COUNCIL MEETING MINUTES
November 17, 1992
Minutes of a special meeting held at the city municipal building,
November 17, 1992.

Meeting was called to order at 7:30 p.m. by Mayor Cotant.
FIREWORKS PERMIT - Landis Fireworks and Lasers presented an
application to shoot a fireworks display for Kimberly Nursery,
212 E. Chubbuck Road, on November 28, 1992. The show will be
in the field across the street from the nursery, at 9 or 9:15
p.m. and wi]] last approx. 10 to 15 minutes.
Certificate of Insurance is in order.
Councilman England moved to approve a permit to Landis
Fireworks and Lasers, to shoot a fireworks display for
Kimber]y Nursery, 212 E. Chubbuck Road. The fireworks show
will be in the field across the street from the nursery.
Councilman Landon seconded. All council members voted in favor
of motion.
ORDINANCE #386 - An ordinance providing for a change of Land Use
District with respect to certain lands within the boundaries
of the City of Chubbuck, located in the NW 1/4SW 1/4, Section
10, Township 6 South, Range 34 E.B.M., from Agricultural
to General Commercial (C-2); declaring that the city Council
finds that such a change in Land Use District is compatible
with the Land Use Pattern prescribed by the City's
Comprehensive Plan.
Mayor Cotant read Ordinance #386 in full for the first
reading.
Councilman England moved to dispense with the rule of reading
Ordinance #386 on three separate days. Councilman Landon
seconded. Roll Call Vote: Quick, yes; England, yes; Landon,
yes; Wood, yes.
Councilman Wood moved to adopt Ordinance ¢386 as read.
Councilman Quick seconded. Roll Call Vote: Quick, yes;
England, yes; Landon, yes; Wood, yes.

Use Pattern prescribed in the City's Comprehensive Plan.
Mayor Cotant read Ordinance ~387 in full for the first
reading,
Councilman Quick moved to dispense with the rule of reading

CITY
STREET FINANCE REPORT - City Clerk Ron Conlin presented the
199t-92 City Street Finance Report, for certification by Mayor
Cotant, as required by Idaho Code Section 40-137.
Councilman Wood moved to approve the 1991-92 City Street
Finance Report and authorized certification of the same by
Mayor Cotant. Councilman Quick seconded. All council members
voted in favor of motion.
UTILITY RATE DISCUSSION - PWD Smart gave an explanation of
sanitation rate proposals presented to Mayor Cotant and
Council.
Sanitation rates for adopted budget -
Residential - $ 9.79
Monthly container cost - $ 38.64
Monthly cost add. dump - $ 35.1t
Sanitation Rate w/landfill charge - All
Residential - $ 16.84
Monthly container cost - $ 45.70
Monthly cost add. dump - $ 42.17

PWD Smart recommended the increase been put into the weight
basis, somehow. PWD Smart stated 118 commercial customers take
42% of weight, and 31% of the time. Residential customers take
68% of the time, and 57% of the weight.
Ray Coles, 227 Briscoe asked why a residence putting out 1 bag
a week gets charged the same as a residence putting out 5 or
10 bags. PWD Smart stated these are based averages.

PROPOSED UTILITY RATE INCREASES - (cont.)
Hr. Coles stated he is against any kind of increase in
sanitation raises. Mr. Coles felt we should tell EPA we are
not going to pay for mandates passed to us.
George Pieper, 152 Briscoe stated he is not in favor of any
utility rate Increases.
PWD Smart said in the near future Bannock County will most
likely charge by weight of sanitation received.
Councilman Quick suggested we talk to counties up north, and
see if they are going to refuse the mandate.
PWD Smart stated, if the council passes through the landfill
charge only, the Sanitation Fund is still running in the red.
City Clerk Conlin was directed to find out what the City of
Pocatello is charging commercial users.
Mayor Cotant suggested a portion of Jim Phelps salaries be
moved from Sanitation Fund to Highway, Streets and Roads
Department.
Councilman Landon felt we should look at contracting
sanitation pickup out.
Council tabled the utility rate increase until the November
24, 1992 Council Meeting.
At
9:10 p.m., Councilman Landon moved, Councilman England
seconded, with full council approval to adjourn meeting.
