HomeMy WebLinkAbout0448 Restricted Parking on Alpine Ave 1995a CITY OF CHUBBUCK, IDAHO ORDINANCE #448 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ENACTING SECTION 10.04.100 OF THE CHUBBUCK MUNICIPAL CODE DESIGNATING ALPINE AVENUE AS A MINOR ARTERIAL AND PROHIBITING PARKING ON CERTAIN PORTIONS OF ALPINE AVENUE LOCATED IN THE KASISKA SUBDIVISION AND PROVIDING PARKING MAY BE RESTRICTED IN THE FUTURE ON PORTIONS OF COUNTRY ACRES SUBDIVISION; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Intent. The 1995 Comprehensive Plan adopted by the City of Chubbuck sets forth a system of major and minor arterial and collector streets which will aid in dispersing the flow of traffic as the city develops. In reviewing the Comprehensive Plan and the development of the Kasiska Subdivision, Alpine Avenue appears to be the only street that can be designated as a minor arterial in the future that will connect Hawthorne Road with Philben Road other than the major arterial of West Chubbuck Road and Quinn Road. In order for Alpine Avenue to be successfully utilized as a minor arterial, on street parking must be prohibited. Accordingly, the City Council deems it in the best interest of the City of Chubbuck and its inhabitants to so designate Alpine Avenue and prohibit parking on Alpine Ave. Section 2. New Section 10.04.100. The following Section 10.04.100 is added to the Chubbuck Municipal code: 10.04.100 Alpine Avenue. Alpine Avenue is designated as a minor arterial street in conformity with the Comprehensive Plan adopted by the City. Parking is prohibited on sections of Alpine Avenue that border the following described property: Kasiska Subdivision Lots 1,2,3,4,5,6,7, and 8, Block 4 Lot 10, Block 1 Lot 6,7,8,9, and 10, Block 3 Lot 7, Block 5 Ordinance - Page 1 dscchubck10.095 0 Parking will be restricted on the following property at such time in the future as the City Council deems traffic heavy enough to warrant no parking on Alpine Avenue where it borders the following described property: Country Acres Subdivision Lots 1 and 2, Block 1 Lot 1, Block 2 ADMINISTRATIVE PROVISIONS Section 1. Repeal of Conflicting Ordinance. The provisions of any Ordinance of the City of Chubbuck, Idaho and any provision of the Chubbuck Municipal Code which are in conflict with the provisions of this Ordinance are hereby repealed to the extent of such conflict. Section 2. Severability. If any provision of this ordinance is held invalid, for any reason, by any court of competent Jurisdiction, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 3. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
