HomeMy WebLinkAbout11 23 1993 CM 207 COUNCIL MEETING MINUTES November 23, 1993 Minutes of regular meeting held at city municipal building, November 23, 1993. Present: Mayor John O. Cotant, Council members Leroy S. Quick, Steven M. England, W. Dean Wood, Marvin C. Gunter, Attorney Thomas J. Holmes, Public Works Director Steven M. Smart and City Clerk Ron C. Conlin. Meeting was called to order at 7:30 p.m. by Mayor Cotant. INVOCATION was given by Mark Velie, Church of God Prophecy. APPROVAL OF MINUTES Mayor Cotant asked for corrections or additions to regular meeting minutes of November 9, 1993. Councilman Quick moved to approve regular meeting minutes of November 9, 1993 as read. Councilman England seconded. All council members voted in favor of motion. CABLE COMMISSION REPORT - Irene Schlader, Chubbuck Cable Commission Chairwoman was present to report on the following: 1. Effective January 1, 1993 the commission approved the Educational Access Channel - The channel is a cooperative situation, with School District #25 and Idaho State University. 2. Mrs. Schlader was elected Chair of the Cable Commission. 3. Irene Schlader reported on the God Makers II Film. The film was required to be shown. 4. Doyle Detroit from Iowa City, Iowa was hired as the Channel 12 Director. Good experience in Access Channels, also in re-franchising agreements. 5. Report on $5.00 late fee charged by TCI. Lots of complaints. 6. Ray Tolman had to resign as the second Cable Commissioner because of his health. Mrs. Schlader said it is very important the Council appoint a new Chubbuck Cable Commission Member as soon as possible. 7. Mrs. Schlader introduced Doyle Detroit as the new Channel 12 Director. 8. Doyle Detroit said there is a 36 month window to negotiate Franchise Agreements, starting January 1, 1994. PROFESSIONAL SERVICES CONTRACT - SICOG - Todd Hong, SICOG was present to answer any questions regarding the contract. Mr. Hong explained the scope of services provided by SICOG. 209 PROFESSIONAL SERVICES CONTRACT SICOG - (cont.) After discussion, Councilman Wood moved to direct Mayor Cotant to sign the contract with SICOG. Councilman Gunter seconded. All council members voted in favor of motion. DON SAMPLE CITATION/RESTITUTION Fire Chief Cary Campbell presented a report to Mayor Cotant and Council stating Don Sample, 333 Briscoe Road had received an open burning permit and was burning earlier in the day., however, Mr. Sample failed to abide by some of the rules of the permit, the fire got out of control. FC Campbell said he issued Mr. Sample a citation for his negligence for violations of City Code 8.34. FC Campbell provided the documentation for costs of wages, materials and equipment usages used to put out the fire. Total costs come to a total of more than $2,200.00. Don Sample explained what he thought happened. Mr. Sample said he has lived in the City 25 years, has burned before, but, never had a problem. Mr. Sample did not think he should have to pay the costs. Mr. Sample was asked if he had talked to his insurance company about the claim. He said he had not. Mr. Sample was asked to submit the claim to his insurance company and find out what they say. Discussion about the citation issued. Mr. Sample will be sent an invoice with breakdown of costs. AGREEMENT - PARTICULATE MATTER REDUCTION - The Power-Bannock County Particulate Matter Air Quality Improvement Plan of May, 1993 identifies wintertime roadway sanding materials and activities as a significant source of PM10 contamination in our community. The City of Chubbuck agrees to participate in the reduction of airborne PM10 concentration. PWD Smart gave a report on the agreement. After discussion, the Council decided to table the Particulate Matter Reduction Agreement until the December 14, 1993 Council Meeting. ORDINANCE #403 Enacting Chapter 8.36 clean air standards to provide for regulation of emission from solid fuel and refuse burning. Mayor Cotant read Ordinance #403 by title for the first reading. Councilman Quick expressed concern about equal enforcement. 211 ORDINANCE #403 (cont.) FC Campbell stated the purpose of the care of problems during the declared during inversions. ordinance is to take inversions, and only Councilman England moved to dispense with the rule of reading Ordinance #403 on three separate days. Councilman Gunter seconded. Roll Call Vote, Quick, yes; England, yes; Wood, yes; Gunter, yes. Councilman Gunter moved to adopt Ordinance #403 as read. Councilman England seconded. Roll Call Vote, Quick, no; England, yes; Wood, yes; Gunter, yes. Motion passes. SNAKE RIVER SANITATION COMMERCIAL SOLID WASTE PROPOSAL - Jaml Jones, Snake River Sanitation stated Snake River Sanitation will provide front load containers instead of the rear load containers the City is using now. Jami Jones presented the proposal, showing the benefits of the City going with Snake River Sanitation. Jami Jones showed where the City can save approx. S50,000.00 annually on residential and commercial pick up. The commercial pick up showed a savings of approx. $1,700.00 per month, $20,400.00 annually. Jim Evans, Snake River Sanitation said Snake River Sanitation can pick the City of Chubbuck's residential pick up easily in three days. Jami Jones stated residents are responsible for replacing damaged containers. PWD Smart presented two spread sheets, explaining the spread sheet analysis of 1993-94 Fiscal Year Sanitation Budget. PWD Smart explained why the City should be charging $14.55 per residential user. Mayor Cotant stated, since the Siphon Road dumpsters were moved there has been a large increase in the city's pick up. Discussion about workman compensation injuries caused by winter dumpster pick up. Jim Evans stated, Snake River Sanitation does not anticipate much increase in costs for a five year period. Mr. Evans said he would like to have an annual review of the contract, so if there was unforeseen costs, they could be reviewed. Discussion about Sanitation City Employees affected by contracting of sanitation pick up. 213 SNAKE RIVER SANITATION PROPOSAL - (cont.) Discussion about future composting plans. CLAIMS - Computer print-out claims presented to Mayor Cotant and Council. City Clerk Conlin stated the DEQ Drinking Water Assessment Fee check is included in these claims. Councilman England moved to approve computer print-out claims as presented, sub3ect to paying the DEQ Drinking Water Assessment claim under protest. Councilman Wood seconded. All council members voted in favor of motion. At 10:20 p.m., Councilman Wood moved to go into executive session meeting, to discuss personnel matters, as authorized by Idaho Code 67-2345 (b). Councilman Quick seconded. 100% of council members voted in favor of motion. Discussion about salvaging by City of Chubbuck Sanitation Employees. No action or final decision was made. At 10:40 p.m., Councilman England moved to ad3ourn to regular meeting. Councilman Quick seconded. All council members voted in favor of motion. COMMERCIAL SOLID WASTE PROPOSAL - SNAKE RIVER SANITATION - (cont.) Councilman Quick suggested the Council set a date in the Spring for total contracting of residential sanitation pick up, and go with contracting the commercial pick up as soon as Snake River Sanitation can put into place. Jim Evans stated Snake River Sanitation can haul City of Chubbuck's Sanitation in approx, three weeks. Council was inagreement to enter into contract with Snake River Sanitation on the hauling of City of Chubbuck Commercial Sanitation. Jim Evans said he will sent Attorney Holmes a copy of Snake River Sanitation~s standard agreement for review.
