HomeMy WebLinkAbout02 11 1992 CM37 COUNCIL MEETING MINUTES February ll, 1992 Minutes of regular meeting held in the city municipal building, February 11, 1992. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, David A. Landor, W. Dean Wood, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk non C. Conlin. Meeting was called to order at 7:31 p.m. by Mayor Cotant. APPROVAL OF MINUTES Mayor Cotant asked for corrections or additions to regular meeting minutes of January 28th., 1992. Councilman Wood moved to approve regular meeting minutes of January 28th., !992 as read. Councilman Landon seconded, All council members voted in favor of motion. CABLE COMMISSION REPORT - Mary Harker, Cable Commission Chairperson was present to give her final report as Cable Commission Member. Mrs, Harker stated several concerns the cable commission will face this year. Mrs. Harker said cities will be allowed to put a cap on TCI Cable charges if they so choose. Mrs. Harker gave a report on how new technologies in the cable industry will affect cities in the future. REZONE APPLICATION - STAN LEBSACK, 4692 BURLEY DRIVE - An application by Star Lebsack, 4692 Burley Drive for a change in Land Use District, to Industrial (I) Property is presently zoned Limited Residential (R-2). Star Lebsack, 4692 Burley Dr. was not present at the December lOth., 1991, January 14th., 1992 and this Council Meeting. After discussion, Councilman England moved to deny the rezone application by Star Lebsack, 4692 Burley Dr. for a change in Land Use District to Industrial (l). Councilman Landor seconded. All council members voted in favor of motion. ORDINANCE ¢366 - An ordinance adding Chapter 15.32 to the Chubbuck Municipal Code providing for new commercial uses of property to comply with existing ordinances regarding curb, gutter, sidewalk, streets and landscaping; amending Section 18.14.040 to bring it into harmony with Chapter !8.14. I ORDINANCE ¢366 (cont.) 39 Mayor Cotant read Ordinance ¢366 by title only for the four reading, one time in full. Attorney Holmes stated the first sentence in 15.32.010, reads "This chapter shall apply to all property within the City, which is put into use for commercial or industrial purposes after January 1, 1992". Attorney Holmes said the Council might want to change the date to "March 1, 1992". Councilman England moved to adopt Ordinance ~366 as read, with Section 2, 15.32.010 reading "This chapter shall apply to all property within the City of Chubbuck, which is put into use for' commercial or industrial purposes after, March I, 1992". Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Landor, yes; Wood, no. ORDINANCE ~367 - An ordinance adding Section 15.36,060 to the Chubbuck Municipal Code to require mobile home park owners and operators to notify the city building department within five (5) days of a unit moving into that park, Councilman England moved to dispense with the rule reading Ordinance ¢367 on three separate days. Councilman Landor seconded. Roll Call Vote: Quick, yes; England, yes; Councilman Landon moved to adopt Ordinance ~367 as read. Councilman Quick seconded. Roll Call Vote: Quick, yes; England, yes; Landor, yes; Wood, yes. INTERMOUNTAIN COMPOSTING ASSOCIATES PROPOSAL FOR COMPOSTING FOR THE CITY OF CHUBBUCK - Rex Browning and Charles Sudweeks, Intermountain Composting were present to present a proposal for a joint partnership for composting with the City of Chubbuck. Mr. Browning and Mr. Sudweeks said they would like the City Council to keep the proposal in mind. BUSINESS LICENSE APPLICATION - Charles F. Homier, Jr., Huntington, Indiana has applied for license to sell tools at the Days Inn, Chubbuck, Idaho, April 29, S0, May 1st. and May 2nd., 1992. Police Department approved the application for license. Councilman Landon moved to approve a business license to Homier Distributing, Charles F. Homier to sell tools at the Days Inn, April 29, 30, May 1 and May 2, 1992. Councilman Wood seconded. Al! council members voted in favor of motion. 41 SCIENCE ADVISORY' BOARD REVIEW ON THE IDAHO RADZONUCLZDE STUDY - PWD Smart stated the EPA is going to develop a guideline that will meet the criteria. PWD Smart recommended the Council wait until after the March 12th., 1992, meeting before making a decision to lift the ban on the slag order. PROCLAMATION - "CHILD PASSENGER SAFETY AWARENESS WEEK" - Councilman England read the proclamation in full. Councilman England moved to direct Mayor Cotant to proclaim, February 9th. through February 15th., 1992 as "Child passenger safety awareness week" in the City of Chubbuck. Councilman Landor seconded. All council members voted in favor of motion. BID - LAWNMOWER - PWD Smart said we opened bids today on a Jacobsen 72" lawnmower to replace one of the Toro lawn mowers that we have. PWD Smart said the City received one bid of $13,495.00, from Rocky Mountain Turf and Industrial Equipment. PWD Smart recommended the council accept the bid of $13,495.00. Councilman Landon moved to accept the bid of $13,495.00 from Rocky Mountain Turf and Industrial Equipment. Councilman England seconded. All council members voted in favor of motion. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. Councilman Wood moved to approve computer print-out claims as read. Councilman Quick seconded. All council members voted in favor of motion. GENERAL DISCUSSION - 1. Hunter Enterprises Proposals for private sanitation collection. At 9:07 p.m., with full council approval Ron C. Smart DATE: February 11, 1992 RE: Lawnmower bid. The City opened bids today on a Jacobsen 72" lawnmower to replace one of the Toro lawnmowers that we have. The 72" lawnmowers are used in the smaller areas in the smaller parks in the city where maneuverability is important. The mower bid is a Jacobsen with a diesel engine and 4-wheel hydraulic drive. The bid price is $13,495. I recommend that the city council authorize a contract with Rocky Mountain Turf and Industrial Equipment to supply this tractor.
