0298 Accessory Structures 1988CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 298 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 18.12.030(A) OF THE CHUBBUCK MUNICIPAL CODE TO MODIFY RESTRICTIONS ON THE PLACEMENT OF ACCESSORY STRUCTURES, AS THAT TERM IS DEFINED IN CHAPTER 18.04 OF THE MUNICIPAL CODE; MODIFYING SECTION 3.01(B) (1) OF THE UNIFORM BUILDING CODE TO ALLOW ONE-STORY DETACHED ACCESSORY BUILDINGS HAVING A PROJECTED ROOF AREA NOT EXCEEDING 240 SQUARE FEET; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 18 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Amendment of Section 18.12.030(A). Section 18.12.030(A) of the Chubbuck Municipal Code is hereby amended to read as follows: 18.12.030 Supplemental controls for particular uses. A. Accessory structures -- 1. May not be located within 1) the front yard, and 2) the minimum side yard set back area required by Section 18.08.040(B) extended twenty feet to the rear of the principal structure. 2. Shall not be located closer than f~ twenty feet from any ~ ~ ~ ~f~ ~ residential structure on adjoining lands. 3. Consisting of ~~ railroad cars, Ordinance - Page 1 jm 15M-93 ~~ truck trailers or vans, or production buildings formerly used as a dwelling are excluded from all residential and agricultural districts and may only be allowed in industrial and commercial districts upon issuance of a conditional use permit. Section 2. Addition to Section 15.04.030. There is added to Section 15.04.030 of the Chubbuck Municipal Code the following: E. Notwithstanding any of the provisions of the Uniform Building Code, section 3.01(b) (1) of the Uniform Building Code is amended to allow one-story detached accessory buildings to have a projected roof area not exceeding 240 square feet. Section 3. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 18 not herein amended shall remain in full force and effect. Section 4. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 5. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided Ordinance - Page 2 jm 15M-93 by law.
