HomeMy WebLinkAbout0252 Land Improvement Standards - Right of Way Widths 1984CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 252 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING CHUBBUCK CITY ORDINANCE NO. 207 BY MODIFYING THE RIGHT-OF-WAY WIDTHS FOR ARTERIAL AND COLLECTOR STREETS AS SET FORTH IN SECTION 2-2 OF SAID ORDINANCE; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS AMENDATORY ORDINANCE AND OF THE ORDINANCE AMENDED; REPEALING THOSE PROVISIONS OF THE ORDINANCE AMENDED WHICH ARE IN CONFLICT WITH THIS AMENDATORY ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: Right-of-Way Widths. Ordinance No. 207 of the City of Chubbuck, Idaho, passed and approved on June 29, 1979, is hereby amended at Section 2-2(A)(1)(b) thereof, by providing for new designations of Major Arterial Streets and Minor Arterial Streets to replace the former designation of Arterial Streets, by providing for right-of-way and asphalt widths for Major Arterial Streets of 80 feet and 61 feet, respectively, by providing for right-of-way and asphalt widths for Minor Arterial Streets of 66 feet and 49 feet, respectively, and by reducing the right-of-way and asphalt widths for Collector Streets to 60 feet and 43 feet, respectively, as follows: Type of Street Right-of-Way Width Asphalt ~mte r-i al- - g43-' .... 6~-'- Major Arterial 80' (major thoroughfare carrying traffic into and out of the City) 61' Minor Arterial 66' (carries high traffic volumes onto and from other arterial, collector and local roads) 49' Collector -66J- 60' (medium density carrier of traffice between neighborhoods and districts of the City) -5+}~- 43' Ordinance - Page 1 jm CH#3-47 SECTION 2: Severability. In the event that any provision of this ordinance is, for any reason, held invalid by a court of competent jurisdiction, such holding shall not affect the remaining provisions of this ordinance, or of the ordinance hereby amended. SECTION 3: Repeal. All provisions of the ordinance hereby amended, or of any other prior ordinance, which are in irreconcilable conflict with the provisions of this ordinance, are hereby repealed to the extent of such conflict. SECTION 4. Effective Date. Adoption of this ordinance having been preceded by numerous public hearings conducted upon due notice, and the public interest requiring that the provisions herein be enacted without further delay, the rule requiring ordinances to be read on three (3) separate occasions is hereby dispensed with, and this amendatory ordinance shall become effective upon its passage, approval and publication as provided by law.
