ORDINANCE NO. 322
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
CHUBBUCK CODE SECTION 9.20.090, AS AMENDED BY ORDINANCES NO.
307 AND NO. 314 TO CLARIFY THAT LIVESTOCK MUST STILL COMPLY
WITH THE PROVISIONS OF THE LAND USE ORDINANCE; REPEALING
PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY
OF THE PROVISIONS OF THIS ORDINANCE; PROVIDING THAT ALL
OTHER SECTIONS AND PROVISIONS OF CHAPTER 9.20 NOT HEREIN
AMENDED SHALL REMAIN IN FULL FORCE AND EFFECT; AND PROVIDING
WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Purpose. The purpose of this Ordinance is to
clarify Ordinance 307 and 314 with respect to livestock, to
specifically provide that livestock in platted areas must still
comply with the Land Use provisions of Chapter 18 of the Chubbuck
Code. Specifically Sections l(b) and l(e) of Ordinance 307 are
clarified to provide livestock can be kept in platted lots and in
residential areas only if the provisions of 18.08.040 (A)
pertaining to livestock are also followed.
Section 2. This shall be added to Chapter 9.20.090 of the
Chubbuck Municipal Code the following subparagraph H:
H. Ail zoning provisions of the Chapter 18 in general and
18.08.040 in particular shall be followed. Any Conditional
Use Permits, if required, shall be acquired prior to the
placement of livestock in any area.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The
provisions of any Ordinance of the City of Chubbuck, Idaho, and
any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby

repealed to the extent of such conflict. Ail other sections and
provisions of Chapter 9.20 not herein amended shall remain in
full force and effect.
Section 2. Severability. If any provision of this
ordinance is held invalid, for any reason, by any court of
competent jurisdiction, such holding shall not affect the
validity or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be
reading in full, is hereby dispensed with, and this Ordinance
shall become effective upon its passage, approval and publication
as provided by law.
