Minutes of the regular meeting of the Land Use and Development Commission held in the City
Municipal Building November 1, 2001.
Present: Chairman Pete Anderson; Commission Members: Mary Harker, Myrna Cain, Nolan
Briscoe, Gayle Anderson, Dusty Whited; Attorney Tom Holmes; City Staff. Steve Smart, Sean
Harris, and Larry Kohntopp; Secretary Myrna Crapo.
Chairman Pete Anderson called the meeting to order at 8:00 P.M.
Chairman Anderson asked for approval of the October 4, 2001 minutes. Myrna Cain moved to
accept the minutes. Gayle Anderson seconded the motion. All voted in favor.
Chairman Anderson asked if any commission member had a conflict of interest. There was none.
PUBLIC HEARING:
1. An application by Margaret McNabb, David Graham and Darris Ellis Enterprises,
13560 N. Hawthorne Rd., Pocatello, Idaho for a Planned Unit development, (PUD) for
residential use with subordinate commercial uses, together with its Preliminary
Development Plan. The L.U.D.C. will also consider the preliminary plat for the first
development phase of approximately 11 acres, together with its requested annexation.
Property is located west of Ponderosa, east of Philbin, south of West Chubbuck Road.
Chairman Anderson reviewed the process that the P.U.D. will go through and what will
take place. Chairman Anderson asked for any additional comments from the staff, there was
none.
Mitchell Greer, Rocky Mountain Engineering 155 S. 2nd Avenue, Pocatello. Mr. Greer
explained what was going to be done. It will have a lot of open spaces and winding streets. Each
of the lots should have access to an ample amount of open space. They have a major street that
will line up with Galena. They would like to use water that is on the property. The commercial
development would be centered around Chubbuck and Philbin roads. The first phase will focus
on residential areas.
The development will be a phase development. The northeast corner will be the first
phase. The first phase would actually be three phases. Phase one would finish part of Galena.
The park will be developed in each phase.
Pete Anderson discussed the traffic count analysis. Steve Smart explained to the commission
that by the year 2020 we will need a five lane section on the east end. The developed project
n would increase the traffic by 700 or 800 on the one end. A two land road could handle 5,000 per
lane per day.

Chairman Anderson opened the meeting for public comments.
Dams Ellis, 13560 N. Hawthorne Road, it is an unique concept. They are trying to make it
community friendly with a jogging path. They want to use the parks for runoff from the roads.
They plan on a 20 year project.
Gerald McNabb, 12973 N. Philbin Road, they are the property owners. People are now using
Chubbuck road for jogging. They want a safe place for people to live and enjoy. They won't
have any bare ground --it would be developed or growing a crop. It will sit a new standard for the
area.
Donna Jones, 4729 Ponderosa, the back of their property abuts the development. She is
concerned that it will just be temporary housing. The Country Acres lots are quite large and they
have a lot of landscaping. The ground water, traffic numbers need to be addressed.
Their development has been around for about 30 years. The large lots have been maintained and
improved. She would like to keep the integrity of their area. We need the same lot sizes and
sets backs.
Justin Kline, 4579 Ponderosa, he agrees with the previous speaker. How big are the parks going
to be and what will be in them. He would like to see playground equipment that would hold 45
to 50 children at one time. Each phase needs that. How wide are the jogging paths going to be.
What trees are going to be put into the park. He would like to see fast growing trees.
Millie McNabb, 12953 N. Philbin Road, she is one of the property owners. They want a place
where the kids can go and be safe. They want it to be a place for families to come and have a
safe fun environment.
Chairman Anderson closed the public hearing.
Darris Ellis, 13560 N. Hawthorne, part of the answers haven't been answered yet because they
are not through the process. They are beginning on the threshold of this development. They want
to make it a positive development for everyone.
The commission discussed:
1. The plan is developed according to the R-1 requirement for size.
2. 435 single family lots, 19 acres of park ground, 18,000 feet of road, 16 acres of
commercial development.
Mary Harker moved to approve the concept of the preliminary development plan and the
preliminary plat. This concept to be continued to the next meeting so the next step of our P.U.D.
process can be addressed. That the plan be consistent with the requirements of the City's P.U.D.
requirement and that the request for the annexation for the proposed be accepted. Nolan Briscoe
seconded. All voted in favor.

