Present: Chairman Pete Anderson; Commission Members: Dusty Whited, Gayle Anderson, Don Moore, Ray Rosen, Jason Mendenhall, Wally Wright; Attorney: Tom Holmes; City Staff: Larry Kohntopp, Sean Harris and Steve Smart; Secretary Myrna Crapo. Chairman Anderson called the meeting to order at 8:00 P.M. Chairman Anderson asked for approval of the June 6 and 26, 2002 minutes. Gayle Anderson moved to accept the minutes as mailed; Don Moore seconded the motion. All voted in favor. Chairman Anderson asked if any commission member had a conflict of interest. Dusty Whited declared he had one with item 8 and will be stepping down. PUBLIC HEARING: 1. An application by Magic Valley Construction, 10305 W 13600 N. Tremonton, Utah, for a Planned Unit Development, (PUD) for Apartments, together with its Preliminary Development Plan. Property is located south of Adams, north of James, and west of 5231 and 5247 Yellowstone City Staff Larry Kohntopp explained that the access off of Yellowstone had changed. I.T.D has made concessions as well as the city in closing off Adams street. Adams street lot 8 has a sewer easement and would allow for a street off of Adams. Lynn Rindlisbacher, Tremonton, Utah they are proposing 264 apartments to be done in two phases. Phase 1 would probably be 6 buildings. Phase 2 would be 5 buildings. 24 units per building, each being 2 stories tall. It will be the nicest one in the Pocatello Area. They need to line up with Park Lawn for the intersection. Fire trucks will be able to go up and around and back down. They showed slides of existing apartment units. It will have an open feeling. They want everything maintenance free. They will have a swimming pool, basketball hoops, picnic tables, Club house, two tot lots. Every unit will have one covered parking and one uncovered. The garages will be an extra cost and there would be 30. The commission talked about: 1. The 6' solid vinyl fence on the outside will be a privacy fence. The building are held away from the outside of the development. 2. On site managers. Full time staff during the day. Usually two that live on site. Landscape crew mows the grass once a week. 3.20 to 25 extra parking for visitors. 4. Division of phase 1 and phase 2 5. The back portion of the property between phase 1 and phase 2 will be used for grazing. Sharon Adams, 5212 Lucky, how will it effect the irrigation for people on Lucky Street. Rhoud Porter, 14358 Siphon, he owns Tasty Treat. He is for this and feels that it is well planned, and developed. Linda Hahn 4200 Hiskee Street, she thinks it is a great thing. Chris Cranor, 253 James, he would like to have them look at the impact that it will put on James. He would like to have trees to buffer the residential neighborhood on the fence line. The public hearing was closed. Lynn Rindlisbacher, the irrigation they will have to do what is required. The trees will be planted with bushes. They will submit this to staff when it is ready. The commission asked: 1. If Tastee Treat will have access to their road. The answer is yes. 2. An application by Magic Valley Construction, 10305 W 13600 N. Bothwell, Utah, for a Preliminary Plat for Country side Apartments. Property is located approximately 5200 Yellowstone Highway. This item was opened for public comment. There was no further comment the public hearing was closed. Wally Wright moved to recommend to the city council approval of the application by Magic Valley Construction, 10305 W 13600 N. Tremonton, Utah for a Planned Unit Development, (PUD) for Apartments, together with its Preliminary Development Plan. Property is located south of Adams, north of James, and west of 5231 and 5247 Yellowstone. And include in that motion approval of the application by Magic Valley Construction 10305 W 13600 N. Bothwell, Utah, for a Preliminary Plat for Country side Apartments. Property is located approximately 5200 Yellowstone Highway. Don Moore seconded. An application by Romriell Family Trust, 600 Marie, for a Planned Unit Development, (PUD) for storage sheds together with its Preliminary Development Plan. Property is located at 5361 North Yellowstone. 4. An application by Gregory Romriell, Alan Romriell, and Earl Romriell, 114 S. 17th, Pocatello for a Preliminary Plat for Chubbuck Storage Center. Property is located at approximately 5200 Yellowstone. Item 3 and 4 will be considered together. Alan Romriell, 612 Vern and Greg Romriell, 114 S. 17th, Pocatello The accesses for commercial property owners in the area will be limited onto Yellowstone. They are working with the engineering firm of Magic Valley Construction. They will be doing a storage facilities that will be compatible with their development. The storage sheds will cut down on the number of trips that people will make out of this property. They want to be compatible to the PUD development. It will be gated and secured. The commission asked Mr. Romriell: 1. If they have any additional storage sheds in the town, (no). 