ORDINANCE NO. 385
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR
CHANGES IN THE LAND USE PATTERN PRESCRIBED IN THE CITY'S
COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1. After full public hearings on January 8, 1985
and on February 12, 1985, the Chubbuck City Council adopted
Ordinance No. 263 changing the Land Use District for the property
described on the attached Exhibit "A", however, the Comprehensive
Plan change was inadvertently overlooked.
SECTION 2. Change of Comprehensive Plan. Following full
public hearings, the Mayor and Council find, and therefore
declare, that the land use pattern prescribed by the City's
Comprehensive Plan for property described on Exhibit "A", should
be, and hereby is, changed from Industrial (I) to Limited
Residential (R-2) (the 1985 hearings used the term General
Residential (R-2), which is now designated under the Land Use
statutes as Limited Residential (R-2)).
SECTION 3. Effective Date. Full, public hearings having
been conducted in this matter, the rule requiring an ordinance to
be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as
provided by law.
PASSED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK,
IDAHO, this 17th. day of NOVEMBER , 1992.

EXHIBIT "A"
A parcel of land located in the E 1/2 NE 1/4 Section 3, T.6S.,
R.34 E., B.M.; Beginning at the NW corner of section 3;
Thence, South along the East line of said Section 3 to the
East quarter corner of Section 3; Thence West along the
latitudinal centerline of said Section 3 to the easterly
right-of-way for the Union Pacific Rail Road; Thence
northerly along the easterly right-of-way of the railroad
2612 feet; Thence South 890 38' 19" East a distance of 600.0
feet; Thence North 10 14' 09" West a distance of 605.80 feet
to the North line of said Section 3; Thence East along the
North line of Section 3, to the Point of Beginning.
EXCEPTING THEREFROM the following parcel: Beginning at the
East 1/4 corner of said Section 3, thence North along the East
line of NE 1/4 of said section a distance of 332.0 feet to the
Point of Beginning of this exception; Thence at right angles
West 225.0 feet; Thence at right angles North 347.0 feet;
Thence at right angles East 225.0 feet to the East Section
line of Section 3; Thence South along the Section line 347.0
feet to the Point of Beginning.
