Meeting of the regular meeting of the Land Use and Development Commission held in the City
Municipal Building April 1, 1999.
Present: Chairman Pete Anderson, Commission Members: Ray Rosen, Dusty Whited, Mary
Harker, Gayle Anderson, Myrna Cain, Nolan Briscoe, Wally Wright; Council Representative
Kent Keams; Attorney Tom Holmes; City Staff.' Steve Smart, Larry Kohntopp and Sean Harris;
and Secretary Myrna Crapo.
Chairman Anderson called the meeting to order at 8:00 PM.
Chairman Anderson asked for approval of the March 4, 1999 minutes. Wally Wright moved to
approve the minutes as mailed, Gayle Anderson seconded. All voted in favor.
Chairman Anderson asked if anyone had a conflict of interest. Kent Keams stated that Brad
Frasure was his cousin.
1. An application by Jim Thilmont and Brad Frasure, P.O. Box 5598, for a Conditional
Use Permit to build a RV Campground at 4520 Kings Way. Property is presently
Zoned General Commercial (C-2).
Chairman Anderson opened the public hearing for public input.
Larry Kohntopp told the commission that the Land Use Ordinance doesn't show the
length of time a trailer can stay in the park; paving is required for office parking and there
is an ordinance on dust control.
Brad Frasure, 11086 Rio Vista, explained they wanted to build a 40 unit RV park. The
interior roads have not been worked out. The pad for the trailers will be paved. There
will be a 10' green belt all around the park.
They don't have set limitations on how long a person can stay. It will be a nice RV park.
The cost will be $20.00 a night. They will have full hook-ups. There will be a full time
manager's office which will probably be a mobile home.
The commission asked:
1. If there were a playground planned and were informed that there wasn't.
2. The exit where they will go out which is Kingsway will be paved.
The public hearing was opened for public comments in favor. There were none.
The public hearing was them opened to public comments in opposition.
Margaret Waldram, 147 Evans Lane. They had previously presented a petition signed by
area residents and businesses. This property will be in her back yard. They are
concerned about their property values and the difficulty selling their homes. The
increased traffic will be bad. There possible needs to be a traffic light on Evans Lane.
They are concerned about the safety of their children. The aesthetics of the area will not
be enhanced with a RV park being downtown. They want a 10' foot fence around the
area. They are concerned with business hours being all day and night. They want to
have access to ditch water.

Lisa Hitchcock, 157 Evans Lane, is concerned about the garbage and the sewer they will
be dumping.
Julie Hitchcock, 201 Evans Lane, The water run off from their irrigation ditch runs into
this field, they are concerned about what will happen to the water. It is hard to see traffic
when getting onto Yellowstone, and this will make it worse.
Bill McKee, 140 Evans Lane, the parking is limited to businesses. It is very congested.
He wonders if this is the kind of business we want to come into the area. He didn't
receive a notification of the meeting, but found out about it from his neighbors.
Mae Hitchcock, 152 Evans Lane, She is concerned with the traffic congestion. Animals
being brought into the area from those going through and creating a noise problem and
possibly leaving them behind.
There were several people who didn't receive a notice: Browns, Kingsway business
complex, Hal Overdorf.
Chairman Anderson closed the public hearing and turned it back to the commission. We
need to readvertise it and notify those individuals who weren't notified.. Mary Harker
moved to table this issue until the next meeting of May 6th when sufficient time will be
allowed to notify the interested parties for further testimony and further consideration by
this board. Ray Rosen seconded. All voted in favor.
2. An application by Roger McAtee, 410 Yellowstone, Suite 204, Pocatello, Idaho
83201, for a Preliminary Plat for Crest field Subdivision. A subdivision located 910 West
Chubbuck Road.
Chairman Anderson asked for any additions to the staff report. Larry Kohntopp
emphasized the important items of the report.
Rodney Burch, 155 S. 2nd. Stanley and Ryan will be turned into a cul-de-sac. The two
homes will stay where they are. The potato cellar will be taken down. They want to
maintain access off of West Chubbuck Road. Lot 1 will be a town home lot. They will
dedicate 8' of right of way on West Chubbuck Road. They will have to extend the sewer
out to an existing street along with the water line. They want three accesses onto
Chubbuck Road.
The commission discussed:
1. Ways to do the drive-ways.
2. Access Control Management
3. Limiting the access onto West Chubbuck Road and having a drive through road instead
of the cul-d-sacs.
Chairman Anderson opened the meeting for public comment.
Rod Young, 923 Stanley, was concerned about widening the road. It will limit access to
his own property. He would like to see the existing lane go through. He is worried about
the danger to children and wonders what fencing will be put up.

Roger Mcatee, is developing between two existing subdivision; there is only so much
road that you can put in. To be able to develop it and sell lots he can't put a road down
the center of the property. The hammerhead will make it so they can drive out instead of
back out. It is the way the subdivision will work to make money for him. He will live on
lot 5.
Silvia Young, 923 Stanley, is worried about the traffic.
Connie McKay, 922 Stanley, wants to know about the existing fence. She would like the
first cul-d-sac redrawn.
The commission discusses:
1. This being an allowed use for the area
2. The access off of Chubbuck Road.
3. The Access Management plan
Chairman Anderson closed the public hearing and turned it back to Rodney Burch for
additional comments. They haVen't decided what the fencing requirements will be. The
comprehensive plan shows the need for less expensive homes.
The commission discusses:
1. The variance in the size of the lots being consistent with the neighborhood.
2. Keeping the integrity of the neighborhood.
3. The structure of the plat
4. Dead end water lines. - will add fire hydrants to be able to flush them.
5. Continued curb and gutter.
6. Chubbuck Road access
7. Geographic area being designated
8. Preservation of the neighborhood
9. Reconfiguration of Lot 8
Mary Harker moved to recommend to the city council approval of the Crestfield
Subdivision with the following conditions: 1. Lots 1, 2 and 3 be provided with hammer
heads; 2. The size of lot 8 be adjusted and 3.the cul-d-sacs be increased to city standard
of 55'. Myma Cain seconded. Roll call vote Ray Rosen, no; Dusty Whited, no; Myrna
Cain, yes; Pete Anderson, yes; Mary Harker, yes; Nolan Briscoe, yes; Wally Wright, yes;
Gayle Anderson, yes.
GENERAL BUSINESS:
1. A proposed ordinance redefining a production building to exclude pre June
15, 1976 mobile homes unless they have been issued a certificate of compliance in
accordance with the law passed in 1998 which allows a HUD certification to be
issued for older mobile homes.
The commission discussed.
1. The meeting two weeks ago
2. We cannot deny them being moved into the city. We can deny those prior to 1976.

Wally Wright moved to have this item advertised for public hearing on the May 6th
meeting, Dusty Whited seconded. All voted in favor.
2. A discussion on the Seminar for Local Community Planning and Local
Planning Act.
The commission discussed:
1. Reviewing the changes to the local Planning Act.
2. We cannot do a duel publication for an item. There must be 30 days between
meetings.
3. The only legitimate conflict of interest is if you have financial gain
4. Agriculture is an accepted land use
5. You can't declare tailors as a nuisance
6. Manufactured housing is acceptable in all zones.

As per our earlier conversation I mentioned that I have acquired 2 lots in the
Misty Manor Subdivision. I would like to build duplexes on these lots. They would be
built to high standards to conform with the surrounding homes in the subdivision.
To accomplish this I wish to get on the land use committee agenda at the earliest

NOTES:
Since there are approximately 47 lots in this subdivision,
conceivably 4, if not 5 duplexes could be allowed.
