December 3, 1998
Meeting of the regular meeting of the Land Use and Development Commission held in the City
Municipal Building December 3, 1998.
Present: Chairman Kent Keams, Commission Members: Ray Rosen, Nolan Briscoe, Wally
Wright, Myrna Cain, Pete Anderson; Attorney Tom Holmes; City Staff Steve Smart; and
Secretary Myrna Crapo.
Chairman Keams called the meeting to order at 8:00 PM.
Chairman Keams asked for approval of the November 5, 1998 minutes. Chairman Kearns
requested the following corrections be made: Pete Anderson name needs to be added as being
present and page 2 needs to show that Chairman Keams reconvened the public testimony at the
request of Dean Funk. Wally Wright moved to approve the corrected minutes with Myrna Crain
seconding. All voted in favor.
Nolan Briscoe was introduced to the commission as the new member and was welcomed to the
commission.
Election of a new chairman. Wally Wright nominated Pete Anderson for chairman, Mary Harker
seconded. All of the Land Use Members voted in favor.
PUBLIC HEARING:
Chairman Anderson asked if anyone on the commission had a conflict of interest. There was
none.
1. An ordinance of the City of Chubbuck to allow trained message therapists as a Home
Occupation; to clarify massage by an untrained person is not allowed.
Chairman Anderson asked for any comments from the commission. He then explained
the ordinance.
Chairman Anderson opened the meeting for public testimony, there was none. He then
closed the public hearing and brought it back to the commission for discussion and a motion.
Myma Cain moved to make a recommendation to the city council to pass this city ordinance as it
is written. Mary Harker seconded. All voted in favor.
GENERAL BUSINESS:
1. Approval of the Finding of Fact, Conclusions of Law and Decision
A. Merlin Philips for a conditional use permit to build a four-plex
at 4801 Whitaker Road.
B. Merlin Philips for a conditional use permit to construct a duplex
at 4801 Whitaker Road.
C. Heritage change in Land Use district from A Agricultural to R-1
Single Family Residential.
D. Pam McBride for a conditional use permit to have a one person
Cosmetology salon at 838 Washburn.
Chairman Anderson combined all four of the above Finding of Fact, Conclusions of Law
and Decision. The commission discussed them.
Wally Wright moved to approve the Finding of Fact, Conclusions of Law and Decision,
Myrna Cain seconded. All voted in favor.
Mary Harker moved to adjourn at 8:15 PM. Wal .
