Present: Acting Chairman Ray Rosen; Commission Members: Wally Wright, Myrna Cain, Mary Harker, Dusty Whited, Gayle Anderson; City Staff: Steve Smart, Larry Kohntopp and Secretary Myrna Crapo. Chairman Ray Rosen called the meeting to order at 8:00 P.M. Chairman Rosen asked for approval of the December 7, 2000 and March 1, 2001 Mary Harker moved to accept the minutes of March 1' 2001; Myrna Cain seconded. All voted in favor. Mary Harker moved to accept the minutes of December 7, 2000; Wally Wright seconded. All voted in favor. Chairman Rosen asked if any commission member had a conflict of interest with any of the agenda items. There was none. PUBLIC HEAR1NG: 1. An application by Vern Combs, 963 Diablo, Pocatello, Idaho, 83201, for a Conditional Use Permit to allow an Amateur Radio Transmission Antenna at 5250 Stuart. Property is presently zoned Limited Residential, (R-2). Deborah Combs, 5250 Stuart, explained that they would like to have two tower. The meeting was opened up to public hearing. Teresa Schmidt, 5227 Stuart presented a letter of 33 neighbors who were not in favor of the tower. The letter did not meet the deadline for accepted by the commission. Gary Anderson, 410 Adams, they are concerned with safety and possible interference in cell phones, television and etc. The area is highly residential. Glenda Funk, 441 Chesapeake, is concerned that the public notice doesn't state two towers were being requested. Bill Konzel, 5375 Stuart Avenue, in the Cottage Grove subdivision there are only 30 some homes in the area. He is opposed to the antenna for safety concern and interference. Jim Schmidt, 5227 Stuart, he lives directly across the street and is a volunteer fire fighter and feels it will interfere with his ability to receive fire calls. Land Use and Development Commission April 5, 2001 Page 2 Phil Quinton, 5372 Lori Lane, where he lived back east the towers did miss up cell phones, etc. It interferes with the privacy of the neighbors. Randy Bennett, 5260 Stuart Avenue, he lives north of the address. He is not in favor of the towers due to interference and aesthetics. Since he is next door he will experience the same interference he did when he grew up living next door to one. He would like to know the requirement of the permit that they will have to meet. Bill Konzel, 5375 Stuart, read a letter he received from the attorney general of the State of Idaho concerning Restrictive Covenants enforcement. Kelli Anderson, 410 Adams is against it. Aesthetically it is ugly. She is concerned about the safety if it is blown over. Scott Maclean, 5280 Stuart, is not in favor because of the aesthetics. He agrees with everything that has been mentioned. The public hearing was closed and brought back to the application for additional comments. Deborah Combs, 5250 Stuart, they keep a neat and clean yard. They keep the area fenced in with the gates always locked. The tower are in 5' of concrete 6'deep. The tower is 18" in diameter. They would like to get along with their neighbors. He helps to report storms and major outages. They now live on the property. They will put a wire cage in the ground to install the antenna in which will be free standing. The meeting was opened to the commission for discussion. They discussed 1. Safety issues. 2. Aesthetics 3. Having one tower instead of two 4. Conditions that might make it less atrusive. Mary Harker moved to deny this application on reasons of 1. Health and safety 2. Interference with transmission of television and phones 3. heights 4. The use of two towers over one, 4. The concern of fall zones in a residential area. Wally Wright seconded. Roll call vote: Myrna Cain, yes; Wally Wright, yes; Mary Harker, yes; Dusty Whited, no; Gayle Anderson, yes; Ray Rosen, yes. Land Use and Development Commission April 5, 2001 Page 3 2. An application by Darris Ellis for a Change of Land Use District to Single Family Residential (R-1) and Limited Residential (R-2); contingent upon a requested annexation. Property located between Whitaker and Hiline Road, south of Ellis School. Chairman Rosen asked for any additional report from the staff there was none. Mitchell Greer, 155 S. 2nd Avenue, Rocky Mountain Engineer, they will have 46 lots in the area. A small portion are R-2 the rest are R-1. The comprehensive plan was discussed and a comparison made between what they were going to