ORDINANCE NO. #400
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADOPTING
CHAPTER 15.44, BANNOCK COUNTY RESIDENTIAL ENERGY CODE;
REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE
SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND
PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Chapter 15.44. The following Chapter 15.44 is
being added to the Chubbuck Municipal Code:

BANNOCK COUNTY RESIDENTIAL ENERGY CODE
Sections:
15.44.010 Purpose of provisiions.
15.44.020 Adoption and procedure for adopting future
changes.
15.44.030 Filing.
15.44.010 Purpose of provisions. The purpose of this
chapter is to adopt the uniform residential energy code developed
for Bannock County to provide for the conservation of energy and
efficient production of residential units.
15.44.020 Adoption and procedure for adopting future
changes. The Bannock County Residential Energy Code, July, 1993,
promulgated by an ad hoc committee of representatives from
certain organizations and governmental entities in the county is
adopted effective October 1, 1993, and incorporated as an
ordinance of this city in its current form and as it may
hereafter be amended, as though set forth at length in this
chapter. Future editions or changes to the Bannock County
Residential Energy Code may be adopted, as the same are published
from time to time, by resolution of the mayor and council of the

pursuant to this chapter. Unless specifically stated to the
contrary in the text thereof, such resolution shall have the
effect of adopting the future edition or changes and any
appendices or standards previously adopted by ordinance.

15.44.030 Filing. Three copies of the Bannock County
Residential Energy Code, together with all amendments thereto,
shall be kept on file in the clerk's office for use and
examination by the public.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The
provisions of any Ordinance of the City of Chubbuck, Idaho, and
any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict.
Section 2. Severability. If any provision of this
ordinance is held invalid, for any reason, by any court of
competent jurisdiction, such holding shall not affect the
validity or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be a
reading in full, is hereby dispensed with, and this Ordinance
shall become effective upon its passage, approval and publication
as provided by law.
