ORDINANCE NO. 462
AN ORDINANCE OF THE CITY OF CHUBBUC& IDAHO, ADDING
CHAPTER 10.28, 'BICYCLES," TO PROVIDE FOR THE VOLUNTARY
REGISTRATION OF BICYCLES, REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE
PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN THIS
ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCY, IDAHO:
Section 1. Intent. The purpose for adopting this section is:
A. To reduce the occurrence of bicycle theft and subsequent loss of property
to bicycle owners in the City of Chubbuck.
B. To facilitate prosecution of thefts by establishing a city ordinance that
allows bicycles owned by residents of the City of Chubbuck to be registered through the
Police Department.
C. To provide a support program to facilitate the registration of bicycles,
keeping of registration records, and
D. To provide an understanding and willing compliance by the residents of the
city through positive public relations.
Section 2. Chapter 10.28. The following Chapter 10.28, 'Bicycles" is adopted as
part of the Chubbuck Municipal Code.

10.28.040 Inspection.
10.28.010 Manner of registration. Bicycles may be registered with the police
department, showing the proper name and phone number of the owner, the maker, serial
number, and general description of the bicycle, and the name of the person or dealer
from whom such bicycle was acquired. The chief of police may delegate the act of the
registration of bicycles to qualified individuals or groups. If there is not a manufacturer's
serial number on the bicycle one shall be assigned to it and either engraved on the bike
or evidenced by a decal issued by the police department at the time of registration.
10.28.020 Registration fee and transfer. A. A fee of One Dollar and Fifty Cents
($1.50) shall be charged for each bicycle registered.
B. At the time of transferring ownership of a bicycle, the new owner may
report the transfer to the police department.
10.28.030 Registration Decal. Upon payment of the registration fee and upon
proof of ownership by bill or sale or written affidavit, the Chubbuck police shall issue a
registration sticker to the person applying therefor, which sticker shall remain in force as
long as the applicant owns or is in possession of the bicycle to which it is assigned. If a

registration sticker is lost or destroyed, a replacement sticker may be obtained and
attached on the bicycle as required herein.
10.28.040 Inspection. It is a condition of the issuance of any registration sticker
that any police officer shall be permitted to inspect the bicycles at any reasonable time.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of
the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent of
such conflict.
Section 2. Severability. If any provision of this ordinance is held invalid, for any
reason, by any court of competent jurisdiction, such holding shall not affect the validity
or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three
separate days, one of which shall be a reading in full, is hereby dispensed with, and this
Ordinance shall become effective upon its passage, approval and publication as provided
by law.
