AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ADDING CHAPTER
10.20, "RESIDENT ONLY PARKING PERMIT AREAS" TO THE CHUBBUCK
MUNICIPAL CODE; DESIGNATING PORTIONS OF VICTOR AVENUE, TETON
STREET AND BONANZA AVENUE AS PERMIT ONLY PARKING AREAS FROM
APRIL 15 TO OCTOBER 31; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE
PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Adoption of Chapter 10.20. The following
Chapter 10.20, "Resident Only Parking Permit Areas", shall be
added to the Chubbuck Municipal Code:
RESIDENT ONLY PARKING PERMIT AREAS

10.20.010 Intent. Certain areas of the city have been
heavily impacted by non-resident visitors using city services
such as parks. To alleviate ongoing parking problems, the City
has determined it needs to designate certain portions of streets
as areas in which only resident may park. To allow for
regulation of such parking, permits need to be issued to the
residents in those areas.
10.20.020 Desianation of resident -only parking areas. The
following shall be designated as resident -only parking areas:
A. The north side of Victor Avenue lying between Teton
Street and Tahoe Place.
B. The east side of Teton Street lying between Victor
Avenue and Bonanza Avenue.

C. The northerly and southerly side of Bonanza Avenue
lying between Teton Street and Hawthorne Road.
D. The northerly and southerly side of West Bonanza Avenue
bounded on the west by Tahoe Place and on the east by Cotant
Park.
Notification of this designation and the procedures for
obtaining permits shall be mailed by the Chief of Police or the
Chief's designee to each residence and/or property owner along
the streets so designated. Parking in such areas from April 15
to October 31 shall be allowed only for vehicles displaying
either a resident's decal or card or a visitor's permit card.
The City shall post signs on the above designated streets
indicating parking is by permit only, said signs to be in a form
designated and approved by the City's Public Works Director.
10.20.030 Issuance of Permits.
A. Parking permits in the form of decals or cards, which
shall be prominently displayed in any vehicle authorized to park
in a resident only parking area, shall be issued by the Chief of
Police or the Chief's designee. Each such permit shall state
thereon the particular permit area as well as the license number
of the motor vehicle for which it is issued. No more than one
decal or card shall be issued for each motor vehicle included on
the application.
B. One decal or card may be issued for each vehicle
currently registered to an applicant residing in the permit area
upon completion by the applicant of a form available from the
Chief of Police and presentation of proof of identification,
address, and current vehicle registration and license plate
number, which information shall be entered on the form. Owners
of residential rental property who reside outside the area may
receive one such permit upon presentation of proof of ownership
of the property in addition to the requirements listed above.
C. Issuance of a permit shall not guarantee or reserve to
the holder thereof an on -street parking space within the
designated residential permit parking area.
10.20.040 Visitor permits. The Chief of Police or the
Chief's designee shall issue two visitor permit cards for each
residence in the areas for the occupant of that residence to give
to visitors for temporary display in vehicles parked on the
streets. Residents who are planning events which require
additional temporary permits may request them from the City and
must return any such additional permits to the City no later than
three days after the event. Failure to return extra permit cards
will result in revocation of resident parking privileges and the

Chief is hereby authorized to so revoke the permit and notify the
resident of the revocation.
10.20.050 Permit only designated parking without permit
prohibited. Parking in an area designated as a resident only
parking permit area is prohibited unless the vehicle displays a
resident's decal or permit card, or a visitor's permit card
prominently displayed so as to be readily visible from the
sidewalk or street. Any vehicle parked in a resident -only
parking area without the display of either a resident' decal or
card or a visitor's permit card shall be in violation of this
ordinance and a parking violation notice shall be issued to the
owner of such vehicle unlawfully parked.
10.20.060 Duration of Permit. Each parking permit shall be
valid for the calendar year of the date of issuance, including
visitor permits. Permits are not transferable, but may be
renewed annually upon reapplication to the Chief of Police. New
visitor's cards, distinguishable from the previous year by color,
shall be issued annually.
10.20.070 Unlawful use of decals or permits.
A. It shall be unlawful and a violation of this chapter
for a person to falsely represent himself as eligible for a
parking permit or to furnish false information in an application
therefor.
B. It shall be unlawful and a violation of this chapter
for a person holding a valid parking permit issued pursuant
hereto to permit the use or display of such permit on a motor
vehicle other than that for which the permit is issued or
intended. Such conduct shall constitute an unlawful act and
violation of this chapter both by the person holding the valid
parking permit and the person who so uses or displays the permit
on a motor vehicle other than that for which it is issued. Said
violation shall result in revocation of the resident's permit for
the balance of the year and the Chief of Police shall so notify
the resident.
C. Any person aggrieved by such a determination made by
the Chief of Police has the right to appeal to the City Council
within ten days of such determination.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The
provisions of any Ordinance of the City of Chubbuck, Idaho, and
any provision of the Chubbuck Municipal Code which are in
conflict with the provisions of this Ordinance are hereby
repealed to the extent of such conflict.
Section 2. Severability. If any provision of this
ordinance is held invalid, for any reason, by any court of
competent jurisdiction, such holding shall not affect the
validity or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance
to be read on three separate days, one of which shall be a
reading in full, is hereby dispensed with, and this Ordinance
shall become effective upon its passage, approval and publication
as provided by law.

NOTICE
The Code allows for on -street parking privileges, .April 15
to October 15. Resident -Only Parking Areas, for vehicles displaying
a residents's permit decal or a visitor's permit card. The permit
is valid for one year from date of issuance. Application for a
renewal must be made annually. The decals are not transferable from
vehicle to vehicle or owner to owner.
THE COLOR OF THE STICKER WILL DESIGNATE THE YEAR OF VALIDATION. THE
STICKER IS TO BE DISPLAYED ON THE DRIVER'S SIDE OF THE REAR WINDOW.

SUMMARY OF ORDINANCE 410
An Ordinance of the City of Chubbuck, Idaho, adding Chapter 10.20, "Resident
only parking permit areas" to the Chubbuck Municipal Code; designating resident only
parking areas on the north side of Victor Avenue lying between Teton Street and Tahoe
Place, the east side of Teton Street, lying between Victor Avenue and Bonanza Avenue,
the northerly and southerly side of Bonanza Avenue lying between Teton Street and
Hawthorne Road and the northerly and southerly side of West Bonanza Avenue
bounded on the west by Tahoe Place and on the east by Cotant Park; providing that only
residents may park in these areas between April 15 and October 31 of each year;
providing for a manner by which residents may obtain a resident parking permit to be
prominently displayed in the vehicle to show that they are authorized to park there;
providing for visitor permit cards to be issued to residence in the area; providing a
procedure for issuance of permits to residents and visitor permits; prohibiting parking in
said designated areas without a permit; providing that parking permits are valid for the
calendar year of issuance; making it unlawful to falsely represent oneself as a resident to
obtain a parking permit, unlawful to furnish false information and application for a
resident only parking permit; providing for a procedure for revocation of a resident
parking permit; providing for the repeal of prior conflicting ordinances, providing for the
severability of this ordinance in the event any of its provisions are found to be invalid.
