HomeMy WebLinkAbout008 05 99LAND USE AND DEVELOPMENT COMMISSION August 5, 1999 Meeting of the regular meeting of the Land Use and Development Commission held in the City Municipal Building August 5, 1999. Present: Chairman Pete Anderson, Commission Members: Ray Rosen, Dusty Whited, Myma Cain, Nolan Briscoe, Gayle Andersen, Mary Harker; Attorney Tom Holmes; City Staff: Larry Kohntopp and Secretary Myma Crapo. Chairman Anderson called the meeting to order at 8:00 PM. Chairman Anderson asked for approval of the July 1, 1999 minutes. Gayle Anderson moved to approve the minutes as mailed, Dusty Whited seconded. All voted in favor. Chairman Anderson asked if anyone have a conflict of interest. Ray Rosen said that he had. PUBLIC HEARING: 1.An application by Joshua D. and Camille Ellis, 706 Washburn, Chubbuck, Idaho for a change of Land Use District, for 706 Washburn, to Limited Residential (R-2), Property is presently zoned Single Family Residential (R-1). Joshua D. Ellis, 706 Washburn, explained the size of the lot and its location. He wants to build another home comparable with the home now there. Chairman Anderson opened the meeting for public comment for or against the proposal. Rich King, 4553 Mountain Park Road, feels that it will be good for the area. The proposed home would be directly across from their home. It would help the appearance of the neighborhood. Donna King, 4553 Mountain Park Road, asked ifa duplex could be put in there. Chairman Anderson explained the procedure for getting permission to build a duplex. Joseph Grover, 707 Brundage, is concerned with the drainage in the area. He is also concerned that it will block the view from the back of his house. Learne Bittle, 4557 Mountain Park Road, lives across the street and a little further north. If they landscaped and put grass in there, it would take care of the weeds. If build it would look like it is on a smaller lot then those in the neighborhood. She is concerned that the home may be hard to sell and would become a rental home. The easement by the present home is a natural drainage and she is concerned about it being filled with dirt and cement from the new home. She is concerned about a water problem affecting her property. Land Use and Development August 5, 1999 Page 2 Doug Remer, 718 Washburn is the next house up from Mr. Ellis. He expected the area to stay an R-1 subdivision and doesn't see any reason to change it to R-2. Paula Callehan, 4525 Mountain Park Road, they bought their home this year because of it being an R-1 area and wouldn't want to live there if it was zoned R-2. They get mud and etc. in their driveway from the property across the street. Lloyd Mathew, 4579 Mountain Park, mentioned the petition that was passed around, since he wasn't here at the time it was circulated, he wanted to go on record as being opposed to the zoning change. Susan Grover, 707 Brundage, is concerned about the light pole that is on the property right now. She wants to know what is going to happen to it when they build the home. There are power boxes right there at the pole. She is also concerned with building on such a small square footage in comparison with others in the area. They enjoyed their view of the mountains; and they are concerning about it reducing the value of their home. Robert Biddle, 4567 Mountain Park Road, is concerned about the drainage ditch having dirt and concrete left there. The sloop behind the proposed home will be steep. Bonnie Maclure, 4539 Mountain Road, the home next to this property has a wood fence and a cement retaining wall. She questioned if the home will have the room for putting stepping terrace in. JoAnne Remer 718 Washburn, they bought their lot because it was a large lot. She will have a difficult time selling her home if a home is built there. Chairman Andersen closed the public hearing and allowed the applicant to address any comments or concerns brought up during the public hearing. Joshua Ellis 706 Washburn, addressed the drainage problem and if the lot was secure. The present home is worth $145,000 dollars. The second lot will be a big if not bigger then the R-2 lots in the area. Other homes in the area have steep lots and it has not made a difference. Chairman Anderson brought the discussion back to the commission. Veldon Robinson, 719 Brundage, according to the restrictive covenants it has to set back 30'. Land Use and Development August 5, 1999 Page 3 The commission discussed: 1. The surrounding area zoning 2. The size of the surrounding lots 3. The gully running through the area 4. The designated geographic area Darris Ellis, 13560 Hawthorne, was asked by Chairman Anderson to refresh the memory of the commission on what had previously taken place with his subdivision. Lot 5 was left unplatted and it is still zoned R-2. The commission then discussed: 1. The lots on the east side of Mountain park back to Brundage being approximately 70 to 80' wide and 110' deep. The lots north down mountain park road are the same size. 2. The size of the lots across the street. 3. Concerns about the people who bought in R-1 and then having it changed. 4. The drainage easement taking care of itself and being left as it is. Bonnie MacClure, 4539 Mountain park Road, the layout of the land behind the proposed home wouldn't leave much room for a back yard. Chairman Andersen asked that the records reflect that we receive a petition signed by 39 individual in opposition to the requested zone change. Gayle Andersen, moved to recommend to the city council that we approve the application by Joshua D. and Camille Ellis, 706 Washburn, Chubbuck, Idaho for a change of Land Use District, for 706 Washburn, to Limited Residential (R-2). Motion died for lack of a second. Dusty Whited moved to recommend to the city council denial of the application of Joshua D and Camille Ellis, 706 Washburn, Chubbuck, Idaho for a change of Land Use District, for 706 Washburn, to Limited Residential (R-2); Nolan Briscoe seconded. Roll Call vote: Myma Cain, yes; Gayle Andersen, no; Mary Harker, yes; Dusty Whited, yes; Nolan Briscoe, yes; and Pete Andersen, yes.
