HomeMy WebLinkAbout0356 Speed Limits 1991CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 356 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION 10.08.050 OF THE CHUBBUCK MUNICIPAL CODE TO CHANGE CERTAIN SPEED LIMITS WITHIN THE CITY; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND PROVISIONS OF CHAPTER 10.08 NOT HEREIN AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Intent. The City has had the North Bannock County Metropolitan Planning Organization (NOBAMPO) conduct studies of the speed limits on certain of some of the major streets within the City. The City desires to adopt certain of NOBAMPO's recommendations, as well as consider input from the staff and the public. Section 2. Amended Section 10.08.050. Section 10.08.052 of the Chubbuck Municipal Code is amended to read as follows: Spe Limit ~ 10.08. 050 ed s. Thirty-five (35) miles per hour or such other limit as the Idaho Department of Transportation or its successor may establish, upon any thoroughfare within the city which is part of the highway system maintained Ordinance - Page 1 dsc chbbck05.146 by the Idaho Department of Transportation or its successor agency; 2. Thirty-five (35) miles per hour on Poleline Road as it extends from the intersection with Yellowstone Avenue to the southerly boundary of the city; 3. Thirty (30) miles per hour on thoroughfares which are designated as "arterial thoroughfares" except for the following limits: Speed Location Limit Hiline Rd. from Chubbuck Rd. north to city limits 35 Hiline Rd. from Chubbuck Rd. south to city limits 35 "Arterial thoroughfares" are East and West Chubbuck Road, Hawthorne Road, Hiline Road and S¥~phon Road. 4. Twenty miles per hour on all thoroughfares not otherwise classified in this section. B. The chief of police is authorized to post or cause to be posted, the speed limits set forth in this section upon thoroughfares within the city, consistent with the standards for traffic-control devices prescribed by the Idaho Code. C. It is unlawful and punishable as an infraction for any person to operate a vehicle upon any public thoroughfare, including any street, highway, vehicular way or other thoroughfare, at a speed greater than is reasonable and prudent under the conditions having regard to the actual and potential hazards then existing. In every event, speed shall be so controlled as may be necessary to avoid colliding with any person, vehicle or other conveyance on or entering the thoroughfare in compliance with legal requirements and the duty of all persons to use due care. Where no special hazard exists that requires lower speed for the purpose of compliance with this subsection, the speed of any vehicle not in excess of the limits specified in subsection A shall be lawful, but any speed in excess of such limits shall be prima facie evidence that the speed is not reasonable or prudent and that it is unlawful. Ordinance - Page 2 dsc chbbck05.146 ADMINISTRATIVE PROVISIONS Section 1. ReDeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other sections and provisions of Chapter 10.08 not herein amended shall remain in full force and effect. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
