0424 Vacating a Portion of the Plat - Johannsen's Bluff 1994CITY OF CHUBBUCK, IDAHO ORDINANCE NO. 424 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, VACATING A PORTION OF THE PLAT FOR JOHANNSEN'S BLUFF; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCES SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Vacation. The property described on the attached Exhibit "A" which includes two reserve strips and a portion of a platted street are hereby vacated. ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinances. The provisions of any ordinance of the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law. ALSO: A portion of the right of way of Johannsen Place, described as follows: BEGINNING at the northwest corner of Lot 14 Block 1 Johnnsen's Place, a subdivision recorded in the records of Bannock County as instrument 753317; thence South 01000149" East along the east right of way line of Johannsen Place for a distance of 100.00 feet to a point of curvature; thence Southeasterly following a 20.00 radius curve, concave to the northeast, through a central angle of 90000'0011, for an arc distance of 31.42 feet to a point of tangency with the north right of way line of Krista Court; thence South 88059111" West for a distance of 70.00 feet to an intersection with the west right of way line of Johannsen Place; thence North 01000149" East along the west right of way line of Johannsen Place for a distance of 120.00 feet to an intersection with the north boundary of Johannsen's Bluff; thence North 88059111" East for a distance of 50.00 feet to the point of beginning.
