Minutes of the regular meeting of the Land Use and Development Commission held in the City
Municipal Building June 7, 2001.
Present: Chairman Pete Anderson; Commission Members: Don Moore, Ray Rosen, Myrna Cain,
Wally Wright, Nolan Briscoe, Dusty Whited and Gayle Anderson; Attorney Tom Holmes; City
Staff: Larry Kohntopp and Secretary Myrna Crapo.
Chairman Pete Anderson called the meeting to order at 8:00 P.M.
Chairman Anderson asked for approval of the May 3, 2001 Myrna Cain moved to accept the
minutes; Ray Rosen seconded. All voted in favor.
Chairman Anderson asked if any commission member had a conflict of interest with any of the
agenda items. There was none.
PUBLIC HEARING:
An application by Jackson's Food Store, Inc., P.O. Box 610, Meridian, Idaho 83680- 0610 for
a conditional use permit at 4444 Yellowstone Ave., Chubbuck, Idaho to allow a 65' wide
access on East Burnside Ave. The site is being developed for truck/trailer access. The
property is presently zoned Commercial, (C-2)
Attorney Tom Holmes explained they needed to consider whether this place is appropriate
for this type of business.
John Jackson, Jackson Food Stores, 625 W. Fordham, Eagle Idaho, they want to add to
the east of the store two fueling lanes for diesel trucks and larger vehicles. They are asking to
eliminated the two current curb cut and collapse them down to one, and have a larger curb cut for
the larger trucks. They would use signs to direct people where they would like them to go. They
have agreed to increase the radius of the corner to keep the speed of the traffic up as they make
the turn; that turn is to tight. They will landscape the entire perimeter and put in the asphalt.
They are also looking for pickups with trailers. They intend to have diesel pumps.
Chairman Anderson asked how many truck use their station now. Mr. Jackson estimate
about 30,000 gallons of diesel per month which means about 350 to 400 trucks a month or about
10 aday.

The commission discussed:
1. Concern about larger trucks entering Yellowstone from Burnside. The intersection is
really close.
2, The tight radius on the other side of the street.
3. Directing the traffic down Kings Way toward McKee' s.
4. Paving Kings Way- Jackson's would be happy to pay their fair share in that area
The meeting was opened up to public comment.
Jerry Rowland, Chubbuck Police Department addressed the commission with his concerns.
Currently they have two curb cuts. One of them as you pull off of Yellowstone onto Burnside, is
in a bad location. If the truck traffic is allowed, East Burnside needs to be one way. Kings Way
would need to be paved down to Evans. They have had some serious accidents there. We really
need to take a look to see if we want to have those semi's at the facility. Someday they will need
a traffic light there on Evans Lane.
The public hearing was closed.
Mr. Jackson, traffic exiting down Kings Way is a better idea. The trucks will still be coming there
for their business whether they make the changes.
The commission discussed:
1. If they decide to put it on Kings Way the turn lane would not be a problem.
2. Getting ride of Burnside and vacating the street
3. Making it a one way street
4. The city helping with the cost of paving Kings Way
5. If Burnside is a one way does he need to make the widen on Yellowstone
6. Using city increment money for the development of Kings Way
Don Moore moved to approve Mr. Jackson's proposal under the conditions that 1. Kings Way is
upgraded and 2. Burnside be turned into one way street. Ray Rosen seconded.. Roll Call vote;
Don Moore, yes; Ray Rosen, yes; Myrna Cain, yes: Dusty Whites, yes; Wally Wright, yes; Nolan
Briscoe, yes; Gayle Anderson, yes; Pete Anderson, yes.
2. An ordinance amending section 18.08.040B to require the setback on a corner with a garage
of carport opening to be the same as the front yard set back.
The meeting was opened up for public comment. There was none. The public hearing was closed
and brought back to the commission for a discussion.

Myrna Cain moved to recommend to the city council approval of the ordinance amending
section 18.08.040B to require the setback on a corner with a garage or carport opening to be the
same as the front yard set back. Wally Wright seconded. Roll call vote: Don Moore, yes; Ray
Rosen, yes; Myrna Cain, yes; Dusty Whited, yes; Wally Wright, yes; Nolan Briscoe, yes; Gayle
Anderson, yes; Pete Anderson, yes.
3. An ordinance amending section 18.12.040(F) of the Chubbuck Municipal Code to eliminate
the difference in site triangle requirements on a driveway from that imposed on other
streets.
The meeting was opened to public comment. There was none. The public hearing was closed
and brought back to the commission for discussion and a motion.
Wally Wright moved to recommend to the city council to adopt the amended ordinance
18.12.040F as amendment. Dusty Whited seconded.. Roll call vote: Don Mogre, yes; Ray
Rosen, yes; Myrna Cain, yes; Dusty Whited, yes; Wally Wright, Nolan Briscoe, yes; Gayle
Anderson, yes; Pete Anderson, yes.
Ray Rosen moved to require the city for safety purposes to look at the changing of Burnside to
one way, upgrading Kings Way for further traffic to eliminate traffic and accidents on to
Yellowstone from Burnside. Gayle Anderson seco)kdpd\ Aj aced in favor.
