0282 Annexation 3 Parcels 1986CITY OF CHUBBUCK, IDAHO ORDINANCE NO. #282 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING CLASSIFICATION WHICH SHALL BE APPLIED TO SAID LAND; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTIONS 50-223 AND 63-2215; REPEALING PRIOR CONFLICTING ORDINANCES, AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: SECTION 1: ANNEXATION. The following described lands, located within Bannock County, Idaho, and contiguous to the existing boundaries of the City of Chubbuck, are hereby annexed and included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: A tract of land in Section 3, Township 6 South, Range 34 E.B.M., Bannock County, Idaho, more particularly described as follows: Parcel 1: Commencing at the North Quarter Corner of Section 3, Township 6 South, Range 34 E.B.M. Thence, East along the North line of said Section 3, 1576.25 feet, more or less, to the West boundary of the Union Pacific Railroad Right of Way; Thence, South along said Right of Way 2371.17 feet, more or less Thence West 1005.23 feet, more or less, to an existing irrigation ditch, the Point of Beginning; Thence, continuing West 550 feet, more or less, to the East Right of Way of Yellowstone Highway; Thence, North along said Right of Way line 123.85 feet; Thence, East on a line parallel to the said North line 550 feet; Thence, South 123.85 feet to the Point of Beginning. Thence, East along the North line of said Section 3, 1576.25 feet, more or less, to the West boundary of the Union Pacific Railroad Right of Way; Thence, South along said Right of Way 2480.96 feet, more or less Thence West on a line parallel to the said North line 1005.73 feet, more or less, to an existing irrigation ditch, the Point of Beginning; Thence, continuing West 550 feet, more or less, to the East Right of Way of Yellowstone Highway; Thence, North along said Right of Way line 109.79 feet; Thence, East on a line parallel to the said North line 550 feet, more or less; Thence, South 109.79 feet to the Point of Beginning. Said land containing approximately 1.4 acres. Parcel 3: Commencing at the North Quarter Corner of Section 3, Township 6 South, Range 34 E.B.M. Thence, East along the North line of said Section 3, 1576.25 feet, more or less, to the West boundary of the Union Pacific Railroad Right of Way; Thence, South along said Right of Way 2647.32 feet, more or less Thence West on a line parallel to the said North line 1006.5 feet, more or less, to an existing irrigation ditch, the True Point of Beginning; Thence, continuing West 550 feet, more or less, to the East Right of Way of Yellowstone Highway; Thence, North along said Right of Way line 166.36 feet; Thence, East on a parallel line to the said North line 550 feet more or less; Thence, South 166.36 feet to the Point of Beginning. Said land containing approximately 2.1 acres. SECTION 2: ZONING. The above-described lands newly annexed to the City of Chubbuck, shall be subject to the zoning classification of General Commercial (C-2). Ordinance - Page 2 jm 4W-33 SECTION 3: FILING. The Chubbuck City Clerk is hereby directed to comply with the filing requirements contained in Idaho Code ~ 50-223 and ~ 63-2215. SECTION 4: REPEAL OF PRIOR CONFLICTING ORDINANCES. All provisions of any prior Ordinance which are in irreconcilable conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. SECTION 5: EFFECTIVE DATE. The rule requiring an Ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
