0331 Annexation - Bringhurst Subdivision 1990 ! 3000402 CITY OF CHUBBUCK, IDAHO ORDINkNCP. NO. 331 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING CLASSIFICATION WHICH SHALL BE APPLIED TO SAID LANDS NEWLY ANNEXED TO THE CITY OF CHUBBUCK; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-2215; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Annexation. The following described lands, located within Bannock County and contiguous to the existing boundaries of the City of Chubbuck, Idaho are hereby annexed and included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: See Exhibit "A", said tract to also be known as Bringhurst Subdivision, a subdivision of Bannock Coutny, Idaho according to the plat thereof on file with the Bannock County Recorder. Section 2. Zoning. The above-described lands newly annexed to the City of Chubbuck, Idaho, shall be subject to the zoning classification of R-2, Limited Residential. Section 3. Clerk. The Chubbuck City Clerk is hereby directed to comply with the filing requirements contained in Idaho Code Section 63-2215. ANNEXATION AND ZONING - Page 1 dsc chbbck03.127 EXHIBIT "A" 90004023 A tract of land in the west one half of Section 34, Township 5 South, Range 34 East, Boise Meridian, described as follows: Commencing at the south 1/4 corner for section 34, Township 5 South, Range 34 East, Boise Meridian; thence north 00°04'50'' east along the meridional centerline of Section 34 for a distance of 2629.11 feet to the northeast corner of Paradise Acres, a subdivision recorded in the records of Bannock.County as instrument 538355; thence north 89°36'50'' west along the north line of Paradise Acres for a distance of 510.90 feet to the northeast corner of lot 25, block 13 of said Paradise Acres; thence north 00°12'29'' east on an extension of the west right of way line of Eden Street for a distance of 50.00 feet; thence south 89°36'50'' east for a distance of 50.00 feet; thence north 00°12'29'' east for a distance of 374.00 feet; thence south 89°36'50'' east for a distance of 459.96 feet to an intersection with the meridional centerline of Section 34; thence south 00°04'50" west for a distance of 410.40 feet to the center 1/4 corner of Section 34; thence continuing south 00'04'50" west for a distance of 13.61 feet to the point of beginning. EXHIBIT "A" - Page 1 dsc chbbck03.131 ADMINISTRATIVE PROVISIONS 90004023 Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