do and what the comprehensive plan addressed. It would provide affordable housing for younger families. It is an infill type development. The meeting was opened up to public hearing for those in favor of the application. Darris Ellis, 13560 N. Hawthorne Road, this subdivision will be similar to Mountain Park Subdivision and Paradise Acres. With an R-2 lot he can get a smaller home with a smaller lot. He has restrictive covenants. Mr. Ellis is trying to market to younger families. The meeting was opened to those were opposed to the motion. Glenda Funk, 441 Chesapeake, she is concerned with the traffic increase; and wants to know what guaranteed there are that the homes would not be manufactured homes. Mrs. Funk had several questions she would like answered: 1. What is the impact on Whitaker Road, sewer and water. 2. The impact on Ellis Elementary with the additional families. She would like to proposed home to be in harmony with those in the neighborhood and would like fewer homes in the area. Vern Briscoe, 5112 Whitaker Road, he is concerned with the number of lots going in the subdivision. He feels that it should be R-1 area. Bill Brown, 5351 Whitaker Road, they have lived there 8 or 9 years. He is concerned about lower cost housing that is going in and that Whitaker Road surface is not good. They need a gravity flow sewage system. He objects to the density. Roger Brown, 5555 Hiline, lives behind the proposed division. He is opposed to the density of the homes. Franklin Briscoe, 605 Marie Circle, he thought that it would be no more then 4 homes per acre when he sold the ground. He doesn't like to see home crowed close together and regrets what has happened so far. He offered two acres of ground for a park to the city provided them 1. They Control the density 2. Move the entrance 3. Some of the land would be used up in a park development Land Use and Development Commission April 5, 2001 Page 4 Melvin Jackson, 5111 Whitaker Road, he has 5 acres and is worried about the deteriorating of Whitaker Road. The impact on Ellis school would be great. They need a storm drain along with the subdivision. Verlyn Ashton, 5269 Whitaker, agrees with what have been mentioned. He is concerned with the drainage during a storm. He would like to see less density. Traffic impact need to be addressed. Malcolm Pope, 7273 Whitaker Road, they have lived here for 3 years. He is opposed. Bill Konzel, 5375 Stuart, he is opposed because it doesn't meet a preliminary plat requirements. Dennis Hanner, 5018 Whitaker Road, has lived here 33 years. He is concerned with the traffic. He want it to stay a nice neighborhood. Ross Minson, 4840 Whitaker Road, the subdivision has too small roads. He doesn't think it is suitable housing for Whitaker Road. Wayne Hawks, 481 Chesapeake, the drain system in Victoria Subdivision doesn't drain. There is no place to put the drainage water. The road has a lot of traffic on it. Phil Clayton, 432 Chesapeake, he is concerned with the safety of kids going to school and having to walking. He is opposed to the smaller lots. Mitchel Greer, Rocky Mountain surveying, addressed the comments that were made. This development could generate 460 car trips per day. He will not have manufactured homes in this development. They are proposing swells for storm drains. Darris Ellis 13560 Hawthorne Road. They are accessing Hiline Road which should cut down on the activity on Whitaker Road. The higher range home market is dead, so they want to sell these homes to younger families. The public hearing was closed and brought back to the commission for a discussion. The commission discussion 1. The zoning on Whitaker Road 2. The requirement of R- 1 Dusty Whited moved that we recommend to the city council approval of the change of land use district to single family residential R-1 and limited residential R-2 as shown on the preliminary plat provided. Motion died for a lacked of a second. Land Use and Development Commission April 5, 2001 Page 5 Mary Harker moved that we recommend to the city council annexation of the Cambridge Estates located between Whitaker Road and Hiline Road and that it be designated as R-1. Wally Wright seconded Roll call vote: Myrna Cain, yes; Wally Wright, yes; Mary Harker, yes; Dusty Whited, yes; Gayle Anderson, yes; Ray Rosen, yes. 3. An application by Darris Ellis and David Graham, 13560 