HomeMy WebLinkAbout0456 Annexation Diamond Court 1996NO 96008493 • • RECORDED AT REQUEST OF CHUB UCK MAY 23 Pfd 2 30 iFFI(II;sL R,1-: _ ;i 300K NO 667 BANNOCK COUNTY IDAHO CITY OF CHUBBUCK, IDAHO LARRY IV CHAN RECORDER FEE 3.00 DEPUTY OW ORDINANCE NO. 456 AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, ANNEXING CERTAIN LANDS TO BE INCLUDED WITHIN THE BOUNDARIES AND JURISDICTIONAL LIMITS OF THE CITY OF CHUBBUCK, IDAHO; SPECIFYING THE ZONING CLASSIFICATION WHICH SHALL BE APPLIED TO SAID LANDS NEWLY ANNEXED TO THE CITY OF CHUBBUCK; DIRECTING THE CHUBBUCK CITY CLERK TO COMPLY WITH THE FILING REQUIREMENTS CONTAINED IN IDAHO CODE SECTION 63-2215; REPEALING PRIOR CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS ORDINANCE SHALL ° BECOME EFFECTIVE. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF CHUBBUCK, IDAHO: Section 1. Annexation. The following described lands, located within Bannock County and contiguous to the existing boundaries of the City of Chubbuck, Idaho are hereby annexed and included within the boundaries and jurisdictional limits of the City of Chubbuck, Idaho: Subdivision Name: Diamond Court Subdivision. Legal Description: See Exhibit "A." Section 2. Zoning. The above-described lands newly annexed to the City of Chubbuck, Idaho, will be part of Diamond Court Subdivision and, upon approval of the final plat, shall be subject to the following zoning classifications General Commercial (C- 2) for Lots 1, 2 and 3 of Block 4 and Dense Residential (R-4) for Lots 1 through 13 of Block 2 of Diamond Court Subdivision. ANNEXATION AND ZONING - Page 1 chbbck04.101 3 Z ;J6008493 Section 3. Filing. The Chubbuck City Clerk is directed to comply with the filing requirements contained in Idaho Code Section 63-2215. Section 4. Conflicting Ordinances. Any conflicting ordinances or sections of the Municipal Code which are in conflict with this Ordinance are hereby repealed to the extent of such conflict. Section 5. Severability. If any provision of this ordinance is held invalid, such holding shall not affect the validity or enforceability of any of the remaining provisions. Section 6. Effective Date. The rule requiring an ordinance to be read on three separate days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall become effective upon its passage, approval and publication as provided by law.
