CITY OF CHUBBUCK, IDAHO
ORDINANCE NO. 37Q
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING
CERTAIN LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND
JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO;
SPECIFYING THE ZONING CLASSIFICATION WHICH SHALL BE APPLIED
TO SAID LANDS NEWLY ANNEXED TO THE CITY OF CHUBBUCK;
DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING
REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-2215;
REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE
SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Annexation. The following described lands,
located within Bannock County and contiguous to the existing
boundaries of the City of Chubbuck, Idaho are hereby annexed and
included within the boundaries and jurisdictional limits of the
City of Chubbuck, Idaho:
Roy Lacey's Espie Subdivision on Hawthorne
Road, as described on the attached Exhibit
"a".
Section 2. Zoning. The above-described lands newly annexed
to the City of Chubbuck, Idaho, shall be subject to the zoning
classification of R-i, Single Family Residential, except for
proposed Lot 1, Block 1 and Lot 1, Block 2 being approximately
the easterly 121 feet of the annexed area, which shall be zoned
R-2, Limited Residential.
Section 3. Filing. The Chubbuck City Clerk is hereby
directed to comply with the filing requirements contained in
Idaho Code Section 63-2215.

Section 4. Conditions. Annexation is conditioned upon the
developer doing the following:
a. Cash in lieu of park land dedication fee of
$181.76 per lot.
b. Minimum of 1100 square foot single level home and
if a two story home, minimum of 900 square foot on ground level
and 1500 square foot total.
c. Net wire fence required on all three sides of the
subdivision which are not currently fenced at this time.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflictinq Ordinances. The
provisions of any Ordinance of the City of Chubbuck, Idaho, and
any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict.
Section 2. Severability. If any provision of this
ordinance is held invalid, for any reason, by any court of
competent jurisdiction, such holding shall not affect the
validity or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be a
reading in full, is hereby dispensed with, and this Ordinance
shall become effective upon its passage, approval and publication
as provided by law.

DESCRIPTION FOR ROY LACEY
(Area to be annexed into the City of Chubbuck)
A tract of land laying west of Hawthorne Road and north of
Delmar Acres, a portion of the south half of the northeast
quarter of the northeast quarter of Section 4, Township 6
South, Range 34 East, Boise Meridian, being all of the land'
described in instruments 647000 and 662263 of the records of
Bannock County, Idaho, described as follows:
The south half of the northeast quarter of the northeast
quarter of Section 4, Township 6 south, Range 34 East, Boise
Meridian.
EXCEPTING THEREFROM the following described tract of land:
Commencing at the northeast corner of Section 4, Township 6
South, Range 34 East, Boise Meridian; thence
South 01°03' East along the east line of Section 4 for a
distance of 899.34 feet to the south east corner of the land
described in instrument 647000 of the records of Bannock
County, THE TRUE POINT OF BEGINNING; thence
South 89o54' West along the south boundary of the land
described in instrument 647000 for a distance of 326.30
feet; thence
South 01o03' East along the east boundary of the land
described in instrument 662263 for a distance of 406.03 feet
to an intersection with the north boundary of Delmar Acres,
a subdivision recorded in the records of Bannock County as'
instrument 450164; thence
North 89o50, East along the said north boundary for a
distance of 326.30 feet to an intersection with the east
line of Section 4; thence
North 01o03' West along the east line of Section 4 for a
distance of 405.65 feet to the point of beginning.