2. What they will look like. (They will have storage sheds around the parameter. It will be fire proof. It will be built in two phases). The public hearing was opened to public comment. Wayne Newby, 275 Adam, he will be backing this property. He has no objection but some concerns. He is concerned with his privacy, is the fence going to be put up after, before or during the project. The water rights are a concern. Is this going to be the same white fence as around the apartments. Is Adams going to be closed. He is concerned about parking along their property line for open storage. The public hearing was closed. Greg Romriell, Fort Hall irrigation, were notified of the hearing. The drainage would be dictated by them. The fence will be similar to Magic Valley project. The fence on the north side will be a building and then a fence on the outside of it. It was brought back to the commission for discussion. 1. It is good in-fill project for the property. Don Moore moved to recommend to the city council approval of the application by the Romriell Family Trust, 600 Marie, for the Planned Unit Development for storage sheds with its Preliminary Development Plan. Property is located at 5361 N. Yellowstone. In addition the application by Gregory Romriell, Alan Romriell, and Earl Romriell for a Preliminary Plat for Chubbuck Storage Center. Property is located at approximately 5200 Yellowstone. Dusty Whited seconded. An application by Pheasant Ridge Development, 3875 South Hwy 23, Wellsville, Utah for a Planned Unit Development together with its Preliminary Development Plan, and requested annexation; along with the Preliminary Plat. Property is located west of Hiline; south of Briarwood and north of 1-86. Land Use and Development July 11, 2002 Page 4 Larry Kohntopp informed the commission that I.T.D. wants specified a 20' setback from their right that abuts 1-86 before any property or buildings. Gary Brown, 2708 Mt. Borah, Pocatello, (realtor). It is a great project for low entry housing. Scott Morrel, 1576 S. 3200 W., Logan, Utah; they need to have it annexed into the city.. They wanted a walking neighborhood that has a mix. It will be targeted for affordable housing, with covenants and restrictions to maintain the property with a home owner group for the common areas. It is intended to be buffered the project so it stands alone. They will fence the project. The commission discussed: 1. Having access to Whitaker Road and lining up with Mt. Lake Road. 2. It would start in the NW corner as phase 1, then NE phase 2, SW phase 3, SE phase 4. It will depend on the market. 3. Units for sale, not apartments. Two story complexes. They will have garages that will match the town homes themselves. 4. The detention pond is on the high side of the property. They want to split the detention location and not concentrate them in one place. 5. Phase 3 and Phase 4 will be when the recreation area is put in. 6. Storage areas are intended for the use of town homes and not for commercial. 7. Amixture of everyone. 8. 30% being kept as rentals. 9.2.6 parking allowed 10. Maintaining the areas before they are built upon. It will be farmed. The meeting was opened for public comment. LeAnn Biddle, 4567 Mt. Park Road, would like to have it single dwelling homes. John Hawn, of the U.S. Postal Service, 2400 Hiskee Street, what kind of mail delivery will they want. They need a centralized delivery area similar to Briarwood estates. Craig Parrish, 689 E. Chubbuck Road, an extension of Eagle Road is planned by them. They welcome what they are trying to do. Mike Norris, 460 Holly, he is concerned with the detention pond. The one by their home is always flooded. The public hearing was closed. Land Use and Development Commission July 11, 2002 Page 5 Mr. Merrill, it will not ever be single family because of the price of property. In each cul-d-sac there could be a bank for mail delivery. Storm water detention - the large grassy area would be part of the storm water. There will have a 6' vinyl fence as a buffer. There will be a detention area by the railroad. They will sit back from Alamo at least 20' and put their utilities there. They want to be separated from Briarwood. The meeting was brought back to the commission for discussion. Don Moore moved to recommend to the city council annexation of the property at Hiline, south of Briarwood and north ofi-86. Wally Wright seconded. Ray Rosen moved to recommend to the city council approval of the Planned Unit Development together with the Preliminary Development Plan for the property located west of Hiline; south of Briarwood and north ofi-86. The commission discussed: 1. Reviewed the minutes of Briarwood and what was required of them. 2. The proposed Alamo Street would need to be done by Briarwood. 3. Alamo is 45' which is 5' short 4. The elevation problem with drainage Ray Rosen moved to require to resubmit the preliminary plat with access into project from Whitaker road to Quail Run and also Quail Run to be line up with Mt. An application by Walter Rowntree, 3333 Middle Road, Columbia Falls, Montana for a Conditional Use Permit for a small animal veterinary clinic. Property is presently zoned General Commercial (C-2). Property is located at 124 Park Lawn Drive. 