HomeMy WebLinkAbout04 23 1991 CM57 COUNCIL MEETING MINUTES April 23, 1991 Minutes of regular meeting held in the city municipal building, April 23, 1991. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, David A. Landor, W. Dean Wood, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Attorney Thomas J. Holmes was excused. Meeting was called to order at 7:30 p.m. by Mayor Cotant. APPROVAL OF MINUTES - Mayor Cotant asked for corrections or additions to the minutes of April 9, 1991. Councilman Landor moved to approve the minutes of April 9, 1991 as read. Councilman Wood seconded. All council members present voted in favor of motion. PROCLAMATION - "LOYALTY DAY" - Mayor Cotant read the proclamation in full. Walt Parker, VFW Post 735 was present to say a few things about Loyalty Day, and invite Mayor Cotant to spend some time at the VFW Post 735 Meeting, May 1, 1991, 7:00 p.m. Mr. Parker invited Mayor Cotant and Council to attend a VFW Dinner on the 27th. of April, 7:30 p.m. Councilman Wood moved to direct Mayor Cotant to proclaim, May 1, 1991, Loyalty Day. Councilman England seconded. All council members voted in favor of motion. BACKHOE BID - Sealed Bids were received for a wheel mounted backhoe loader until 2:00 p.m. April 16, 1991. Councilman Landon did not vote because of conflict of interest. The following bids were received cashiers check of 5%: BID PRICE BIDDER W/O TRADE with required bid bond or BID PRICE W/TRADE Western States Cat 446 Elliot Ind. Deere 710C $72,813.48 $78,506.59 $69,813.48 $72,006.59 PWD Smart recommended the Council accept the bid from Western States Equipment (without trade of Massey Backhoe). 59 BACKHOE BID - (cont.) PWD Smart said the City has a firm, interested in presenting a sealed bid of $4,000.00, for the Massey, as compared to the $3,000.00 bid, for trade. Councilman England moved to accept the low bid from Western States Equipment of $72,813.48, without trade. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Landor, did not vote, conflict of interest. BACKHOE FINANCING - PWD Smart and City Clerk Conlin stated the backhoe can be financed from the Enterprise Depreciation Fund with no problem. Councilman Wood moved to finance the backhoe from the Enterprise Depreciation Fund over a five year period. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Wood, yes; Landon, did not vote, conflict of interest. DAMAGE CLAIM - Craig Sorenson, 5135 Henry said he rented his home. The home during October, had been winterized by draining the pipes and water heater. Zn January when he rented it, the : renter had the water turned on, the pipes leaked throughout the house. He stated the City of Chubbuck came out after a call from the plumber to replace their main shut-off valve' into the house which had leaked causing the lines to fill with water and damage to occur in the sub zero temperatures felt during the winter. Mr. Sorenson presented a damage claim, with receipts, in the amount of $353.54. Discussion about the damage claim. After discussion, PWD Smart was directed to contact Mr. Sorenson to find out the actual date of winterization. CLAIMS - Computer print-out and hand check claims presented to Mayor Cotant and Council. Councilman Quick moved to approve computer print-out and hand check claims as read. Councilman Wood seconded. All council members voted in favor of motion. At 8:15 p.m., Councilman Landon with full council approval Ron C. Conlin, City Clerk moved, Councilman Wood seconded, to ~adjourn meeting. /'John O. Cotant, Mayor April 22, 1991 Dear Mayor and Council I recommend that we accept the bid from Western States Equipment (without trade of Massey backhoe) in the amount of $72813.48. This bid price includes a 2 cy bucket option specified. We have a firm indication of receiving a sealed bid of $4000 for the Massey compared to $3000 bid for trade. I have also been advised by Western that they have found a machine on a dealer yard in the midwest that meets our bid specs. We could expect to take delivery of that machine with a maximum of 3 weeks. Delivery on a new production machine would be approximately 8 to 12 weeks. Western States has assured me that there would be no difference in the two machines other than the manufacture date/year. I am also gathering information on leases.
