ORDINANCE NO. 387
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR
CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS
WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK LOCATED IN THE
NW4SW4, SECTION 10, TOWNSHIP 6 SOUTH, RANGE 34 E.B.M., FROM
AGRICULTURAL (A) TO GENERAL COMMERCIAL (C-2); DECLARING THAT
THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE DISTRICT
IS COMPATIBLE WITH THE LAND USE PATTERN PRESCRIBED BY THE
CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
SECTION 1. Change of Land Use District. Pursuant to Public
Hearing and Council approval on June 25, 1985, the land use
district established by the Chubbuck Land Use Ordinance, with
respect to the lands described on the attached Exhibit "A",
located within the boundaries of the City of Chubbuck, is hereby
changed from Agricultural (A) to General Commercial (C-2):
SECTION 2. Comprehensive Plan. The Mayor and Council find,
and therefore declare, that the foregoing changes in the Land Use
Districts established in Title 18, Chubbuck Code, are consistent
with the land use pattern prescribed by the City's Comprehensive
Plan for the above-described property.
SECTION 3. Effective Date. Full, public hearings having
been conducted in this matter, the rule requiring an ordinance to
be read on three separate days, one of which shall be a reading
in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as
provided by law.

Pine Ridge Mall, 1st Addition, described as:
A parcel of land located in the SW'h of Section 10,
Township 6 South, Range 34 E.B.M., more particularly
described as follows:
Beginning at the S 1/16 corner on the West line of
Section 10, a found railroad spike (Instrument No.
752838); thence North 89033159" East along the South
1/16 line of said Section 10, 25.08 feet to the East
right-of-way of Hawthorne Road a point marked by a
Bannock County monument, the True Point of Beginning;
Thence N 000 4115611 West along said right-of-way 50.00
feet; Thence N 890 3315911 E 916.54 feet to a 3/4" steel
rod L.S. 5074 set on this survey; Thence N 00024142" W
1109.24 feet to a point on the South right-of-way line
of Highway I-86 marked by a 3/411 steel rod L.S. 5074
set on this survey; thence S 8904512311 E (Record S 890
1911611 E) along said right-of-way 373.92 feet to a
found highway right-of-way monument; thence continuing
along said right-of-way S 720 0213711 E (Record S 800
3211111 E) 2.73 feet to a found 3/411 Steel Rod L.S. 2002
marking the intersection of the South right-of-way of
I-86 and the West boundary of Pine Ridge Mall
Subdivision Instrument No. 657825; Thence S 0002414211 E
(Record S 000 2314711 E) along West boundary of Pine
Ridge Mall Subdivision 1153.95 feet to a found 3/411
Steel Rod L.S. 2002, the SW 1/16 corner of said Section
10; thence S 8903315911 W along the South 1/16 line of
Section 10, 1292.77 feet to the True Point of
Beginning.
