HomeMy WebLinkAbout012 06 01LAND USE AND DEVELOPMENT COMMISSION December 6, 2001 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building December 6, 2001. Present: Chairman Pete Anderson; Commission Members: Ray Rosen, Myrna Cain, Gayle Anderson, Don Moore, Nolan Briscoe, Mary Harker joined the meeting prior to item 3 on the agenda; Attorney: Tom Holmes; City Staff: Sean Harris; Secretary Myrna Crapo. Chairman Pete Anderson called the meeting to order at 8:00 P.M. Chairman Anderson asked for approval of the November 1, 2001 minutes and November 1, 2001 special meeting minutes. Myrna Cain moved to accept the minutes as mailed and Gayle Anderson seconded the motion. All voted in favor. Chairman Anderson asked if any commission member had a conflict of interest. There was none PUBLIC HEARING:. 1. An application by Sharon Knudsen/David Carlsen Development, 2595 Hwy. 39, American Falls, Idaho 83211 for a change of Land Use District to General Commercial, (C-2), contingent upon a change in the Comprehensive Plan for said property north of the Redman Canal, south of Misti Manor Subdivision, east of Hawthorne Road. Property is presently zoned, Agricultural, (A). Chairman Anderson asked for any additional comments from city staff; there was none. He then asked the commission if anyone had questions of the city staff, the commission had no questions of the city staff. The meeting was opened up to public comment to those individuals who didn't receive a public hearing notice prior to last months meeting; everyone who testified last month had already provided their comments. Wayne Webb, 545 Bonanza, questioned the request to Commercial; he was told previously that piece of property would be zoned residential. He didn't feel like we were following the comprehensive plan. The public hearing was closed, there were no public comments from the developer so the meeting was brought back to the commission for a discussion and a motion. Chairman Anderson asked to have two letter that we had received on time entered into the record. 1. A letter from JP Realty, Inc. they were in support. 2. Victor Baron - raised concerns with traffic, property values. He was not in support. Land Use Commission December 6, 2001 Page 2 The commission discussed: 1. The size of the buffer zone wanted by residents and by the developers. Ray Rosen moved to recommend to the city council approval of the application by Sharon Knudsen/David Carlsen Development for a change of Land Use District to General Commercial (C-2), contingent upon a change in the Comprehensive Plan for said property north of the Redman Canal, south of Misti Manor Subdivision, east of Hawthorne Road. Property is presently zoned Agricultural; seconded by Don Moore. Roll call vote: Don Moore, yes; Ray Rosen, yes; Myrna Cain, yes; Nolan Briscoe, yes; Gayle Anderson, yes; Pete Anderson, yes. 2. An application by the City of Chubbuck to update the comprehensive plan; along with the Comprehensive plan map and proposed zoning maps. Chairman Anderson opened the meeting to public comment. Melvin Jackson, 5111 Whitaker Road, they have five acres of property. They would like to have the zoning on Whitaker Road Agricultural; as it fits the neighborhood. We need to have security around Hiline Canal to protect it. Flooding can be caused by subdivisions being built in the area. The public hearing was closed and brought back to the council. The commission discussed: 1. The map needs to be changed to include the subdivision next to Ellis School. Nolan Briscoe moved to recommend to the city council that we accept the comprehensive plan along with the proposed comprehensive plan map and zoning map, with a change in the maps to include current annexation. Myrna Cain seconded. Roll call vote: Don Moore, yes; Ray Rosen, yes; Myrna Cain, yes; Nolan Briscoe, yes; Gayle Anderson, yes; Pete Anderson, yes. GENERAL BUSINESS: 2. An application by Margaret McNabb, David Graham and Darris Ellis Enterprises, 13560 N. Hawthorne Rd., Pocatello, Idaho for a Planned Unit development, (PUD) for residential use with subordinate commercial uses, together with its Preliminary Development Plan. The LUDC will also consider the preliminary plat for the first development phase of approximately 11 acres, together with its requested annexation. Property is located west of Ponderosa, east of Philbin, south of West Chubbuck Road. Land Use Commission December 6, 2001 Page 3 Brian Flyn, 155 S. 2nd, Pocatello Idaho the only changes they have been made since the last meeting are the phase lines are included on the preliminary plat; and they changed the 2nd page at the end of the 1St paragraph stating that the parks will be dedicated to the city of Chubbuck. This is the vision of how the property will be developed. The commission discussed: 1. The reason for a P.U.D. being to be able to have a mixed use. 2. Changed the development master plan 3. Whether the master plan would be completed as it is. Mitch Greer, 156 S. 2nd, the plan allows them to deal with mixed uses; and allows some design flexibility. Nolan Briscoe moved to recommend approve of the application by Margaret McNabb, David Graham and Darris Ellis Enterprises for the planned unit development plan along with annexation into the city and also approving the preliminary plat for approximatelyl 1 acres for phases 1, 2, and 3 at the property located west of Ponderosa, east of Philbin, south of West Chubbuck Road.
