ORDINANCE NO. 320
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, PROVIDING A
CONDITIONAL USE PERMIT IS ISSUED TO AN APPLICANT; CORRECTING
TECHNICAL DRAFTING ERRORS; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS
OF THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND
PROVISIONS OF CHAPTER 18.28 NOT HEREIN AMENDED SHALL REMAIN
IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE
SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1.
amended to read:
Section 18.28.040 (A) of the Chubbuck Code is
18.28.040 Conditional use permits. A. Duration,
assignability and review. A conditional use permit is
issued to the.Applicant authorizing applicant to use the
property for the use specified in the permit and subject to
any conditions imposed upon the use. Unless otherwise
specified by the land use development commission when
granting, renewing or modifying a conditional use permit,
such permit shall be nonassignable and nontransferable and
shall expire in three years if the applicant fails to
implement the use for which such permit is sought. A
conditional use permit shall expire upon the violation of
any conditions imposed ~-~he-e~y-e~e~Z~-by the Land
Use Development Commission upon the approval of a
conditional use permit. The commission may, as a condition
imposed upon a conditional use permit granted hereunder,
require that the applicant report to the commission on a
subsequent date or dates as to the implementation of the use
for which the permit is sought and as to the applicant's
compliance or noncompliance with conditions imposed by the
commission.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The
provisions of any Ordinance of the City of Chubbuck, Idaho, and
any provision of the Chubbuck Municipal Code which are in

conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict. All other sections and
provisions of Chapter 18.28 not herein amended shall remain in
full force and effect.
Section 2. Severability. If any provision of this
ordinance is held invalid, for any reason, by any court of
competent jurisdiction, such holding shall not affect the
validity or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be a
reading in full, is hereby dispensed with, and this Ordinance
shall become effective upon its passage, approval and publication
as provided by law.