N. Hawthorne, Pocatello, Idaho 83206 for a Preliminary Plat for Cambridge Estates, located between Hiline and Whitaker Road south of Ellis School. Mitch Greer, 155 S. 2nd, these lots as proposed meets the most restrictive zoning requirements in the City of Chubbuck. Darris Ellis, 13560 N. Hawthorne Road, feels it is a positive move for the city of Chubbuck. He would to see it accepted. The meeting was opened to public comment. Bart Reed, School District 3115 Poleline Road. They spoke with Rocky Mountain Engineering about a park in the area. They would like to place the proposed park in the middle of the middle of the Ellis Elementary property to the south. It would create a cul-de-sac on Kelsey Lane. They are concerned about the safety of the children in that area. They are concerned about the lack of sidewalks on Whitaker Road. Mr. Greer, Rocky Mountain Engineering, would like to see if the pedestrian ways address the safety concerns. There would be sidewalks within the development. Bart Reed, having sidewalks on Whitaker Road would address their safety concerns. They were approached with the question if they would be favorable with Ellis Elementary School to have a adjacent park. So they came up with this proposal. The meeting was opened to those in Favor. There were none. The meeting was then opened to those oppose. Kelli Anderson, 410 Adams. There are no sidewalks in their area. The kids will not always access those pathways. There is a need to have sidewalks in the area. Glenda Funk, 441 Chesapeake, she is concerned with the sidewalk issue. Phil Clayton, 432 Chesapeake, asked how the modular homes could be assured to be kept out of the subdivision. The swells for run off water does not work. They need a decent drainage system. Bill Konzel, 5375 Stuart reviewed the Chubbuck Code requirements for a preliminary plat. Land Use and Development Commission April 5, 2001 Page 6 Dennis Anderson 4960 Whitaker, he wondered about where the park was going to go in. Mitchell Greer, 155 S. 2nd Avenue. Whitaker is a collector street so direct access onto Whitaker Road is limited. The meeting was closed and turned over the commission for discussion. The commission discussed: !. The width of Whitaker Road Wally Wright we recommend approval of the application by Darris Ellis and David Graham, 13560 N. Hawthorne, Pocatello, Idaho for a preliminary plat for Cambridge estates, located between Hiline and Whitaker Road south of Ellis School with the curb and sidewalk on the east side of Whitaker road running north and south with the property being developed. We recommend the approval of two access from the property going into Ellis School. Seconded by Myrna Cain. Roll call vote Myrna Cain yes; Wally Wright, yes; Mary Harker, yes; Dusty Whited, yes; Gayle Anderson, yes; Ray Rosen, no. 4. An application by Parker-John L.L.C. for a Preliminary Plat for Garden Oaks Subdivision, phase 3. Property is located on Sample Way and Stuart. Willard Price, 697 E. 1600 N. Idaho Falls, they met all the requirements of phase one. All of Siphon Road will have sidewalks by the time the development is finished. The park will be located next to Cottage Grove. They will not have twin homes or duplexes. The meeting was opened for public comment. Steve Christensen, 5357 Lori, he is concerned about restrictive covenants. They don't want to see modular homes. There are no stick built homes there yet. He is concerned about his property value going down. He is also concerned with speeds in the area. He would like to recommend that covenant be established before any more developments. Gary Anderson, 410 Adams, he is concerned with the high density houses going in. The traffic will go down Adams Street and cause a safety problem in the area. Bill Konzel, 422 Mindy Driven is concerned about modular homes. Kelly Anderson, 410 Adams, she is concerned with the speed of cars on the road. We need less traffic on those roads. Bill Konzel, 5375 Stuart, reviewed the things that took place in the prior meeting. He is concerned about the transition. Mary Harker moved to recommend to the city council approval of the preliminary plat for Garden Oaks Subdivision phase. Dusty Whited seconded. Roll call vote: Myrna Cain, yes; Wally Wright, yes; Mary Harker, yes; Dusty Whited, yes; Gayle Anderson, yes; Ray Rosen, yes. Dusty Whited moved to table the General Business items.
