HomeMy WebLinkAbout011 07 02Land Use and Development Commission November 7, 2002 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building November 7, 2002 Present: Chairman Pete Anderson; Commission members: Don Moore, Ray Rosen, Jason Mendenhall, Mary Harker, Nolan Briscoe, Gayle Anderson; Attorney: Tom Holmes; City Staff: Steve Smart; Secretary Myrna Crapo. Chairman Anderson called the meeting to order at 8:00 p.m. Chairman Anderson asked for approval of the minutes of September 5, 2002 special meeting, September 5, regular meeting, Oct 3, 2002 special meeting, October 3, regular meeting. Ray Rosen moved to approved the minutes; Don Moore seconded; all voted in favor. Chairman Anderson asked if any commission members had a conflict of interest. There was none PUBLIC HEARING: 1. An application by Elite Contractors, Inc., 449 South 7"' Avenue, Pocatello, Idaho, for a n conditional use permit for a beauty school. Property is located at 141 E. Chubbuck Road. Property is presently zoned General Commercial (C-2). Attorney Holmes stated that members of the staff is concerned about two accesses. James Harvesten, 449 S. 7t' Pocatello, The clients wanted to have two accesses into the property. They have ample room for parking. The city requirement to cover one access with grass and landscape would be an additional expense to the owners in order to close it off. The commission discussed: 1. Having one driveway designated as entrance only and one as exit only. Chairman Anderson opened the meeting to public comment. Linda Mottishaw, 5130 Whitaker Road, they own the Pocatello Beauty Academy Inc. at 257 North Main Street. They have had an increase in students lately and need to have a place that has parking available and additional work stations. They will move their existing business there and expect to have 60 to 70 students plus their customers. They didn't plan on the additional expense for closing one of the accesses. n The public hearing was closed and brought back to the Commission for discussion and a motion. Land Use and Development Commission November 7, 2002 Page 2 Chairman Anderson reviewed the history for the two accesses at this location. The commission discussed: 1. Having one an entrance and one an exit 2. The business being a good one to have in the city. 3. The curb cuts being large will make it two way traffic. 4. Designating one right turn lane and one a left turn lane on the exit only. 5. Looking at the potential to get an 24' easement west over the gravel on Rite Aid properties. 6. Doing a notice of record to show whoever buys Rite Aide will have to get an easement to go through the Beauty School property to Chubbuck Road. Mary Harker moved to grant the conditional use permit to the Pocatello Beauty Academy, 449 S. 7" Avenue, Pocatello, Idaho for a Beauty School at Grover's Property at 141 E. Chubbuck Road; with the condition that they grant the Rite Aide property access through Pocatello Beauty Academy on Chubbuck Road; and that a notice of record be recorded that when the Rite Aide property is developed that the access from Rite Aide onto Chubbuck Road will be removed and their access will be through the western entrance of the Pocatello Beauty Academy; seconded by Jason Mendenhall. Roll Call Vote: Don Moore, yes; Ray Rose, yes; Jason Mendenhall, yes; Mary Harker, yes; Nolan Briscoe, yes; Gayle Anderson, yes; Pete Anderson, yes. 2.An application by High Deseret Homes, 1754 Cottage, Pocatello, ID, 83201, for a Preliminary Plat for Garden Park Subdivision, 2" addition. Property is located east side of Rose Street. The commission discussed: 1. The access for a road to be built over to Afton near Smith's. Ken Pape, 1754 Cottage, There is undeveloped property at the trailer sales for which they will try to develop. The have fort Hall irrigation water. The meeting was opened up for public comment. There was none, so the public comment was closed and brought back to the commission for a discussion. The commission discussed: 1. The layout of the existing property for future roads being built 2. Where the stub is located, and moving it. 3. The parks fee being paid in lieu of doing a park. Land Use and Development Commission November 7, 2002 Page 3 Nolan Briscoe recommends approval to the City Council for the Preliminary Plat by High Deseret Homes at 1754 Cottage for Garden Park Subdivision 2" addition with the condition that the stud be located where as future development on the east of the subdivision would be able and that money be accepted in lieu of park; seconded by Don Moore. Roll call vote: Don Moore, yes; Ray Rosen, yes; Jason Mendenhall, yes; Mary Harker, yes; Nolan Briscoe, yes; Gayle Anderson, yes; Pete Anderson, yes. GENERAL BUSINESS: 1. Discussion of the Comprehensive Plan: The commission discussed the time frame for the changes in the Comprehensive Plan. A open house for the public would be held in January and the public hearing would be in February. Ray Rosen moved to have the open house in January and to have ary Harker in charge of publicity and the open house. Gayle Anderson seconded.
