ORDINANCE NO. 294
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDED SECTION
18.08.010 (b) TO PROHIBIT THE ERECTION OF DOUBLE HOUSEHOLD
DWELLINGS (DUPLEXES) IN SINGLE FAMILY RESIDENTIAL (R-l) LAND
USE DISTRICTS, AND THEREBY CLARIFYING INCONSISTENCY WITHIN
TITLE 18; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS AMENDATORY ORDINANCE AND OF THE SECTION OF THE CHUBBUCK
MUNICIPAL CODE AMENDED; REPEALING THOSE PROVISIONS OF TITLE
18 OF THE CHUBBUCK MUNICIPAL CODE WHICH ARE IN CONFLICT WITH
THIS AMENDATORY ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1: Amendment of Section 18.08.010(b) of the Chubbuck
Municipal Code.

Section 18.08.010(b) is hereby amended to read as
(b) Single Family Residential (R-l)--The purpose
of this district is to provide for neighborhoods of
single household dwellings and Class 1 production
~6~ ~9~%%~. Planned unit developments and home
occupations may also be conditionally permitted.
SECTION 2: Severability. In the event that any provision of
this ordinance is, for any reason, held invalid, by any court of
competent jurisdiction, such holding shall not affect the
remaining provisisions of this ordinance or of the Chapter, Title
and Section hereby amended.

SECTION 3: Repeal. Ail provisions of the Chapter, Title and
Section hereby amended and of any prior ordinance which are in
irreconcilable conflict with the provisions of this Ordinance are
hereby repealed to the extent of such conflict.
SECTION 4: Effective Date. Adoption of this ordinance
having been preceded by public hearing conducted upon due notice,
and the public interest requiring that the provisions herein be
enacted without delay, the rule requiring an ordinance to be read
on three (3) separate days, one of which shall be a reading in
full, is hereby dispensed with, and this Amendatory Ordinance
shall become effective upon its passage, approval and publication
as provided by law.
