AN ORDINANCE OF THE CITY OF CHUBBUCK, IDAHO, AMENDING SECTION
13.04.095 TO PROVIDE THAT TURN ON/OFF FEE SHALL BE SET FROM TIME
TO TIME BY RESOLUTION OF THE CHUBBUCK CITY COUNCIL; AMEND
SECTION 13.04.040 TO PROVIDE FOR PRORATED BILLING WHERE PROPERTY
OCCUPIED FOR MORE THAN ONE MONTH; REPEALING PRIOR CONFLICTING
ORDINANCES; PROVIDING FOR THE SEVERABILITY OF THE PROVISIONS OF
THIS ORDINANCE; PROVIDING THAT ALL OTHER SECTIONS AND
PROVISIONS OF CHAPTER 13.04 NOT HEREIN AMENDED SHALL REMAIN IN
FULL FORCE AND EFFECT; AND PROVIDING WHEN THIS ORDINANCE SHALL
BECOME EFFECTIVE.
BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF
CHUBBUCK, IDAHO:
Section 1. Amended 13.04.040. Section 13.04.040 is amended as follows:
13.04.040 BillingPeriod. All services shall be billed on a monthly basis. The
billing period for water serve shall extend from the sixteenth day of one calendar month to
the fifteenth day of the succeeding calendar month. The billing period for garbage
collection and sewer service shall extend from the first to the last day of each calendar
month. Any lot, property, building or residence owned or occupied for a period e€ less
than at least one month shall be entitled to a prorata refund for any full day of the billing
period during which the premises were unowned or unoccupied.
Section 2. Amended 13.04.095. Section 13.04.095 is amended as follows:
13.04.095 Turn -on fees for water service. Except for the turn on/off fee provided
for in Section 13.04.080, there shall be no turn on-off fee for water service where
arrangements are made to have service turned on or off during the regular work wee
(Monday through Friday) between eight a.m. and five p.m. In the event water service is
turned on or off at any other time at the property owner's request, there shall be imposed,
in addition to other fees required by this title and chapter a turn on/off fee of ferty do!!
as set from time to time by resolution of the Chubbuck City Council, which fee shall be
paid before service is turned on or off.

ADMINISTRATIVE PROVISIONS
Section 1. Repeal of Conflicting Ordinances. The provisions of any Ordinance of the City
of Chubbuck, Idaho, and any provision of the Chubbuck Municipal Code which are in conflict
with the provisions of this Ordinance are hereby repealed to the extent of such conflict. All other
sections and provisions of Chapter 13.04 not herein amended shall remain in full force and effect.
Section 2. Severability. If any provision of this ordinance is held invalid, for any reason,
by any court of competent Jurisdiction, such holding shall not affect the validity or enforceability
of any of the remaining provisions.
Section 3. Effective Date. The rule requiring an ordinance to be read on three separate
days, one of which shall be a reading in full, is hereby dispensed with, and this Ordinance shall
become effective upon its passage, approval and publication as provided by law.