7. An application by Walter Rowntree, 3333 Middle Road, Columbia Falls, Montana for a Conditional Use Permit for residential apartment at 124 Park Lawn Drive. Property is presently zoned General Commercial (C-2). Items 6 and 7 to be considered together. Mark Kinghorn, Kinghorn Architectecure, 850 Spyglass Rd., Pocatello, a veternary hospital second floor will be a residence. The upstairs will eventually become a doctor, business offices. It will fit at that location. Land Use and Development July 11, 2002 Page 6 The commission asked Mr. Kinghorn: 1. If they will have any outside kennel runs. The answer was no. There will be an outside walking exercise area behind the screen fence. It will be for small animals. The meeting was opened up to public comments, there was none so the public hearing was closed and brought back to the commission. Dusty Whited moved to approve the conditional use permit for a veternary clinic as well as the residence for Walter Rowntree, 3333 Middle Road, Columbia Falls, Montana; property located at 124 Park Lawn Drive. Ray Rosen seconded. Roll call vote. Don Moore, yes; Ray Rose, yes; Wally Wright, yes; Jason Mendenhall, yes; Dusty Whited, yes; Gayle Anderson, yes; Pete Anderson, yes. 8. An application by AAA Construction, 775 Jensen Grove, Blackfoot, Idaho for a Designated Geographic Area for 219 Briscoe Road. Property is presently zoned Limited Residential (R-2). Dusty Whited removed himself from the commission for this item. Dan Hale, 725 Jensen Road Drive, Keith Rasmussen is the owner of the property but couldn't be here tonight. They want to do a duplex on this ground. There is a existing structure on the ground. The twin homes will fit in between the existing structure and Briscoe Road. The side of the structure will be facing Briscoe Road. They will be low maintenance. The meeting was opened up to public comment. Don Curtiss, 224 Briscoe, he is not against a duplex, but doesn't want three or four there. The property is not well managed. There is a lot of cedar brush dumped there and if that is an indication of how it would be managed it is a concern. Ray Coles, 227 Briscoe Road, He doesn't want a duplex there. It will not be compatible with everything else. He would like to see a home there. Ardith Whited, 207 Briscoe, could he have two twin homes in the area. She wants to keep the street the way it is. She wonders what the future plans of the property are. She is concerned about children playing in the street. Dusty Whited, 4640 Teton, he is concerned about clustering of duplex' s. It is an L shaped piece of property. They are concerned with the rumor of additional 4-plex' s. Land Use and Development Commission July 11, 2002 Page 7 Lisa Smith, 210 Briscoe Road, she is concerned with the way the property is being taken care of. It is referred to a dump by her friends. It could change the dynamics of the neighborhood. There is a problem with the way the property is kept now. Steven Tubb, 153 Briscoe, he is concerned with the way the house is put on the property. How would that affect the neighbors view. The public hearing was closed. Dan Hale: the owner will keep the land nice and have it look good. He would like to clean it up. It would improve that land. He does a nice job and doesn't skimp on anything. It was brought back to the commission for discussion: 1 .Possible areas to include. Don Moore moved that we designate the geographical area of Briscoe Road to include the east of Yellowstone, the south of the southern property lines of Belva Lane, the west lot 333 Briscoe and the north property lines of the addresses on Briscoe, the southern property line of the addresses on Briscoe. Ray Rosen seconded. Roll Call vote: Don Moore, yes; Ray Rosen, yes; Wally Wright, yes; Jason Mendenhall, yes; Gayle Anderson, yes; Pete Anderson, yes. 9. An application by Becker Management, 1921 N. Harrison, Pocatello, for a Preliminary Plat for Kasiska Subdivision 2"d Addition. Property is located west of Deer Avenue, south of Redmond and an extension of Alpine. Mitchell Greer, 155 S. 2nd Avenue, Rocky Mountain Engineering. Everything is sold out in the 1st addition. It will be 13 lots. They need to modify the depth of the asphalt on alpine street. The first four lot (1,2,3,4) being designated as twin homes. They want to delay the park until the 3rd phase. Vacant ground would remain in it's natural state for now. The commission discussed: 1 The width of Alpine Street 2. Alpine Street being designated as a minor arterial. The public hearing was opened for public comment. There was none, so it was closed and brought back to the commission for discussion. 1. The width of the street 2. Cars being put on the street 3. The width being difference on each sides of the canal 4. Taking care of run off water. An ordinance amending section 18.12.031A providing for the use of shipping containers, including those used on ocean-going vessels and railcars to be used as accessory structures. The meeting was opened for public comment. Craig Parrish, 689 E. Chubbuck Road, they would prefer not to include agricultural areas, just residential areas. The public hearing was closed and brought back to the commission for a discussion. Gayle Anderson moved to recommend to the city council amending section 18.02.030a providing for the use of shipping containers, including those used on ocean-going vessels and railcars to be used as accessory structures. Jason Mendenhall seconded. Gayle Anderson moved to amend the motion to allow in agricultural areas with a conditional use. Jason Mendenhall concurred. Roll call vote: Don Moore, yes; Ray Rosen, yes; Wally Wright, yes; Jason Mendenhall, yes; Dusty Whited, yes; Gayle Anderson, yes; Pete Anderson, yes.