2. An application by Sharon Knudsen/David Carlsen Development, 2595 Hwy. 39,
American Falls, Idaho 83211 for a change of Land Use District to General
Commercial, (C-2), contingent upon a change in the Comprehensive Plan for said
property north of the Redman Canal, south of Misti Manor Subdivision, east of
Hawthorne Road. Property is presently zoned, Agricultural, (A).
Dave Carlsen, P.O. Box 28335, Spokane, Washington, they want the property to be
designated for commercial use. The development of this property is severely affected by the
canal. They intend to provide a buffer on the north end of the property. The canals would need
to be relocated. Water flow would not be affected at all.
Pete Anderson asked:
1. The size of buffering of this area. They don't have a specific number yet.
2. Misti Manor roads would cul-de-sac in their development. It would be part of the
buffer.
3. The rerouting of the canal. They would like the Redman as far north as they can get it.
They would pipe the canal.
4. Neighborhood commercial might be possible.
Chairman Anderson opened the meeting for public comment.
Marty Nolte,413 Idealya lane, They are concerns about the traffic, nosie, lights, view, etc.
They want to bring business in. If they have an adequately sized buffer zone it should take care
of most of the problems. They would like more than the 40 feet for the buffer zone. They would
like to have the city take over the buffer zone.
Victor Baron, 409 Idealya, we have plenty of commercial property. The traffic problem on
Hawthorne Road is getting worse. He didn't receive a notice in the mail. He would have liked to
have had more notice.
Leonard Kovacheff, 404 Idealya, is concerned about the effect on their property value; and the
traffic.
Scott Crane, 4719 Kimmi Court, supports the buffer zone, he would like to see a larger buffer
zone. He is concerned with the noise barrier along Hawthorne Road.
Edith Arcand, 421 Idealya, has lived there since 1997. The neighborhood is a great place to live.
She doesn't want to have it changed.
David Folty, 4691 Misti, The cul-de-sac would have a 110' across. He felt that it was a good
start for a buffer zone. They would like the buffer zone in before they do any commercial
building.
Faith Nohe, 413 Ideayla, She has two little girls and fells that the area is safe. She doesn't want
to have the businesses that close to her back yard. We need to guarantee their safety.

Roy McIntosh, 4619 Hawthorne Road, he doesn't believe we need any more commercial area.
He doesn't want to see commercial area across the road from him. The traffic has increased on
Hawthorne Road. He is concerned about property values.
Launal Lee Leo, 4754 Heidi, doesn't want to see it in her area.
Michael Stevens, 4739 Kimmi court, he is worried about all the traffic because of the
commercial. He is concerned about additional light and the noise. He is concerned about safety
along the road. A sound and safety barrier would be helpful. He prefers small businesses instead
of large businesses. The increase traffic is a concern.
Wendy Baron,409 Idealya, Do we really need more economic development. It is in her back
yard.
Michelle Meyer, 420 Idealya, She has five children, and likes the area. Their kids can walk to the
school. She wants to be able to see the mountains, and blue sky. The subdivision is slower pace.
She will be concerned with her children playing outside with commercial buildings so close.
Ron Johnson, Gate City Real Estate, realtor for Knudsen. They would like to work something
out for the community. It would eliminate a lot of traffic by being close to a neighborhood.
Wesley Morris, 4704 Heidi Court, He agrees with the comments. Linden comes into his back
yard. He doesn't want trucks driving through his back yard.
Michelle, Myer, 420 Idealya we need higher paying jobs and these will not pay that much.
Matias Gonzalez, 4724 Heidi, He is proud to be a homeowner there. He is concerned that they
will be low paying jobs.
David Carlsen, businesses are not a bad neighbor. The business's want to be good neighbors.
The meeting was brought back to the commission:
Dusty Whited moved to table the application by Sharon Knudsen/David Carlsen, Development,
2595 Highway 30, American Falls until the proper notification can be sent to all residents within
300 feet of this property. Testimony given by the people attending tonight will not be accepted
only testimony from people who were not properly notified will be heard. Myrna Cain
seconded. Roll call vote: Myrna Cain, yes; Dusty Whited, yes; Mary Harker, yes; Nolan Briscoe,
yes; Gayle Anderson, yes; Pete Anderson, yes.
GENERAL BUSINESS:
1. Comprehensive Plan
Mary Harker moved that we bring the issue of the Comprehensive Plan to a public meeting.
Gayle Anderson seconded. All voted in favor.

Chairman Anderson requested that we have the journal put an article in the paper informing
residents that copies of the Plan are available at the City Office and inviting public comment.
