HomeMy WebLinkAbout006 06 02LAND USE AND DEVELOPMENT COMMISSION June 6, 2002 Minutes of the regular meeting of the Land Use and Development Commission held in the City Municipal Building June 6, 2002. Present: Chairman Pete Anderson; Commission Members: Don Moore, Ray Rosen, Jason Mendenhall, Mary Harker, Wally Wright; Attorney: Tom Holmes; City Staff: Sean Harris and Steve Smart; Secretary Myrna Crapo. Chairman Anderson called the meeting to order at 8:00 P.M. Chairman Anderson asked for approval of the May 7 and April 25, 2002 minutes. Don Moore moved to accept the minutes as mailed; Mary Harker seconded the motion. All voted in favor. Chairman Anderson asked if any commission member had a conflict of interest. There were none. PUBLIC HEARING: 1. An application by Colter Kirkham, 2435 N. Pamela Drive, Inkom, Idaho, 83245 for a change of Land Use District to Limited Commercial, (C-1) contingent upon requested annexation. Also a conditional use permit for a residence on the property. Property is located on the SW corner of Siphon Road and Whitaker Road, north of Victorian Village. Colter Kirkham, 2435 N. Pamela Drive, Inkom they are in the process of purchasing the 2 acres and plan on putting a shop and a home. He is not going to do a commercial at the present, but may later. He repairs wheel chairs on the side. If his business grows he will do most of the business out of patients homes. The meeting was opened for public comment. Dean Funk, 1749 S. Fairway, this piece is next to the property brought in last month. It is in compliance with the comprehensive plan and would be compatible with the area. Terry Baker 468 Pocano, he adjoins the property from behind. He is in favor of having Mr. Kirkham in the back of his place. If Mr. Kirkham has animals he would like to have a privacy fence for the property. He would be willing to pay for half of the fence. He has small children and would like to protect them from the horses he is thinking of putting there. They would like to have a fence put in now. Glenda Funk, 441 Chesapeake, it would be nice to have the fences consistent with all others in the area. They could have an agreement with the neighbors on the type of fence for everyone to put in. Land Use and Development Commission June 6, 2002 Page 2 Marcye Kirkham, 2435 N. Pamela Drive, Inkom, they have two dogs and no horses so it shouldn't be a problem. They just want to build a nice home there. There main concern is their family. The public hearing was closed and Chairman Anderson asked Colter Kirkham to address any concerns. Colter Kirkham, he is in agreement with the fencing. They would like to put a circular drive so they won't have to back up with school kids in the area. The commission discussed: 1. A fence is not needed for residential use. 2. Having to fence animals in Mary Harker moved to recommend to the city council an annexation of the property at SW corner of Siphon and Whitaker Road, and that the zoning be changed to C- 1 (limited commercial) And that the Land Use Commission approve a conditional use permit for a residence in C-1 (Limited Commercial) Seconded by Don Moore. Roll Call vote: Don Moore, yes; Ray Rosen, yes; Jason Mendenhall, yes; Mary Harker, yes; Wally Wright, yes; Pete Anderson, yes. 2. 1. An application by Heritage Development, Box 2684, Pocatello, Idaho, 83206 for a Preliminary Plat for Victorian Village 2rd Addition. Property is located west of Pocano Street. There was no representative from Heritage Development. The meeting was opened for public comment. Darris Ellis, 13560 North Hawthorne Road, he wanted a clarification on the code for the City of Chubbuck to allow a hammer head. He would like the city to be consistent in there requirements. The commission discussed: 1. The code definition of a hammer head. 2. Having him use a circular turn around instead of a hammer head. 3. The areas in the city that have a hammer head 4. If the size of the adjoining lots would be adequate with a turn around Ken Funk, 441 Chesapeake, wanted to know what he is asking to do. Chairman Anderson closed the public hearing and turn it to the Commission for a discussion and a motion. Land Use and Development Commission June 6, 2002 Page 3 Don Moore moved to recommend to the City Council the approval of the preliminary plat for Victorian Village 2nd addition with the exception of the change from the hammer head to the cul- de-sac. Seconded by Wally Wright. Roll call vote Don Moores, yes; Ray Rose, yes; Jason Mendenhall, yes; Mary Harker, yes; Wally Wright, yes; Pete Anderson, yes. 3. An application by Heath Fullmer, 2628 Birdie Thompson, Pocatello, Idaho for a Conditional use permit to conditionally permit a duplex at 4843 Valenty. Property is presently zoned General Commercial (C-2). The public hearing was combined for items 3 and 4. Heath Fullmer, 2628 Birdie Thompson, they would like to divide the present home into two rentals. The shop would be put on the south side of the home. The shop will be used for storage. The top will be a family home in which they will live. The tenants would be allowed to park in the new driveway. The commission discussed: 1. The amount of parking that is needed 2. They will need to have curb, gutter and sidewalk on the street 3. Green way that is required 4. How to fit the parking onto the lot 5. Four parking units for the duplex 6. Two for residents above the garage 7. The condition of the existing drive-way The meeting was opened to public comment. There was no comment. The hearing was closed and brought back to the commission for a discussion. Jason Mendenhall moved to grant the application by Heath Fullmer, 2628 Birdie Thompson, Pocatello, for a conditional use permit for a duplex at 4843 Valenty which is presently zoned Commercial (C-2) with the requirement that it goes through design review and meets the parking ordinances for the city. And also that the conditional use permit be granted for the single family dwelling at 4843 Valenty which is also presently zoned C-2; same conditions. Seconded by Mary Harker. Roll call vote: Don Moore, yes; Ray Rosen, yes; Jason Mendenhall, yes; Mary Harker, yes; Wally Wright, yes; Pete Anderson, yes. 4. An application by Heath Fullmer, 2628 Birdie Thompson, Pocatello, Idaho for a Conditional use permit to conditionally permit a single family dwelling above a commercial shop building, the shop building to be new construction, at 4843 Valenty. Property is presently zoned General Commercial (C-2). Combined with #3. Land Use and Development Commission June 6, 2002 Page 4 GENERAL BUSINESS 1. Discussion on proposed ordinance amending section 18.12.031A to provide for the use of shipping containers, including those used on ocean-going vessels and railcars to be used as accessory structures. The commission discussed: 1. Outlawing them altogether. 2. Recommend the change to agree with #3 on the ordinance 3. Present containers in Pocatello 4. Maintenance on the containers being included in the ordinance changes 5. Being allowed in a C-2 and Industrial Zone and not in residential or C-1 Mary Harker moved to include the changes in the ordinance for shipping containers (the fourth paragraph) to include allowance in C-2 and industrial under a conditional use permit. Seconded by Ray Rosen All voted in favor. Chairman Anderson we need to take a look at our off-street parking ordinance to see if we need to change the language.
