HomeMy WebLinkAbout0392 Change in Land Use 19932 19 1 :1. a� 2 8 CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 392 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING FOR CHANGES IN THE LAND USE PATTERN PRESCRIBED IN THE CITY'S COMPREHENSIVE PLAN, WITH RESPECT TO CERTAIN LANDS WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK, LYING EAST OF INTERSTATE 15, LOCATED IN THE NE 4, SECTION 11, TOWNSHIP 6 SOUTH, RANGE 34 E.B.M., FROM SINGLE FAMILY RESIDENTIAL (R-1) TO GENERAL COMMERCIAL (C-2); PROVIDING FOR CHANGE OF LAND USE DISTRICT WITH RESPECT TO CERTAIN LANDS WITHIN THE BOUNDARIES OF THE CITY OF CHUBBUCK LOCATED IN THE N� NW4 NW4, SECTION 10, TOWNSHIP 6 SOUTH, RANGE 34 E.B.M., FROM Agriculture (A) TO Limited Residential (R-2); PROVIDING FOR CHANGES IN THE LAND USE PATTERN PRESCRIBED IN THE CITY'S COMPREHENSIVE PLAN; DECLARING THAT THE CITY COUNCIL FINDS THAT SUCH CHANGE IN LAND USE DISTRICT IS COMPATIBLE WITH THE ALTERATIONS MADE IN THE LAND USE PATTERN PRESCRIBED BY THE CITY'S COMPREHENSIVE PLAN; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Tract 1 (Hancock) SECTION 1. Property. Property affected by change of Comprehensive Plan. All of the NE4 of Section 11, Township 6 South Range 34 E.B.M. lying East of Interstate 15. SECTION 2. Change of Comprehensive Plan. Following full public hearings, the Mayor and Council find, and therefore declare, that the land use pattern prescribed by the Citv's Comprehensive Plan for the above-described property, should be, and hereby is, changed from Single Family Residential (R-1) to General Commercial (C-2). Tract 2 (Osier) SECTION 3. Change of Land Use District. The land use district established by the Chubbuck Land Use Ordinance, with respect to the lands described below, located within the boundaries of the City of Chubbuck, is hereby changed from agriculture (A) to Limited Residential (R-2): See Exhibit "A" for Legal Description ORDINANCE - Page 1 dsc chbbck12.091 -- ` 2151 �. C 2 8 SECTION 4. Change of Comprehensive Plan. Following full public hearings, the Mayor and Council find, and therefore declare, that the land use pattern prescribed by the City's Comprehensive Plan for the property described on Exhibit "A", should be, and hereby is, changed from General Commercial (C-2) to Limited Residential (R-2). SECTION 5. Compliance with Comprehensive Plan. The Mayor and Council find, and therefore declare, that the foregoing changes in Land Use District are consistent with the foregoing modifications to the land use pattern prescribed by the City's Comprehensive Plan. SECTION 6. Effective Date. Full, public hearings having been conducted in this matter, the rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law. SECTION 7. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions.
