviewing the Planned Unit Development approval process. Chairman Harker asked for a review by the city staff. Attorney Holmes explained what they were trying to do with the changes for the new PUD ordinance. They have eliminated having to go back to the commission for the final PUD plan. Steve Smart reviewed the recommendation of Pete Anderson. The commission then discussed his suggestions. Chairman Harker opened the public hearing and asked for public testimony in favor of the proposed. There was none. Chairman Harker then asked for public testimony in opposition. There was none. The public hearing was closed and the meeting was opened to the commission for discussion. Myrna Cain moved to recommend to the City Council to accept the ordinance change as submitted. Dennis & Kathy Murray tabled request for dwelling at the end of Rose. Kathy Murray, 11481 N. Rio Vista Road informed the commission that they wanted the commission to deny the conditional use permit. They will not pay for the road. She informed the commission they had previously told us that all they wanted to do was to put a manufactured home next to her parents and they did not want to develop it. Mary Harker asked for any testimony in favor or against this application. There was none, so it was brought back to the commission. Wally Wright moved to table this request of Dennis & Kathy Murray and to advise them by letter concerning the requirement and invite them to bring it back again to the meeting next month. After a discussion by the commission Wally Wright withdrew his motion. Dusty Whited moved to deny the condition use permit for Dennis and Kathy Murray. Myma Cain seconded. Roll call vote: Wally Wright, yes; Myrna Cain, yes; Mary Harker, yes; Dusty Whited, yes. 2. Steve Campolattaro, 435 E. Chubbuck Road Major Home Occupation two year review. Trisha Campolattaro, 435 E. Chubbuck Road reviewed the original requirements that were imposed by the Land Use. She explained the things that they were doing. They had moved the fence back and asked for a building permit to build a new home. The family run the business, and no customer come to the house. They are not running the business out of their house. Larry Kohntopp presented some photo to the commission showing the property. Captain Jim Phelps, Chubbuck PD, 210 Circle Inn Drive. Officer Phelps has been in contact with Steve Campolattaro concerning the problems with the property. The last time they met they talked about putting up a screening fence. They stated that they would put up a fence. They put up a short fence--not as long as they agreed to. The abandoned vehicle is very unsightly. Trash, Junk cars, etc. are there. Some vehicles have been observed with people parking them for the day and picking them up later. The Chubbuck Police are getting neighbors complaining. Mrs Branson has called in several times. Marie Branson, 4779 Branson Drive, it is a mess and it's not only unsightly but they drive back and forth within a few feet of her house creating dust in the summer. She keeps her yard looking nice and it is discouraging to have to look at the mess all the time. Trisha Campolattaro, 435 E. Chubbuck Road. Explained about the various vehicles. She looked at the vehicles in the pictures and explained who the cars belonged to Jim Phelps, 210 Circle Inn Drive, suggested we meet as a commission and walk over the property. Mrs. Branson requested that we look into the area from her property line. Land Use Commission & Development January 9, 1996 Page 3 Larry Kohntopp, 156 Hiway Avenue, Mr. Campolattaro has felt that the property will someday be zoned commercial. They are zoned residential now and need to comply. Major Home Occupation permit when permitted states the venture is not to detract from the development of the neighborhood. The way it is now it doesn't look like a residential development. The meeting was turned back to the commission for discussion. The commission discussed: 1. The comprehensive plan 2. Residential area 3. Need to be within the guidelines of a home occupation. Wally Wright moved to table this until next month; Dusty Whited seconded. A meeting on Thursday 23rd at 4 PM here at the city offices was decided upon for the Land Use Commission to meet and view the property. We will need to advertised the meeting. 3urned at 9:10 PM.
