ORDINANCE NO. 467
AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, VACATING
THE JEFF LANE RIGHT-OF-WAY ON THE APPROVED AND RECORDED
PLAT OF BAR -X TRACTS SUBDIVISION, REPEALING PRIOR
CONFLICTING ORDINANCES; PROVIDING FOR THE SEVERABILITY
OF THE PROVISIONS OF THIS ORDINANCE; AND PROVIDING WHEN
THIS ORDINANCE SHALL BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Petition and Notice. A petition has been filed to vacate the plat or
portion of plat as described in Section 2. Notice of Public Hearing has been given as
required by Idaho Code S 50-1306A and a public hearing was held pursuant to statute on
September 23, 1986.
Section 2. Vacation. The Jeff Lane right-of-way shown on the original plat of
Bar -X Tracts Subdivision, being a subdivision located in NE; of Section 5, Township 6 S.
Range 34 EBM, Bannock County, Idaho and recorded March 2, 1977, as Instrument No.
571382 in the records of Bannock County, Idaho is hereby vacated.
Section 3. Recordine. The City Clerk shall transmit a certified copy of the
ordinance to the Bannock County Recorder for recording; subject however to the
provisions of Idaho Code S 50-1324 that all taxes due be paid by the landowner prior to
recording.
ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of
the City of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which
are in conflict with the provisions of this Ordinance are hereby repealed to the extent of
such conflict.

Section 2. Severability. If any provision of this ordinance is held invalid, for any
reason, by any court of competent jurisdiction, such holding shall not affect the validity
or enforceability of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three
separate days, one of which shall be a reading in full, is hereby dispensed with, and this
Ordinance shall become effective upon its passage, approval and publication as provided
by law.
