ORDINANCE NO. 459
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING
CHAPTER 15.24, SIGN REGULATIONS, TO PROVIDE FOR THE
REGULATION OF PERMANENT SIGNS COMMONLY KNOWN AS
BILLBOARDS, DEFINING BILLBOARDS AND PROHIBITING FURTHER
BILLBOARDS WITHIN THE CITY OF CHUBBUCK EXCEPT FOR THOSE
ASSOCIATED WITH A BUSINESS ADJACENT TO OR NEAR THE
BILLBOARD; REPEALING PRIOR CONFLICTING ORDINANCES;
PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF THIS
ORDINANCE; PROVIDING T HAT ALL OTHER SECTIONS AND
PROVISIONS OF CHAPTER 15 NOT HEREIN AMENDED SHALL REMAIN
IN FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Section 15.24.030. The following Section 15.24.030 is added to the
Chubbuck Municipal Code:
15.24.030 Regulation of Billboards.
A. A billboard is defined as a sign that is an outdoor advertising sign which
advertise goods, products or services that are not sold on the premises upon which the
sign is located and which sign mounted upon a pole or structure in such a manner that it
is directed to vehicular or pedestrian traffic. This definition shall not include any sign
that is placed by or at the direction of any political subdivision of the State of Idaho or
the United States Government. It shall not include any temporary sign defined in
Chapter 15. 24 of the Chubbuck Municipal Code
B. All billboards within the City of Chubbuck except those now existing are
prohibited.
C. Should property be annexed into the City of Chubbuck that has upon it an
existing billboard, said billboard shall be removed within five years of the effective date
of the ordinance annexing the property.
D. Any billboards existing at the time this ordinance is passed may remain but
shall not be altered, substantially repaired or relocated, except that the advertising
material upon the billboard may be changed as is common in the advertising industry.

E. If a billboard, or any portion of the sign, face, frame or supporting
mechanism is damaged, said billboard may not be repaired but must be removed within
30 days of the date of damage.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of
the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent of
such conflict. All other sections and provisions of Chapter 15 not herein amended shall
remain in full force and effect.
Section 2. Severability. If any provision of this ordinance is held invalid, for any
reason, by any court of competent jurisdiction, such holding shall not affect the validity
or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three
separate days, one of which shall be a reading in full, is hereby dispensed with, and this
Ordinance shall become effective upon its passage, approval and publication as provided
by law.
